Defendant,

The below-named complaining witness being first duly sworn states the following:

Count 1: MISDEMEANOR BATTERY, DOMESTIC ABUSE ASSESSMENTS

The above-named defendant on or about Monday, May 28, 2018, in the City of Madison, Dane
County, Wisconsin, did cause bodily harm to MLN, by an act done with intent to cause bodily
harm to that person, without that person's consent, contrary to sec. 940.19(1), 939.51(3)(a),
973.055(1) Wis. Stats., a Class A Misdemeanor, and upon conviction may be fined not more
than Ten Thousand Dollars ($10,000), or imprisoned not more than nine (9) months, or both.

And further, invoking the provisions of sec. 973.055(1) Wis. Stats., because this charge is an
act of domestic abuse, and further, invoking sec. 973.055(1), Wis. Stats., the court shall
impose the domestic abuse assessment of $100 for this offense because this charge is an
enumerated crime under sec. 973.055(1)(a)1, Wis. Stats., and the conduct constituting the
violation involved an act by the defendant against his or her spouse, against an adult with
whom the defendant resides or formerly resided, or against an adult with whom the defendant
has created a child.

Count 2: CRIMINAL DAMAGE TO PROPERTY, DOMESTIC ABUSE ASSESSMENTS

The above-named defendant on or about Monday, May 28, 2018, in the City of Madison, Dane
County, Wisconsin, did intentionally cause damage to the physical property of another, a fan,
belonging to MLN, without that person's consent, contrary to sec. 943.01(1), 939.51(3)(a),
973.055(1) Wis. Stats., a Class A Misdemeanor, and upon conviction may be fined not more
than Ten Thousand Dollars ($10,000), or imprisoned not more than nine (9) months, or both.

And further, invoking the provisions of sec. 973.055(1) Wis. Stats., because this charge is an
act of domestic abuse, and further, invoking sec. 973.055(1), Wis. Stats., the court shall
impose the domestic abuse assessment of $100 for this offense because this charge is an

Count 3: DISORDERLY CONDUCT, DOMESTIC ABUSE ASSESSMENTS

The above-named defendant on or about Saturday, June 2, 2018, in the City of Madison, Dane
County, Wisconsin, while in a private place, did engage in violent, abusive, indecent, profane,
boisterous, unreasonably loud and/or otherwise disorderly conduct, under circumstances in
which such conduct tended to provoke a disturbance, contrary to sec. 947.01(1), 939.51(3)(b),
973.055(1) Wis. Stats., a Class B Misdemeanor, and upon conviction may be fined not more
than One Thousand Dollars ($1,000), or imprisoned not more than ninety (90) days, or both.

And further, invoking the provisions of sec. 973.055(1) Wis. Stats., because this charge is an
act of domestic abuse, and further, invoking sec. 973.055(1), Wis. Stats., the court shall
impose the domestic abuse assessment of $100 for this offense because this charge is an
enumerated crime under sec. 973.055(1)(a)1, Wis. Stats., and the conduct constituting the
violation involved an act by the defendant against his or her spouse, against an adult with
whom the defendant resides or formerly resided, or against an adult with whom the defendant
has created a child.

FACTS:

Your complainant is a Detective with the City of Madison Police Department and for this
complaint is relying on the official written police report submitted by City of Madison Police
Officer Mark Gulden.

Officer Gulden reports on June 3, 2018, at 12:32 A.M., he was dispatched to a residence
located on Sherman Terrace, in City of Madison, Dane County, Wisconsin, in reference to a
physical disturbance that had occurred.

Upon arrival, Officer Gulden was met by the complainant/victim, who was identified with a
name that forms the initials MLN. Officer Gulden asked MLN if she was injured and needed
medical treatment, to which she stated she did not. MLN stated that her roommate, who she
verbally identified as John A. Owen, date of birth November 10, 1991, the defendant herein,
had physically assaulted her at approximately 8:00 P.M., on June 2, 2018, inside of their
residence on Sherman Terrace, in the City of Madison, Dane County, Wisconsin. MLN stated
she has resided at the Sherman Terrace apartment since approximately March. MLN stated
she is not a leaseholder, that she does not have keys to the apartment; however, she has slept
in the spare bedroom every night for the past few months.

MLN explained that on June 2, 2018, at approximately 7:47 P.M.,, she was sitting in the living
room with John Owen, the defendant, having a discussion about Owen having a bad day.
MLN continued that Owen made accusations to MLN in reference to MLN not caring about
Owen’s situation and he called her selfish and accused her of not wanting to help him. MLN
stated that Owen was speaking loudly and aggressively to her. MLN stated she had enough
and retreated to her bedroom to let the situation deescalate. When MLN was in her room, she
was seated on a futon when Owen forcefully pushed the door open and entered her bedroom.

Owen bent down and grabbed the futon with both hands and flipped it over backwards. MLN
stated Owen was shouting incoherently at her while he was physically flipping the futon over
backwards. MLN reported that she slid off the futon, which landed on top of her striking her in
her left leg, which caused a bruise and a small puncture wound to her leg. MLN stated that
after Owen flipped the bed over he yelled at her, “See what you do to me, you make me so
angry.”

MLN stated she did not consent to being injured or flipped on the bed, and that she felt like a
“rag doll” and completely helpless. MLN reported that being flipped over on the bed caused
her pain in her left leg.

MLN further explained that John Owen, the defendant, has been physically abusive in the past.
MLN reported that on Monday, May 28, 2018, sometime in the early evening hours, she was
sleeping on her futon in her bedroom when Owen physically forced his way through her door,
causing the locking mechanism in the door to break. MLN stated that Owen was upset that
she was using a fan with a built in heater. MLN stated that Owen, after physically pushing
through the door, had cut the cord to her fan while shouting at her loudly. At the time, MLN
was unsure of how the cord was cut and it was later determined through admissions of Owen
that the cord was cut with a pliers.

MLN stated after Owen cut the cord to the fan, MLN tried to gather her belongings in order to
leave the residence. MLN stated Owen was removing MLN’s property from the bedroom and
attempting to toss it out the back door. When MLN came back to the bedroom area, which is
adjacent to the living room, Owen threw a heavy laundry basket at her, which caused her to fall
to the ground, resulting in multiple bruises and cuts to her leg. MLN stated that Owen struck
her in the face with an open palm, striking her in her nose, which caused yellow and blue
bruising underneath both of her eyes and to the bridge of her nose.

Officer Gulden observed bruising to both eyes and the bridge of her nose. MLN showed
Officer Gulden cell phone photos that she had taken of herself of her injuries. Officer Gulden
provided MLN with a business card and an email address and asked her to email the
photographs to Officer Gulden of the injuries on the day that it had occurred.

Officer Gulden asked MLN if she consented to being struck, to which she stated she did not.
Officer Gulden asked MLN if being struck in the face caused her pain, to which she stated,
“Hell yeah it hurt.”

MLN stated the value of the fan is $20.00. MLN did not consent to Owen’s actions.

MLN said that after being struck in the face, Owen stated to her, “You make me so mad, there
is something in this house that makes me angry.”

MLN stated that she is afraid for her safety and of what is going to happen to her after this
incident. MLN stated that Owen was currently in the apartment and sleeping in his bedroom.
MLN gave Officer Gulden consent to enter the apartment to make contact with Owen.

Officer Gulden reports he made contact with a man who was identified verbally as John A.
Owen, date of birth November 10, 1991, the defendant herein, who was sleeping in his
bedroom, which is adjacent to MLN’s bedroom. Officer Gulden identified himself to Owen and

the reason for the contact. Officer Gulden gave Owen a few moments to gather his thoughts
and to wake up. Officer Gulden’s initial observations of Owen was that he was easily
excitable, appeared confused, and increasingly became upset throughout the contact. During
the contact, Owen was speaking loudly in an aggressive tone. Officer Gulden asked Owen to
describe the events that had occurred throughout the evening.

Owen stated that he had come home from work on June 2, 2018, and was “bummed out.”
Owen stated that it was only a verbal argument and denied that anything physical had
occurred. Owen reported that he did enter MLN’s room forcefully, and when he did, he stated
that the futon was pushed against the door, and when he forced his way into the room it
caused it to flip over.

Officer Gulden asked Owen about the incident that had occurred on May 28, 2018, and asked
him if he had punched MLN in the face. Owen emphatically denied physically punching MLN.
In regards to the incident with the heater/fan, Owen stated, “Yeah, I cut it with a pliers and
began arguing with her.” Owen stated that it was a poor decision to cut the cord on the fan.

**THIS COMPLAINT IS BASED ON the information and belief of your complainant, who is a
Detective for the City of Madison Police Department, and who learned of the above offense
from the reports of City of Madison Police Department Police Officer Mark Gulden, which
report your complainant believes to be truthful and reliable inasmuch as they were prepared
during the course of the officer’s official duties.

Further, your complainant believes the information furnished by MLN to be truthful and reliable
inasmuch as she is a citizen informant and witnessed the events described.

Your complainant believes the statements of the Defendant to be truthful and reliable insofar
as they are admissions against penal interest.
