SCHOOLS DIVISION OF BUKIDNON December 15, 2023 DIVISION_ MEMORANDUM No__Sel s. 2023 GUIDELINES ON THE REQUEST FOR PERMISSION TO TEACH IN PRIVATE SCHOOLS, SUCs, LUCs, ONLINE PLATFORMS AND OTHER INSTITUTION FOR ‘TEACHING, TEACHING-RELATED AND NON-TEACHING PERSONNEL TO: School Governance and Operations Personnel Curriculum Implementation Division Personnel Public Schools District Supervisor/District In-Charge Elementary /Secondary School Principals/ Head Teachers All Others Concerned 1. __ This is to reiterate existing Civil Service Rules and Republic Act 6713 entitled Code of Conduct and Ethical Standards for public officials and its implementing rules and regulations relative to private practice of profession or employment in private schools and other entities of all employees. 2. Section 18, Rule XIII of CSC Memorandum Circular No. 15, s. 1999 states that unless otherwise provided by law, no officer or employee shall engage directly or indirectly in any private business or profession without a written permission from the head of agency provided that his prohibition will be absolute in the case of those officers and employees whose duties and responsibilities require there entire time be at the disposal of the government, provide further that if an employee is granted permission to engage in outside activities, the time devoted outside of office hours should be fixed by the head of agency so that it will not impair in any way the efficiency of the officer or employee nor pose a conflict of interest with official functions. 3. Republic Act No. 6713 states that engagement in the private practice of profession by public officials and employees is a ground for administrative action, unless authorized by the Constitution or law, provided, that such practice will not conflict or tend to conflict with their official functions 4. Pursuant to Republic Act No. 6712, CSC Memorandum Circular No. 32, s. 1993 and other CSC Circulars, all are enjoined to adhere to the following: 4.1 Permission to teach maybe granted only for subjects or courses which are related to the field of the official or employee. This shall include the teaching and tutor load for classes which are conducted through online platforms, distance learning, and open university program of tertiary schools. 4.3 The conduct of classes whether through actual classroom contact or through online platforms shall be undertaken only after class hours for teaching personnel and after office hours for non-teaching personnel. Travel time from the employee's official station to the school or institution should be after class or office hours, as the case maybe. 4.4 The permission to teach shall be valid on a semestral basis while permission to engage in business shall be per contract basis not exceeding one (1) year. 4.5 Private practice of profession during official time and office hours will not be allowed, even if time spent is covered by corresponding vacation leave. 4.6 Depending on the location of the private practice, there should at least be thirty (30) minutes to one (1) hour interval between the close of the official time or office hours and the time of the private practice. 4.7 No official or employee shall be allowed to teach or practice profession in any school or institution over which he/she directly or indirectly exercise jurisdiction, control, supervision, or influence by reason of his office or position. 4.8 Officials and employees applying for permission to teach or practice 4. 9 4.9Officials and employees applying for permission to teach or practice profession must have obtained at least a Very Satisfactory rating from the last rating period. 4.10 Officials and employees applying for permission to teach must not have a record of being habitually tardy/undertime or habitually absent in the last school year. 4.11. Permission to teach or practice profession may be revoked at any time whenever the exigency of the service so requires, or if there are violations of the conditions set herein. This is without prejudice to administrative disciplinary action for violation hereof and in case of misrepresentations on the part of the applicant. 4.12 No official employee shall hold any position or assignment involving management or administration duties and responsibilities. Officials and employees who intend to teach as a practice of their profession should submit the necessary documents at least two (2) weeks before the effective date of the practice of profession. 8. Any violation of these provisions shall be dealt with accordingly. 9. Attached is the permit to teach template and sample certification of teaching load from school where the profession will be practiced. 10.
