FIRST ITEM: GENERAL PROVISIONS

Article 1 – This agreement has the objective of
putting place an observation internship in a
professional environment for the benefit of a
student in an educational establishment.
Article 2 – The objectives and the modalities of
the observation internship are indicated in the
Pedagogical annex to this agreement.
The modalities of responsibility for costs related
to this internship and insurance for the student
are defined in the Financial annex to this
agreement.
Article 3 – The organization of the observation
internship is determined in an agreement
between the enterprise or organization director
and the school principal.
Article 4 – The students remain under school
regulations during the observation internship in a
professional environment. They remain under the
authority and the responsibility of the school
principal.
Nevertheless, students are subject to the rules of
the company or organization. In case of
contravention, the director of the company has
the right to suspend the internship of the student
concerned and to return him immediately to the
person in charge at school.
The students are not entitled to any remuneration
or gratuity from the receiving enterprise or
organization.
Article 5 – During the observation internship, the
students are not required to contribute to the work
of the receiving enterprise or organization.
During the observation internship, the students
may implement their inquiries in contact with their
instructors: They may equally participate in the
activities of the receiving enterprise or
organization, trials or demonstrations in contact
with their instructors and the training objectives of
their class, under the control of personnel
responsible for guiding/managing them in the
professional environment.
The students may not access machines, devices,
or products for which the utilization is prohibited
to minors in articles D. 4153-15 to D. 4153-37 of
the Labor Code. Students under 16 years of age
cannot operate other production machines,
products or devices, nor execute light work for
which minors are permitted under the same labor
code.
Article 6 – The weekly duration of activities in the
professional environment for interns, both minors
(<18) and adults, is limited to 35 hours.
Concerning interns who are minors:
-The daily duration of activities in the professional
environment for minor students cannot exceed 8
hours. Beyond 4 hours of activity, the minor
students must benefit from a break of at least 30
consecutive minutes. Students less than 16 years
of age must not be present in the receiving
enterprise between the hours of 20:00 and 6:00.
For students between 16 and 18 years of age,
their presence is forbidden in the workplace from
22:00 to 6:00.
-For each period of 24 hours, a minimal period of
daily rest must be fixed at 14 consecutive hours
for students less than 16 years of age, and 12
consecutive hours for students from 16 to 18
years of age.
-The weekly rest of minor students must have a
minimum duration of 2 consecutive days, and this
minimal period of rest must include Sunday.
Article 7- The school principal has an insurance
contract covering civil responsibility of the student
for damages that he/she could cause during the
observation internship in a professional
environment, as well as for outside the receiving
enterprise or organization, or on the way from
home to the enterprise and from the enterprise
towards home. This insurance also guarantees
physical damages that may occur to the student
during the internship.
Article 8 – In case of accident to the student,
either in the professional environment, or on the
way to and from the enterprise, the receiving
enterprise or organization director commits to
sending a statement of accident to the school
director on the day an accident occurs.
Article 9 – The school principal and the director
of the enterprise/organization receiving the
student will keep each other informed of any
difficulties that could arise in the application of
this agreement and will take, in common consent,
and in contact with the pedagogical team,
appropriate arrangements to resolve them,
notably in case of lack of discipline. The
difficulties that could be encountered during the
entire period in the professional environment, and
notably any absence of the student, will be
immediately brought to the attention of the school
principal.
Article 10 – This convention is signed for the
duration of a single observation internship in a
professional environment.
