TERMS OF USE – These Terms of Use apply to the Carnegie Mellon University Code in Alice

Program (the “Terms”)


BY APPLYING FOR THE PROGRAM AND/OR ACCESSING OR USING THE SERVICES
(DEFINED BELOW), YOU ARE AGREEING TO THESE TERMS. THESE TERMS ARE A
LEGALLY BINDING AGREEMENT BETWEEN YOU AND CMU WITH RESPECT TO THE
SERVICES. IF THESE TERMS OF USE ARE NOT ACCEPTABLE TO YOU, YOU MAY NOT
ACCESS OR USE THE SERVICES.
Introduction. The Code in Alice Program (the “Program”) is a virtual outreach program
operated by Carnegie Mellon University (“CMU”) in Qatar (“CMU-Q”). Its goal is to teach
computer programming to students between 13 and 18 years of age through an engaging on-
line experience. Student participants are taught in small groups by volunteer teachers. Students
will interact with volunteer teachers and other students via online platforms. Students and
volunteer teachers may be recorded in connection with the Program.
Restrictions. Students must be between 13 and 18 years of age. This Program is not open to
students or volunteer teachers who reside in Cuba, Iran, North Korea, Syria or the Crimea
region of Ukraine, or who are on a denied party list or affiliated with an organization on a denied
party list.

Volunteer Teacher Applications. Individuals interested in being volunteer teachers must file
an application via https://alice.qatar.cmu.edu/?page_id=8693&lang=en. Demographic
information (name, age, email address, background in computing, availability, country, and city
without address) will be collected from volunteer teacher applicants and they will be required to
submit an exercise and a video of themselves explaining a computer science concept.
Volunteer teacher applicants will be evaluated based on their qualifications and teaching skills
and selected for participation by CMU-Q in its sole discretion. By submitting an application, the
volunteer teacher applicant agrees to the Program Terms of Use and the Volunteer Teacher
Understanding and Release of Liability should they be selected to participate in the Program.

Student Applications.

Individuals under 18 years of age must file an application via


https://alice.qatar.cmu.edu/?page_id=8728&lang=en. Because applicants under 18 are
minors, their parent/guardian must review the application and related documents and agree to
them on behalf of their minor child. Demographic information (name, age, email address,
background in computing, country, and city without address) about student applicants and their
parents will be collected and applicants will be required to submit an exercise based on a
reading. Applicants will be evaluated based on their exercise and other Program criteria and will
be selected for participation by CMU-Q in its sole discretion. By submitting an application, the
parent/guardian agrees to the Program Terms of Use and the Parental Understanding and
Release of Liability should their child be selected to participate in the Program.

Individuals 18 and older must file an application at

age, email address, background in computing, country, and city without address) about student
applicants will be collected and applicants will be required to submit an exercise based on a
reading. Applicants will be evaluated based on their exercise and other Program criteria and will
be selected for participation by CMU-Q in its sole discretion. By submitting an application, the
applicant agrees to the Program Terms of Use and the Adult Student Understanding and
Release of Liability should they be selected to participate in the Program.

Online Platforms. Students and teachers will meet regularly via a Zoom link generated by the
Program team. Volunteer teachers will lecture via Zoom and students can interact by asking
questions, sharing screens, displaying code and chatting. In addition, students and teachers will
create an account on Piazza, a platform that provides access to Program information,
assignments and materials and enables group discussion. Users will be assigned to groups and
each user will create an account with a unique username-password combination that will
provide access to the assigned group. Users are not permitted to share their usernames or
passwords. Code in Alice uses the programming language Alice and all users must agree to
and abide by the terms of the Alice 3.0 End-User Agreement located at
https://www.alice.org/get-alice/alice-3/

Services. The Program provides teaching information, tools, materials and/or services such as
videos, pdf documents, presentations, exercises, homework and other similar materials for use
by volunteer teachers and students in conjunction with the Program. The Program and the
information, tools, materials and/or services such as videos, pdf documents, presentations,
exercises, homework and other similar materials (collectively, The “Services”).

Content. “Content” means all information, data, text, software, music, sound, photographs,
graphics, video, messages, tags, or other materials uploaded, posted, emailed, transmitted or
otherwise made available through the Services. "User Content" is any Content provided by
and/or originating from a user (regardless of whether a volunteer teacher or student).
“CMU/CMU-Q Content” is Content provided by and/or originating from CMU, CMU-Q, their
respective employees, representatives, licensors, content providers and contractors. As used
herein, "Content" refers to both User Content and CMU/CMU-Q Content unless expressly stated
otherwise. CMU and CMU-Q are not responsible for any User Content that that is uploaded,
posted, emailed, transmitted or otherwise made available through the Services. CMU and CMU-
Q do not guarantee the accuracy, integrity or quality of any Content. Under no circumstances
will CMU and/or CMU-Q be liable in any way for any Content, including, but not limited to, any
errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the
use of any Content uploaded, posted, emailed, transmitted or otherwise made available through
the Services. CMU/CMU-Q shall have the right (but not the obligation) in its sole discretion to
pre-screen, refuse, or remove any Content for any reason, including but not limited to, Content
that is deemed to be objectionable, inappropriate, inaccurate or deleterious to the Program,
CMU or CMU-Q.

Permitted Use. Subject to these Terms (and applicable third-party licenses), the Services may
be used by individuals enrolled in the Program as students or volunteer teachers for their own
personal, academic and educational and/or instructional use (which includes student instruction,
student work in the classroom and/or homework, grading, and educational activities). No other
rights are granted to the Services and individuals may not copy, reproduce, alter, modify, create
derivative works, or publicly display any part of the Services. CMU and/or its employees,
agents, representatives, licensors, content providers and contractors, as applicable own and
retain all intellectual property rights they have in and to the Services, including but not limited to
the CMU/CMU-Q Content.

Prohibited Uses/Activities. The following activities are prohibited with respect to the Services:
(a) using the Services or Content in a manner not permitted under Terms; (b) using another
user’s credentials to access and/or use the Services; (c) transmitting, submitting or accessing
any User Content without the right to do so; (d) transmitting or submitting any User Content or
otherwise taking any action using the Services that is harmful, threatening, abusive, harassing,
tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, infringing of the
rights of others, hateful, discriminatory or racially, ethnically or otherwise objectionable, or
encouraging and/or assisting others to engage in these activities; (e) interfering with, removing
or modifying any terms and conditions or other Content for the Services and/or any part of the
Services used for the operation and/or security of the Services; (f) impersonating any other
person or entity, or falsely stating or otherwise misrepresenting your affiliation with any other
person or entity; (g) knowingly uploading, posting, emailing, transmitting or otherwise making
available any User Content that contains software viruses or any other computer code, files or
programs designed to interrupt, destroy or limit the functionality of any computer software or
hardware or telecommunications equipment; (h) interfering with or disrupting the Services or
servers or networks connected to the Services, or disobeying any requirements, procedures,
policies or regulations of networks connected to the Services (including but not limited to those
of any relevant third party service providers used in connection with the Services); and (i) taking
CMU/CMU-Q Content from the Services and reformatting it and/or displaying it on any other
website.

Termination of Services. CMU/CMU-Q retains the right to revoke, suspend and/or terminate
any or all user account privileges at any time for any reason in its sole discretion including, but
not limited to, violation of these Term. Neither CMU/CMU-Q shall not be liable to users or third
parties for revoking, suspending or terminating any user account or access to the Services.

If a user account becomes compromised, or if a user leaves and/or is no longer expected to use
or access the Services, please notify CM-Q by contacting CMU-Q Program in Alice as soon as
possible so that CMU-Q may de-activate the applicable user account.

Use of Third Party Providers. The Services and software embodied within or used in coaction
with the Services may include security components that permit digital materials to be protected,
and that use of these materials is subject to usage rules set by CMU/CMU-Q and/or Content
providers. In addition, the Services may include tools or other features designed to protect the
integrity of certain materials, provide security-related features (such as automatically logging off
a user after a period of inactivity) and/or detect improper activity with respect to the Services.
Users may not attempt to override or circumvent any of the usage rules embedded into the
Services. CMU/CMU-Q will or may use third party service providers to support portions of the
Services.

Use of Information. CMU/CMU-Q has the right to access, preserve and/or disclose account
information and Content if required to do so by law or if in good faith CMU/CMU-Q believes that
such access preservation or disclosure is reasonably necessary to: (a) comply with legal
process; (b) enforce these Terms; (c) respond to claims that any Content violates the rights of
third parties; (d) respond to requests for assistance; or (e) protect the rights, property or
personal safety of CMU/CMU-Q, users of the Services and/or the public. Further, CMU/CMU-Q
reserves the right to cooperate with legitimate law enforcement requests for information. In
addition, CMU/CMU-Q has the right to use data and information obtained or collected through
the Services to provide and/or improve the Services and/or for research or other activities
consistent with CMU’s status as a 501(c)(3) organization, provided that CMU (including CMU-Q)
removes individually identifiable personal information (if any) contained in such data or
information prior to any related publication.
License to User Content. By submitting User Content, CMU (including CMU-Q) is hereby
granted a worldwide, royalty-free, non-exclusive perpetual, irrevocable and fully sub-licensable
license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform and
publicly display such User Content (in whole or in part) as necessary to provide and/or improve
the Services and/or for research or other activities consistent with CMU’s status as a 501(c)(3)
organization, provided that CMU (including CMU-Q) removes individually identifiable personal
information (if any) contained in such data or information prior to any related further publication.

Disclaimer of Warranties. THE SERVICES, INCLUDING ALL INFORMATION, TOOLS AND


MATERIALS PROVIDED OR ACCESSED IN CONNECTION WITH THE PROGRAM, ARE
PROVIDED "AS IS," WITHOUT WARRANTY OR REPRESENTATION OF ANY KIND. CMU
(INCLUDING CMU-Q), AND ITS TRUSTEES, OFFICERS, EMPLOYEES, AGENTS,
REPRESENTATIVES, AFFILIATES, LICENSORS, CONTENT PROVIDERS, CONTRACTORS
(INCLUDING ANY THIRD PARTY PROVIDERS) AND SPONSORS (COLLECTIVELY THE
“PROGRAM PARTIES”) EXPRESSLY DISCLAIM TO THE FULLEST EXTENT PERMITTED BY
LAW ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES AND DUTIES, INCLUDING,
WITHOUT LIMITATION: THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, AND NON-INFRINGEMENT; ANY WARRANTIES REGARDING
THE SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE OF THE SERVICES;
ANY WARRANTIES FOR ANY GOODS, INFORMATION OR ADVICE OBTAINED THROUGH
THE SERVICES REGARDLESS OF SOURCE (INCLUDING BUT NOT LIMITED TO ANY
GOODS OR INFORMATION OR ADVICE RECEIVED THROUGH ANY LINKS PROVIDED IN
THE SERVICES).THE PROGRAM AND SERVICES COULD INCLUDE TECHNICAL OR
OTHER MISTAKES, INACCURACIES OR TYPOGRAPHICAL ERRORS OR BE OUT OF
DATE. CMU (INCLUDING CMU-Q) DOES NOT REPRESENT THAT THEY ARE FREE FROM
ERRORS, OR SUITABLE FOR ANY PARTICULAR TASK. USERS UNDERSTAND AND
AGREE THAT THEY ARE USING ANY AND ALL INFORMATION, MATERIAL, DATA AND/OR
OTHER CONTENT THROUGH THE USE OF THE SERVICES AT THEIR OWN RISK AND
THAT THEY WILL BE SOLELY RESPONSIBLE FOR ANY RESULTING DAMAGES TO THEIR
COMPUTER SYSTEMS OR LOSS OF DATA.

Limitation of Liability; Limitation of Damages. UNDER NO CIRCUMSTANCES SHALL CMU


(INCLUDING CMU-Q) OR ANY OTHER PROGRAM PARTIES BE LIABLE TO USERS ON
ACCOUNT OF USE OR MISUSE OF OR RELIANCE ON THE SERVICES ARISING FROM
ANY CLAIM RELATING TO THESE TERMS OR THE SUBJECT MATTER HEREOF. SUCH
LIMITATION OF LIABILITY SHALL APPLY TO PREVENT RECOVERY OF INDIRECT,
INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, AND PUNITIVE DAMAGES
WHETHER SUCH CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING
NEGLIGENCE), OR OTHERWISE, (EVEN IF CMU (INCLUDING CMU-Q) AND/OR ANY OF
THE PROGRAM-STEM PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH
DAMAGES). IN ADDITION, IN NO EVENT SHALL CMU (INCLUDING CMU-Q) OR ANY OF
THE OTHER PROGRAM PARTIES BE LIABLE FOR DIRECT DAMAGES RELATING TO
THESE TERMS OR THE SUBJECT MATTER HEREOF. SUCH LIMITATIONS ON LIABILITY
AND DAMAGES SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL
PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY
LAW.

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, USERS, ON BEHALF


OF THEMSELVES AND THEIR HEIRS, EXECUTORS, ADMINISTRATORS, PERSONAL
REPRESENTATIVES, BENEFICIARIES, AGENTS, SUCCESSORS AND ASSIGNS, HEREBY
IRREVOCABLY AND UNCONDITIONALLY REMISE, RELEASE AND FOREVER WAIVE ANY
AND ALL MANNER OF CLAIMS, SUITS, ACTIONS OR DEMANDS AGAINST CMU
(INCLUDING CMU-Q) AND AMY OTHER PROGRAM PARTIES ARISING OUT OF OR
RELATING TO THE ACCESS TO AND/OR USE OF (OR INABILITY TO USE) THE SERVICES
WHETHER ARISING OUT OF CMU’S (INCLUDING CMU-Q) AND/OR ANY OF THE OTHER
PROGRAM PARTIES’ NEGLIGENCE OR OTHERWISE.

Force Majeure. CMU (including CMU-Q) or any other Program Parties are not liable for any
delay or failure in performance resulting directly or indirectly from acts of nature, forces, or
causes beyond its control, including, but not limited to, Internet failures, computer equipment
failures, telecommunication equipment failures, electrical power failures, strikes, labor disputes,
riots, insurrections, civil disturbances, pandemic or epidemic disease, shortages of labor or
materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of
courts or tribunals, or non-performance of third parties.

Governing Law; Disputes. These Terms and any disputes related to them shall be governed
by and construed under the laws of the Commonwealth of Pennsylvania without regard to
conflicts of law provisions in that or any other jurisdiction.

Miscellaneous. If any provision of these Terms is held to be invalid or unenforceable, such


provision shall be deemed superseded by a valid enforceable provision that most closely
matches the intent of the original provision and the remaining provisions shall be enforced.

Amendments. CMU expressly reserves the right to change these Terms from time to time
without notice to you. It is your responsibility to review this site and these Term from time to time
and to familiarize yourself with any modifications. Continued use of the Services after such
modifications will constitute acknowledgement of the modified Terms and agreement to abide
and be bound by the modified Terms.
