CAR RENTAL AGREEMENT

This agreement is hereby made between:

______________________________________, single/married, Filipino, of legal age,

and a resident of ______________________(hereafter referred to as "the Lessee")

and

_______________________________________, single, Filipino, and a resident of

Tacloban City, Philippines (hereafter referred to as "the Owner").

The Owner hereby agrees to rent the following vehicle to the Lessee, subject to the
terms and conditions stated below, the parties agree as follows:

A. RENTAL PERIOD and Rate. The owner agrees to rent the vehicle to the Lessee
for a period of _______________ as stated below.

Any extension of more than _________ hrs shall be considered as an extension of one
(1) full day.

The Lessee hereby agrees to return the above-described vehicle to the pickup
location no later than the date and time indicated above.

The Lessee agrees to return the vehicle in the current condition it was initially
turned over (minus normal road wear-and-tear) to the Owner on the return date and
hour, fully fueled up.

The Lessee understands that the vehicle is for use only within Leyte. In no event
shall the vehicle be brought outside the Leyte Province without prior authority or
agreement. Should the same vehicle be used outside Leyte Province, the Security
Deposit shall be forfeited, and agrees to pay an additional liquidated damages of
P______________.

a. All fuel used shall be paid for by the Lessee.

b. The Lessee authorizes the owner to charge all amounts payable to the
Lessee’s account. The Lessee’s account means a nominated debit card,
credit card, or pre-arranged charge account;

B. DEPOSIT. The Lessee agrees to make a deposit of P5,000.00 with the owner, said
deposit to be used, in the event of loss of or damage to the vehicle or equipment

during the term of this Motor Vehicle Rental Agreement, to defray fully or
partially the cost of necessary repairs or replacement.

In the absence of damage or loss, said deposit shall be credited toward

payment of the rental rate and any excess shall be returned to the Lessee.

C. CONDITION OF THE VEHICLE.

a. The owner states that to the best of his knowledge and belief that above-
described vehicle is in sound and safe condition and free of any known
defects or faults which would affect its safe operation under normal use.

b. The Lessee has inspected the vehicle prior to pick-up and confirms that it
is free of any damage and that the fuel tank is at FULL TANK;

c. Lessee is responsible for returning the vehicle with as much fuel in the
tank as when received. If the Lessee returned the vehicle with less fuel
than we supplied it with, a fuel surcharge applies. Owner, determines
how much fuel is needed by the refilling of the fuel tank.

D. RESPONSIBILITY FOR LOSS OR DAMAGE TO THE VEHICLE.

Lessee is responsible for the FULL VALUE of the vehicle, regardless of fault.
Lessee further warrants to replace/repair any damage on the rented vehicle. Any
expenses for such replacement or repair shall be for the account of the Lessee.In
case of any damage, LESSEE IS RESPONSIBLE to contact and report to the
OWNER.

a. IN CASE OF DAMAGE TO VEHICLE: Lessee must secure Police Report,

photocopy of driver's license, and will pay Participation Fee + 100% of the
daily rate while the vehicle is serviced by authorized service center, or for
the entire duration thereof.

b. LOST / DAMAGED KEYS: Lessee's failure to return car keys is

automatically charged with fee of P7,500.00.

c. Total loss of the rented vehicle for whatever reason shall be for the
account of the lessee, based on the prevailing value of the rented vehicle.

E. QUALIFICATIONS. The Lessee states that he/she is physically and legally

qualified to operate the above-described vehicle. The vehicle may be driven
during the term of hire only by the person/s named on this Rental Agreement

and only if they hold a current valid driver’s license appropriate for the vehicle
for the entire period of the rental agreement.

F. RELEASE OF LIABILITY. OWNER is not liable or responsible for any losses of

any valuables left in the car. The Lessee hereby undertakes and guarantees that
the car shall be used and operated for lawful purposes and in strict conformity
with all applicable laws, ordinance, and regulations. If the Lessee used or
permits the use of vehicle for any unlawful purpose, he shall render OWNER
harmless from any and all connected therewith. OWNER shall not be responsible
for any unforeseen happenings beyond human control during the duration of
this Contract that may damage or prevent the car from reaching the destination
on time.

G. EFFECTIVITY. This AGREEMENT shall take effect upon the delivery/pick-up

of the rented vehicle.
