1.1 Resource extractive industries or activities but not limited to:

contact with cooling water/coolant
3.1.4 Barangay Micro Business Enterprises (BMBEs) as defined by R.A. 9178
except those which store/generate toxic/hazardous and/or
strongly/highly pollutive wastes
*All BMBEs are required to submit a certification from the
appropriate agency/ies (i.e. DTI, DENR)
3.1.5 Garment/textile and other industry/manufacturing without dyeing
operation
3.1.6 Bakery ovens and confectionery cookers where products are edible
and intended for human consumption
3.1.7 Wooden assemblies having the following equipment: trimmers,
crosscut saws, circular saws of less than 600 mm diameter in
size and S2S type planers of not more than 3 units each provided
that no spray painting/vanishing activity (using air compressor) is
involved
3.1.8 Metal works which do not involve spray painting (using compressor)
and/or electroplating process
3.1.9 Feedmill with machine-capacity not exceeding 1 ton per hour
3.1.10 Organic compost/fertilizer making not exceeding 500 metric tons per
annum in capacity
3.1.11 Cold storage/refrigeration facilities provided that no process (i.e. ice
making, meat, fish or vegetable processing or other similar
activities) is involved and/or with less 1 hectare floor area
3.1.12 Storage/post harvest facilities and warehousing for non-toxic/
hazardous materials & substances with less than 1 ha. floor area
3.1.13 Traders and importers and exporters of non-hazardous materials or
substances
3.1.14 Brokers-forwarders, trucking, sea and air freight services without
repair and maintenance facilities
IV. SERVICE INDUSTRY
4.1 Stand-alone fastfood stores, restaurants & similar

maintenance and repair works involving negligible,
no expansion nor change or land use beyond that
which is/was previously existing)
5.6 Demolition or abandonment of dangerous or condemned
buildings and facilities with previously stored/used

6.1 Waste disposal sites (i.e. sanitary landfill), waste processing
facilities, transfer stations and other similar projects

IV. THE EUFS AND ITS INCENTIVES

EUFS is a market-based instrument that


applies the “polluters pay principle”

EUFS serves as an economic means to


force polluters to reduce/abate water pollution
while instituting remedial measures within their
establishment

EUFS was initially implemented in the Laguna


de Bay Region in 1997

Validity of Discharge Permit

The Discharge Permit (DP) shall be


valid for a maximum period of three (3)
years from the date of issuance, subject
to revalidation / renewal per LLDA
Board Resolution No. 298
Criteria for Issuance of Discharge Permit

The Validity of the DP shall be determined based on the


following set of criteria for each case scenario:
Case 1
A discharge permit shall be valid for three (3) years if the
establishment satisfies any of the following criteria

a. The establishment is an ISO 14001 certified (or any


internationally recognized environmental certification)
provided that there is no pending case or violation of any
rules and regulations enforced by the Authority
b. The establishment has complied with LLDA Rules and
Regulations including but not limited to permit
conditions and the prescribed effluent standards within
the last three (3) years prior to issuance of the long-term
permit

c. The firm is a recipient of an award being given by the


Authority relative to environmental performance

Case 2
A discharge permit shall be valid for two (2) years if the
establishment satisfies any of the following criteria:

a. That the establishment’s activity falls under the category


of gasoline station, fastfood and restaurant and other
similar activities provided that there is no pending case
or violation of any rules and regulations of the Authority
b. That the establishment is practicing zero-discharge
scheme (close loop system) provided that there is no
pending case or violation of any rules and regulations of
the Authority
c. The establishment has no pending water pollution case
within the past two years and all payable accounts have
been settled (i.e. re-sampling fee, arrears, surcharge,
EUF, etc
Case 3
A discharge permit with a validity of one (1) year shall be
issued to those establishments who had pending water
pollution case prior to the date of its issuance, provided
that the said case had been dismissed and all payable
accounts had been settled (i.e. re-sampling fee, arrears,
surcharge, EUF, etc.)
REVALIDATION of
Discharge Permit

 All issued Long Term Discharge Permit shall


be revalidated annually subject to payment of
EUF and other applicable fees.
 The Pollution Control Officer (PCO) shall
bring the following to the LLDA Clearances
and Permits Division (CPD):
 Approved Original DP
 Payment of applicable fees/fines are paid in full
 Certificate of attendance to 4 hr. seminar
DISCHARGE PERMIT (DP) REQUIREMENTS

Exemption:
• Duly accomplished and notarized application form
(www.llda.gov.ph)

• Letter request under oath by the CEO

• LLDA Clearance or LLDA Clearance Exemption

• Non-refundable Fee (Php 5,000.00)

• Water bills/reading registered in the name of


applicant and/or Certificate of Interconnection

 Pollution cases will be filed if the
establishments do not conform with the
effluent standards, and penalties will be

Rules & Regulations Implementing
the New General Effluent Standards
(GES) Pursuant to LLDA B.R. No. 523,
s. 2017 entitled
“ADOPTION OF DEPARTMENT
ADMINISTRATIVE ORDER (DAO) NO.
2016-08 OF THE DENR, AS THE NEW
EFFLUENT STANDARDS FOR THE
CONTINUOUS IMPLEMENTATION OF
THE EUFS AND THE WATER QUALITY
GUIDELINES FOR SURFACE WATERS
WITHIN THE LDBR, and for other
purposes”
COVERAGE:

THESE GUIDELINES SHALL APPLY


TO ALL EXISTING AND/OR NEW
DEVELOPMENT PROJECTS,
INSTALLATIONS AND ACTIVITIES
THAT ARE REQUIRED TO SECURE A
DP, PURSUANT TO LLDA B.R. 322 S.
2007 OR THE MODIFIED
WASTEWATER CHARGE SYSTEM IN
LAGUNA DE BAY REGION (LDBR).
GENERAL EFFLUENT STANDARDS (Sec. 7.0 of DAO 2016-08)
Discharges from any point source shall, at all times, meet the
effluent standards set forth in Tables 9 and 10 of DENR DAO
2016-08 to maintain Class C water quality for water bodies
within the LDBR, and Class SB for Manila Bay as mandated by
the DENR.

Industries shall only be required to monitor their effluent


quality parameters determined to be significant to them. ROLA
for all significant parameters shall be submitted to LLDA as
part of the SMR.
Wastewater generated by an establishment shall not be
allowed to be used for irrigation and other agricultural
purposes w/o valid certification issued by the Dept. of
Agriculture. The certification from DA shall be valid for the
duration of the DP issued to the establishment.

Effluent quality monitoring procedures shall be in accordance


with the Effluent Quality Monitoring Manual issued by DENR-
EMB through MC 2008-008 as adopted by LLDA.
TABLES 9 and 10
of DAO 2016-08
SIGNIFICANT EFFLUENT QUALITY PARAMETERS per
SECTOR (Section 7.1 of DAO 2016-08)
Individual point sources of pollution shall be
categorized into sectors consistent with the Phil.
Std. Industrial Classification (PSIC, 2009).
The significant effluent quality parameters shall be
based on Table 8 of said DAO for purposes of
streamlining compliance and enforcement of the
GES.
In cases where a certain establishment does not fall
in one of the identified sectors in Table 8 of said
DAO, the LLDA shall identify the most probable
pollutants that the said establishment will discharge
into the environment.
These identified parameters will then be used for
compliance monitoring and enforcement.
Wastewater treatment facilities of
establishment that caters both process
wastewater and domestic sewage shall be
monitored for effluent parameters
significant to them, including parameters
intended for domestic sewage as listed in
PSIC Code No. 37000.

LLDA shall include additional effluent


parameters other than those listed in their
assigned PSIC Code for laboratory analysis,
if this particular parameter/s is/are deemed
significant based on actual inspection of its
process or activities.
EFFLUENT STANDARDS FOR BOD FOR STRONG WASTEWATER
(Section 7.2)
Establishments with strong wastewater has to request and submit at
least 10 monthly monitoring results or a minimum of 12 monitoring
results of a 6-month period showing that influent BOD is equal to or
greater than 3,000 mg/L, at all times.

Analysis of samples shall be from a DENR recognized, third party


laboratory.

LLDA may conduct validation tests, review of submitted SMRs, among


others, to verify if such claim is valid.

Establishments with verified influent BOD of at least 3,000 mg/L, the


applicable effluent standards in Table 10 shall at all times be enforced
and complied with. Laboratory analysis for influent BOD shall be
conducted consistent with the analysis of effluent samples which shall
be included in the submission of SMR.

All establishments directly draining into the Manila Bay, with BOD as
one of its significant effluent parameters and considered as strong
waste, shall comply with the maximum BOD value set in Table 9,
pursuant to the continuing mandamus of the Supreme Court.

For parameters other than BOD, Table 9 shall apply.


MODIFICATION OF GES (Section 8.0)
Any person, both natural and juridical, may request for the
modification of the GES.
The request shall include a clear and scientifically valid
evidence having a probative value to demonstrate that such
modification is consistent with R.A. 9275 and its IRR.

Request for modification shall be submitted to the Office of


the General Manager, LLDA, actions of which shall be subject
to further consultation with DENR.

The requesting entity has to submit at least 10 monthly


monitoring results or minimum of 12 monitoring results of
a 6-month period among other supporting documents, to
prove that its request for modification is based on empirical
and scientific findings or studies.

LLDA shall conduct validation tests, review of


submitted SMRs, among others, to verify if such claim
is valid.
MODIFICATION OF SIGNIFICANT EFFLUENT QUALITY
PARAMETERS & GES VALUES (Section 8.3)

In cases where a particular significant parameter is present in an


establishment’s waste stream but is not listed in Table 8 of the
DAO, the LLDA shall require the establishment to comply with
such particular significant parameter.

The LLDA shall inform the establishment of the findings and of the
need to include such parameter in the succeeding issuance of its
DP, as well as, in the succeeding compliance monitoring and
enforcement.

The establishment may file a motion for reconsideration within 15


days after receipt of such findings.

The LLDA reserves the right to reject or accept the appeal based
on justifiable grounds.
In cases where a particular significant parameter is not present in
an establishment’s waste stream, the establishment may request
for exclusion of such particular parameter in its succeeding
monitoring regime and its DP, provided that:
Based on the DENR-approved method of analysis, the parameter
of concern is below the method detection level (MDL) for at least
10 monitoring events. Monitoring events shall refer to self-
monitoring activities with frequency of at least twice a month.
No change in technology & raw materials used in its operation
or process. During the monitoring periods for purposes of
effluent quality measurement, there should be no changes in
technology & raw materials used in its operations or process.

Once exclusion of a particular parameter is approved, the


establishment shall inform the Authority of any changes in
technology & raw materials used in its operations or
processes to verify if such exclusion is still valid. This
shall be included as one of the conditions in its DP.
The LLDA shall conduct validation tests, review of submitted SMRs,
among others, to verify if such claim is valid.
GRACE PERIOD (Section 10.0)

An establishment may request for a grace period of not


more than 5 years to be able to comply with the GES,
provided the requesting establishment submits a
Compliance Action Plan (CAP). Cases wherein a grace
period may be granted shall be limited to any of the
following:

Values for the GES have become stringent


compared to the values in DAO 1990-35. In such
cases, DAO 1990-35 shall apply during the grace
period.

New significant effluent quality parameters were


identified for the sector.
The minimum content of the CAP to avail of the grace period
description of the establishment

justification why it needs to request for a grace period (i.e. new


parameters, stricter parameters in the new DAO, etc.)

process production flow (including flow rate, material balance,


water balance, etc.)

characterization or nature of existing wastewater stream, historical


trend of its regulated parameters based on the submitted SMRs
(w/in the last 3 years to present)

description of its existing wastewater treatment facility such as its


type, design rate and actual capacity, date constructed/installed,
projected useful life, etc.

proposed modification on the existing WTF to address new and/or


stringent parameters of the new DAO

timeline of the establishment’s corrective actions & modifications,


including projected milestones, to fully comply with the new
standards w/in the requested grace period

investment cost & other related expenses for the implementation of


the CAP
CAP submitted before the issuance of this IRR need not follow the
suggested content. The establishment may opt to submit or the LLDA
may request submission of a revised CAP to include other details not
considered in the earlier submitted CAP.

Filing for a request for a grace period shall be made at least 3 months
prior to expiration/revalidation of DP for 2018.

Start of the grace period is upon approval of the submitted CAP.

After approval of CAP, periodic status of implementation or annual


progress report to update LLDA on the steps taken for the
establishment’s approved implementation schedule, including milestones
achieved, implementation challenges, among others.

A moratorium is in effect within the approved grace period which includes


issuance of cease and desist and/or closure order, fines, & other penalties
against establishment’s operations.

DAO 1990-35, however, remains in effect during the grace period which
must be complied with at all times. Failure in any of the regulated
parameters under DAO 1990-35 shall not be covered in the mentioned
moratorium.
Failure to submit annual progress report or periodic status
of implementation may form the basis for the cancellation
and/or revocation of approved grace period. The
applicable GES for that particular establishment shall be
enforced & complied at all times.

An extension of the approved grace period may be


granted provided a catch-up plan is submitted 6 months
before the lapse of the grace period. Provided, also, that
the delay and/or implementation challenges was duly
reported in its submitted periodic (annual) status of
implementation. In no case shall the grace period be
extended to an aggregate total of 5 years.

After the lapse of the grace period, the new GES shall be
automatically enforced and complied with at all times.
WATER POLLUTION CASE PENDING WITH THE PHC

The case shall be deemed recommended for


dismissal if the non-compliant parameter is no
longer included in the list of its new significant
parameters.

The cut-off date for the computation of daily


penalty and computation of EUFs to be imposed, as
pre-requisite for the dismissal of the case shall be
the date of effectivity of this IRR. (February 5,
2018)

Those who submitted CAP wherein DAO 1990-35


shall apply during the grace period, the case will
remain active until it complies with the effluent
standards set for the said DAO.
