LIVERY CONTRACT

This Agreement is made on

(2) OWNER:

The Owner is the owner of the Horse or the person to which the Horse has been loaned and wishes to
engage the Yard to carry out the Services in respect of the Horse in accordance with this Agreement.
IN CONSIDERATION OF the payments and mutual promises contained in this Agreement the Yard and the
Owner agree as follows:

1. THE SERVICES
1.1 The Yard shall at all times during the Term provide the Services in an efficient and professional
manner which meets the welfare needs of the Horse and in so doing will exercise all the skill, care
and diligence that might be expected of a competent and properly qualified livery yard.
1.2 The Owner will notify the yard in good time of any information or documents required by the Yard
to enable it to perform the Services including without liability, any know vices, medical conditions
and any special requirements of the Horse.
1.3 During the Term the Yard will keep appropriate records of all the acts and work done by it in
relation to the Services and at the request of the Owner, the Yard shall make available for
inspection and/or provide copies to the owner.

2. FACILITIES TO BE PROVIDED BY THE YARD & DUTIES OF THE YARD


2.1 Throughout the Term the Yard shall give the Owner access during the business hours of the yard, to
the Horse and all premises where the Horse is kept.
2.2 The Owner shall observe any rules or requirements relating to those premises as notified to the
Owner by the Yard.
2.3 The Yard shall develop and publish, with veterinary advice a yard health policy to include without
limitation policies on worming and vaccination.
2.4 The Yard shall ensure that all persons wear appropriate dress at all times when in the vicinity of the
Horse, including without limitation, a hat conforming to BSI standards and suitable footwear with a
flat sole and a small heel.

3. DUTIES OF THE OWNER


3.1 The Owner shall ensure that the Horse is provided with all those matters set out in Schedule 4.
3.2 In the event that the Owner fails to ensure that the Horse is provided with any matters listed in
Schedule 4, the Owner agrees that the yard may undertake this work and charge the Owner in
accordance with the sums set out in this Agreement or where not covered by this Agreement, at
the market rate.
3.3 The Owner agrees that in the event that the manager of the yard believes that the Horse is in need
of urgent veterinary / farrier attention, the Yard may summon a veterinary surgeon / farrier and
authorise any essential treatment, provided that the Yard makes all reasonable attempts to contact
the Owner before such work is carried out. The Owner agrees to take responsibility for veterinary /
farrier fees incurred in accordance with this paragraph.
3.4 The Owner shall inform the Yard if the Horse is to be absent from the Yard’s premises overnight and
when the dates that the Horse will leave and return to the Yard’s premises.
3.5 The Owner shall ensure that no children under the age of 16 years are bought onto the premises of
the Yard unless under the supervision of the Owner, or a nominated adult, at all times.
3.6 The Owner shall wear appropriate dress at all times when riding the Horse, including without
limitation, a hat conforming to BSI standards and suitable footwear with a flat sole and a small heel.

4. FEES, TERMS OF PAYMENT & FINANCIAL MATTERS


4.1 In consideration for the provision of the Services, the Owner will pay to the Yard the Fee and any
additional sums due under this Agreement by monthly bank transfer one month in advance.
4.2 In the event that the Fee or any additional sum due under this Agreement remains unpaid for more
than three (3) months after they first become due, the Owner agrees that the Yard may sell the
Horse provided that written notice has been given to the Owner (at the address set out at the
beginning of this Agreement) of the intention to sell at least seven (7) days before sale. From the
monies received from the sale of the Horse the Yard may retain such sums as cover of any unpaid
sums due under this Agreement and the reasonable costs of sale. Any remaining money shall be
returned to the Owner within thirty (30) days of the sale.
4.3 Payments are to be made by Standing Order to the following account details:

5. TERM & TERMINATION


5.1 This Agreement is initially for three (3) calendar months from the date it is signed, as all liveries are
accepted on a temporary three (3) month probation period.
5.2 During the probation period the Yard or the Owner may terminate the Agreement early as laid out
in Schedule 1.
5.3 After satisfactory completion of the Probation Period this Agreement shall last for the Term, subject
to earlier termination in accordance with this Agreement.
5.4 The Yard or the Owner may at any time terminate this Agreement or any part of it by giving written
notice to the other of not less than the Notice Period.

6. GENERAL
6.1 No amendment of the terms of the Agreement shall be valid or binding unless made by prior
written agreement between the Yard and the Owner.
6.2 This Agreement shall in all respects be governed by and construed in accordance with English law
and the parties herby submit to the exclusive jurisdiction of the English Courts.

SCHEDULE 1 – Definitions

TERM MEANING
“Business Hours” The business hours of the Yard are : 06.00 Hrs to 22.00 Hrs
“Fee(s)” The fees are set out in Schedule 3

“Notice Period” During the three (3) month probation period, the Notice Period is one (1)
weeks, after which time it becomes and remains one (1) full calendar
month’s notice required to terminate this agreement.
“Services” The standard livery services listed in Schedule 2 of this Agreement and such
additional services from Schedule 3 that the Yard and the Owner may agree.
“Term” This Agreement shall last until either the Yard or the Owner terminates it,
after completion of a three month probation period.
“Probation Period” This is a temporary contract for three (3) calendar months from the date of
signing only initially. During this time the terms of the Agreement remain
but the termination period is reduced to one (1) week. On satisfactory
completion of the Probationary period the full Notice Period is required.
SCHEDULE 2 – Standard Services

1. The Yard shall provide the following livery services in respect of the Horse:

1.1 at all times, a dry stable with adequate light and ventilation; and
1.2 when required, an area of hard standing where the Horse may be groomed, shod etc; and
1.3 during the winter and summer months, grazing subject to the availability of grass and
weather conditions; and
1.4 at all times an unlimited supply of fresh, clean water available to be taken to fields or
stables; and
1.5 at all times, secure fencing to all areas used by the Horse.
1.6 Whilst the yard will try to offer 365 turnout, weather and ground conditions may reduce this
availability. If winter grazing is to be removed, then the yard will provide one (1) weeks’
notice of this and the owner will be required to keep the horse stabled.

2. The Yard shall use its best endeavours to ensure that there is provision to heat water and
provide adequate light sufficient to examine and provide veterinary care to the horse.

3. The Yard shall provide a tack storage facilities for Owners

4. The fee for these standard services shall be £100.00 per calendar month.

5. The Fee is to be paid monthly in advance by bank transfer.

SCHEDULE 3 – Additional Services

The charges for these items will be invoiced by the Yard to the Owner on a monthly basis payable within
one (1) month of the delivery of the invoice.
SCHEDULE 4 – Duties of the Owner

The Owner shall at all times remain responsible for ensuring that:

1. The Horse is checked twice daily if stabled.


2. The Horse is fed twice daily if stabled and left with hay nets filled.
3. The Horse is to be supplied with fresh clean water daily, you may need to bring water in buckets or
containers to your paddock.
4. To take reasonable care of fields to minimise poaching at gateways.
5. The Horse is mucked out daily when stabled
6. If reduced grazing is required, the owner will provide the electric fencing, fencer and battery.
7. To check any electric fencing used for safety and charge daily
8. To prevent the horse causing damage to fencing or gates
9. The Horse is provided with adequate hard feed
10. The horse is exercised regularly according to its needs
11. The Horse is attended by a registered farrier every 12 weeks if unshod and every 7 weeks if shod.
12. The Horse is wormed in accordance with the Worming Policy of the Yard (Schedule 6)
13. The Horse is vaccinated in accordance with the Health Policy of the Yard (Schedule 7)
14. Third party insurance is maintained in respect of the Horse.
15. A copy of the passport of the Horse is to be provided to the Yard.

SCHEDULE 5 – Current Prices

The prices for the following items are subject to market forces and therefore will fluctuate.

Prices as at 1 January 2018:

Livery charges £100.00 per calendar month per horse

SCHEDULE 6 – Worming Policy

The Yard operates an “Intelligent Worming” Policy.


All liveries are required under the terms of their Livery Agreement to adhere to the Worming Policy.

FEBRUARY Worm Count (Paid for by the Owner)


Horse wormed according to the results of the worm count.
Horses MUST NOT be wormed if low or zero count found.
Wormers issued as required by the Yard, payable by the Owner.

MAY Worm Count (Paid for by the Owner)


Horse wormed according to the results of the worm count.
Wormers issued as required by the Yard, payable by the Owner.
AUGUST Worm Count (Paid for by the Owner)
Horse wormed according to the results of the worm count.
Wormers issued as required by the Yard, payable by the Owner.

NOVEMBER Worm Count (Paid for by the Yard)


Horse wormed according to the results of the worm count.
Wormers issued as required by the Yard, payable by the Owner.
All horses wormed for Tapeworm, payable by the Owner.

The Yard will ensure that a rotation of wormers is used where applicable to reduce the chance of
resistance.

All Owners are responsible for poo picking the field in which their Horse is turned out.

All new Horses are required to have a worm count prior to arrival and to be wormed according to the
results of the worm count. The worm count will be paid for by the Yard, but any wormers required will be
paid for by the Owner.

SCHEDULE 7 – Health Policy

Vaccinations
The Yard does not insist that the Horse is vaccinated but would strongly recommend that it is.

Veterinary Care
The Yard routinely used the following veterinary practices, if the Owner wishes alternative Veterinary
Practices to be used for their Horse, they must ensure the full contact details are included in Schedule 1 of
the Agreement.

Farriery
The yard routinely uses the following Farrier, if the Owner wishes alternative Farriers to be used for their
Horse, they must ensure that the full contact details are included in Schedule 1 of the Agreement.

The Farrier visits the Yard every six (6) weeks and horses may be booked in as required for that standard
appointment. Appointments are always 06:00 Hrs, so horses requiring the farrier must be stabled over
night. Owners will be responsible for turning horses out after the farrier, unless prior arrangements have
been made with the Yard.

Health Issues
The Owner must notify the Yard if the Horse is ill, under medication, receiving veterinary care or has other
health issues with 24 hours. The Yard will notify the Owner as soon as they become aware, if the Horse
may have, whilst on the Yard, come into contact with any known illness or disease within 24 hours. The
Owner must adhere to any restrictions placed on the facilities or use of the Horse, if placed, to ensure the
health and welfare of the Horse, and where reasonable. The Yard will only impose restrictions where they
are deemed necessary to protect the welfare of the Horse.

Contagious Diseases
The Yard has an isolation stable at the bottom of the facility, which is to be used when the Horse needs to
be isolated for the protection of other equines on the premises. During isolation turnout may be restricted
by the Yard. All contagious diseases will be overseen by the veterinary practice and any protocols from the
authorities adhered to.

Strangles Prevention
If a strangles outbreak is confirmed in the area the Yard will advise all owners once it is informed. In the
instance of a strangles outbreak in Carmarthenshire, Pembrokeshire or Ceredigion the following process
will be followed by all new liveries:
Isolation of horse for three weeks from all other horses both stabled and in field.
On completion of isolation period the horse will be integrated with other horses.

Equine Dentist
An appointment will be made annually with an equine dentist by the Yard, it is the Owner’s responsibility
to book the horse in for this appointment or make alternative arrangements.

SCHEDULE 8 – General Riding, Contact Details & Emergency Procedure

In the event of an emergency contact the emergency services / vet / farrier using the free payphone in the
tack room.

Fire Extinguishers are in the Stables, Tack Room and Top Shed.

Grievance Procedure
All grievances, problems or issues that may arise whether relating to horse welfare, health and safety,
people or behaviour must be referred to the Yard Owners. Liveries must not take it upon themselves to try
to mediate problems on the yard or deal with issues arising without the consent of the Yard Owners.

Additional Services
Please ensure you book any additional services with the owners at least one day in advance. We cannot
guarantee to accommodate last minute requirements unless in an emergency.

Arena Hire
Liveries may not book the arena and cross country unless they have a paid instructor in attendance or
other professional for which a fixed time booking is required. Arena hire is booked by emailing
info@hafodfarm.com and bookings are kept up to date on the website www.hafodfarm.com

Riding Out
When riding out from the yard riders are to remember they are representing the Yard and should conduct
themselves accordingly. The following guidelines should be observed:

• Wear a hat, gloves and suitable footwear


• Wear fluorescent clothing if riding on the road
• Be aware of other road users and observe the highway code at all times
• Do not ride on any land without the permission of the landowner
• Notify someone of your intention to ride, route and expected time of return if riding out alone.
• Carry a mobile phone

General rules
Owners are not permitted at any time to ride on the Yard property without wearing a suitably accredited
riding hat.

Owners are not permitted to ride on the Cross Country alone, you must be accompanied by either a
second rider or someone on foot.

The Yard recommends that for any jumping; fast work or cross country you wear a body protector.

The Yard does not permit any non BHS accredited riding instructors to teach/coach on the premises.
All riding and care of your horse is undertaken at the Owners risk. Whilst the Yard will take every step
reasonable to ensure that a high standard of health and safety is maintained on the yard, by the nature of
the activity the owner accepts there is an inherent risk and therefore the Yard will not be liable for any
accidents should they occur unless due to the negligence of the yard.

Owners are encouraged to co-operate with other liveries in the care of horses and to be considerate to the
needs of other owners at all times.

Communication
The Yard is a DIY yard and the Owner is responsible for the welfare of the horse. The Yard cannot provide
24-hour cover on the yard, although they are contactable as above.

It is preferred by the Yard to communicate with all liveries via a Facebook message group as it is quick and
efficient and enables the Yard to know that Owners have read messages. If you are unable to use this form
of communication the Yard requires you to make alternative arrangements to keep in touch.
