!0heteas, the Hon'ble High Court of Delhi vide their order dated 20.10.2014 in \\,?
No. 2780/11 filed by Dr. C.S. Sahukar & Others directed this department'!o ensure that
DACP is granted to veterinary officers on the basis of the CPC's recommendations
implementation to GDMOS and Dental doctors from the date the latter category @ental
Doctors) u,ere given that benefit'

2. \\,hereas, this Department in consultation s'ith the DePtt. of Expendirure and

Deptt. of Legal Affaits frled a SLP in the Hon'ble Supreme Court of India challenging the
direction given bv the Hon'ble High Coun of Delhi and the Hon'ble Supreme Coun oi
india dismissed the SLP No. 3505 of 2015 filed by this Depanment.

3- \\,'hereas, this Deparmrent consuited the Deptt. of Expenditure and Deptt of Leqal
Affairs in r'-iew of the dismissal of SLP filed by this Department and the Depn. of
Expenditure advised this Department to implement the order dated 14.10.2014 of the
Hon'ble High Court of Delhi in case ,.lf petitioners with the following observations :

'As regards the question of its extension to similariy placed petsons, a suitable
proposal bringing out the flumber of employces involved, the financial implicauon
and also the financial implications based on rvithdrawing Modified Assured Career
Progression O{ACP) as both the MACP and DACP cannot be given together, mav
be worked out'

4. v,hereas, the direcuons of the Hon'ble High Court of Delhi vide their order dated
14.10.20.14 has been considered by dris Department in consultadon u'ith Deptt. of
Expenditure and Deptr of Legal Affairs as recorded above for extending the beneflts oi
DACp scheme o rhe 24 veterinarians of the f)epartment being the peutioners in the \\'P
No. 2780/11 filed by Dr. c.S. Sahukar & others frorn the date of the benefit giveo to the
Dental Doctors by the Ministry of Health and Family welfares vide their order No. A
45012/1./2002-CHS. \'l dated 25.08.2006 atd a 4501'2/2/2008-CHS.V dated 29.10.2008'

DACP scheme provides promotion to the Cenffal Health Service Officers wtthout linkage
to vacancies upto the level of NFSG (Director level) w.e.f. 29.08.2A06 and up to the level
of SAG (]S level) w.e.f . 29.07 .2008 as per order issued b1, the M/o Health and FamilI
\X'elfare recorder above. The details are as under in case suitably modified for Veterinarians
in DADF:

5. Nou' therefore, the approval of the competent aurhorlq, is contel'ed for
implementing the DACP scheme in respect of the Veterinanans peuuoners, pertairung
to DADF, in the '{? No. 2780/11 filed by Dr. C.S. Sahukar & Others as extended t<r
the Dental Doctors by the Min. of H&FW as recorded above after follov'ing due
procedures Iike Depanmental Promotion Committee and fulfilment of other
formalities as pet DOP&Ts insuuctions in this Department. Other conditions for
effecting ptomotions will be governed by the pror,rsions of Recruitrnent Rules
pertaining to tlre Veterinatians of DADF. On implementation of DACP scheme, the
NTACP already sanctioned to the veterinarians will stand withdrawn.

6. The amendments to the relevant recruitrnent rules whenever necessan'

consequent upon the above decision, shall be made in due course
