The petitioner is aggrieved by

non-implementation of decision of respondent

No.1 to upgrade the post of Library Assistant

from BPS-12 to BPS-17.

2. The learned counsel for the petitioner

states that by letter dated 15.01.2016

respondent No.1 had directed that the post of

Library Assistant at ECO Postal Staff College is

to be upgraded from BPS-12 to BPS-17 and

that consequently the petitioner ought to be

granted the pay and privileges of the

upgraded post. He states that the same was

reiterated by letter dated 13.07.2016 and the

order was to be given effect as of 15.01.2016.

He states that subsequently the accounts

department refused to afford the petitioner

the pay entitlement for BPS-17 and by letter

dated 26.09.2019 held that the petitioner was

to be granted upgraded pay-scale of BPS-14.


He states that the matter was agitated before

the learned Federal Service Tribunal before

whom the respondents also admitted that the

post being occupied by the petitioner had

been upgraded from BPS-12 to BPS-17.

However, at the implementation stage the

learned Federal Service Tribunal came to the

conclusion that it was devoid of jurisdiction

and hence this petition.

3. Let notices be issued to the respondents

for 25.05.2023, who will file report and

para-wise comments within a period of two

weeks. The petitioner shall deposit the

requisite fee for issuance of the notices in the

office within a period of three days.
