TERMS OF REFERENCE FOR SERVICES

SHORT TITLE OF ASSIGNMENT


Supply, installation, and operation of water network for Maran water project In Haydan district –Saada
Governorate.
BACKGROUND
Part of UNICEF’s work plan in supporting the water supply network and infrastructure is to provide
technical and financial assistance to the local water supply companies in the form of upgrading and
construction of WASH facilities in the most conflict-affected areas. In addition, UNICEF also supports
GARWSP in WASH emergency responses for emergency situations in the country.
Water scarcity is a critical issue affecting communities worldwide, with Yemen being one of the countries
experiencing severe water stress. the communities in the border districts such Haydan district depend
on rainwater, furthermore the Water sources are very limited and hard to reach and they have used
animals and women to transport water and walk for long distances to fetch water. the population faces
significant challenges in accessing an adequate water supply. The situation is particularly dire in remote
villages like the Maran area in Haydan district.
Residents in these areas heavily rely on surface water sources, such as springs and rooftop rainwater
harvesting, to meet their water needs. However, the scarcity of reliable water sources exacerbates the
acute water shortage, resulting in a severe lack of drinking water availability. As a result, residents are
compelled to seek alternative means of accessing water, including traveling long distances to springs or
streams located approximately 3 - 5 kilometers away or resorting to expensive water trucking services
from distant areas. The existing rainwater harvesting tanks, which is inconveniently located far from the
population, further compound the challenges faced by the community. The rugged road leading to the
tanks adds additional difficulties for residents seeking access.
Maran water system consists of 3 wells working by solar systems and reservoirs implemented by
MoW&E .
Due to the current situation in Maran, UNICEF Yemen seeks to establish contracts to supply equipment,
install and implement the water network (1st phase) of the Maran water project to provide safe water
to more than 9000 individuals.
This water project will serve as a reliable water source and distribution system, providing a sustainable
solution to the water scarcity issue. In addition, the project will include the installation of distribution
points and a comprehensive water network. This network will ensure the delivery of clean and safe
water to the communities in need.
By establishing a reliable water network, the project aims to enhance access to clean water, alleviate
the burden on community members, and foster social and economic development. Women, girls, and
boys will particularly benefit from the project, as it will free up their time and resources that are currently
dedicated to searching for water sources or arranging costly water deliveries. This newfound time can
be redirected towards education, livelihoods, and family care, contributing to the overall well-being and
development of the community.
OBJECTIVE
The objective of water network of Maran water Project in Haydan District, Sa'ada Governorate is to supply ,
implement and operate a new water network (1st phase) that will provide a safe and sustainable water supply to
approximately 9,000 people in need, specifically in some villages in Maran areas. This project aligns with UNICEF's
general output of ensuring that more children, adolescents, and their families benefit from safe water supply services
and improved hygiene practices at household, community, and institutional levels (Output 2.2).

In line with UNICEF Yemen's commitment to achieving this output, the project aims to establish contracts with
competent and technically qualified construction companies. These companies will be responsible for supplying the
necessary equipment and executing the first phase of Maran water network in Maran area in Haydan district – Sa'ada
Governorate.

By implementing a reliable water network , the project will not only improve access to safe water but also contribute
to improved hygiene practices at the community level. The availability of a sustainable water supply will support
better sanitation and promote hygiene practices within households, communities, and institutions, benefiting
children, adolescents, and their families in the area.

This initiative seeks to alleviate the challenges faced by the community in accessing clean water and improve their
overall well-being. It directly contributes to UNICEF's efforts to ensure that more children, adolescents, and their
families benefit from safe water supply services and improved hygiene practices, ultimately fostering healthier and
more resilient communities.
SCOPE OF WORK, ACTIVITIES, TASKS, DELIVERABLES AND TIMELINES, PLUS BUDGET PER DELIVERABLE
Scope of works
Selected construction companies are expected to:
• Supply, transport, and install all equipment required for the project.
• Conduct all required construction works in the project.
• Develop and submit detailed project plans, including timelines, resource allocation, and cost estimates.
• Coordinate with relevant stakeholders to ensure smooth execution of the project.
• Adhere to all safety regulations and best practices throughout the construction process.
• Provide regular progress reports and updates to project stakeholders.
• Address any unforeseen challenges or obstacles that may arise during the construction phase.
• Ensure proper maintenance and upkeep of construction equipment and machinery.
• Complete all necessary documentation, including permits, licenses, and certifications, as required by local
authorities.
• Hand over the completed project, including relevant documentation and training materials, to the client or
designated party.

Tasks
Below are the generic tasks of this tender. Specific tasks are described in Annex 2 and Annex 6 and Annex 7:
Construction Documents (Design drawings, technical specifications, and BOQ).
• Install and implement water network according to the design drawings and technical specifications provided.
• Procure and install network and distribution points as outlined in the project requirements.
• Carry out any other activities specified in the Bill of Quantities (BOQ) and drawings.
• Prepare the construction site by clearing and leveling the designated area.
• Excavate foundations and trenches as per the project requirements.
• Erect network components following the design drawings and specifications.
• Apply appropriate finishing works to achieve the desired aesthetic and functional outcomes.
• Conduct testing and commissioning of installed systems and equipment to ensure proper functionality.
• Implement site safety measures and adhere to occupational health and safety regulations throughout the
construction process.
• Provide support and cooperation during site inspections and audits conducted by relevant authorities.
• Collaborate with project stakeholders, including engineers, and supervisors, to ensure smooth project
execution.
• Maintain accurate documentation of construction activities, including progress reports, site records, and
material usage.

• Adhere to environmental regulations and implement sustainable construction practices, where applicable.
Timeline
The table below shows the expected timeline for the project. A defect liability period of 12 months will start counting
from issuing the certificate of substantial completion. The timelines of each deliverable shall be as agreed in the
Work plan. In case of any deviation from the timeline or work plan (not meeting the targets), the Contractor shall
send a written request to UNICEF with appropriate justification. UNICEF will approve or reject each request. If the
request is rejected, the Contractor shall be fully responsible for making up the backlogs without affecting the overall
contractual period.

Deliverables and payment schedule


UNICEF will issue fixed price contract with the selected bidders taking into consideration, any variation of works, that
reported based on the recommendation of Engineering Firms, is to be pre-approved by UNICEF and that
communicated formally to the vendor, in particular, the variation of works with direct effect on the cost is to be
reflected on the contract then communicated to the vendor accordingly. Bidders are required to indicate their fixed
price in Annex 1. This price will cover all expenses (material, equipment, transportation, labor, overhead, etc.) of all
items included in the BoQ and specification in Annex 2 & 6 & 9. The fixed price of the selected offer will be reflected
in the contract. UNICEF does not provide advance payments. Payment is to be made based on the actual completed
BoQ and the supervision Engineering Firm’s confirmation that the BoQ, as per the contract, has been implemented
using standard engineering method of measurement and against approved deliverables as per the table below.
UNICEF will use the BoQ as a reference for the contract award. The selected contractor will use the BoQ as
complementary to the technical specifications to be followed in the execution of the works. Variations from the total
lumpsum fixed price in Annex 1, BoQ, or specifications that have an impact on costs or timeline need written approval
from UNICEF prior to proceeding. The contractor will send a variation request to the supervising engineer, who in
turn will send it with its comments to UNICEF for approval. UNICEF will not pay for Variations not supported by
UNICEF’s issuing an amended contract prior to actual variation work being initiated.
UNICEF will issue a lumpsum contract with the selected bidders. The price will be fixed, and UNICEF will issue payments
based on contract conditions and acceptable completion of deliverables to each project as per the payment schedule
below. Bidders are required to indicate the lump sum fixed price for each site in Annex 1. This price will cover all
expenses (material, equipment, transportation, labor, overhead, etc.) of all items included in the BoQ and
specification in Annex 2 &6& 8 . The lumpsum fixed price of the selected offer will be reflected in the contract. UNICEF
does not process advance payments.

Variation of work
Any variation of work should be approved by UNICEF in writing before moving forward. The engineering firm will
receive a variation request from the contractor and forward it to UNICEF for approval along with comments. UNICEF
will not pay for Variations not supported by UNICEF’s prior written approval.
Once deliverables are completed, the contractor will submit a report of the activities included in the deliverables to
UNICEF together with its respective invoice. The report will contain pictures of activities delivered and it will be signed
by the contractor and engineering firm responsible for site supervision.

Reporting requirements
The selected contractors will report directly to UNICEF Supervisor WASH Officer or his representative. UNICEF will
hire an engineering firm to conduct site visits and supervise the execution of works.
The construction company will submit monthly progress reports in English to UNICEF, the report will contain the
required details on quality tests, the progress on BOQs and timeline, pictures of activities delivered and
it will be signed by the EF

QUALIFICATIONS, SPECIALIZED EXPERIENCE AND ADDITIONAL COMPETENCIES


Contractors must have reasonable background experience (minimum of 3 years) in the scope of work similar to the
project’s scope of work. (See technical evaluation criteria for more details).
The solicitation will be managed through the UNICEF Supply Section by issuing an RFP open for all bidders through
the UNGM announcement.
The awarding will be based on best value-for-money criteria combining technical and financial scores of
bidders who pass the technical threshold. Bidders are required to submit the documents for the 3 tender
steps below.

- Copy of company valid registration to work in Yemen, including trade registration (mandatory), tax card
(mandatory), and Zakah card.

document submitted as proof of modification.
2. Technical Proposal (The Technical Evaluation will be given a maximum of 60 points)
The Bidder should provide the technical & manufacturing catalogues, specifications, and lab tests for
all items, showing acceptable quality to be considered passing.

In respect to technical submissions, any submission of 2 proposals will expose the bidder to disqualification.
Bidders are requested to provide full narrative documents on the methodology of implementation, indicating
the effectiveness of technical site implementation.

in the English language.

3. Financial Proposal (The Financial Evaluation will be given a maximum of 40 points)

prices for all items of BoQ. Item’s price will include all costs, such as labor, material, transport, equipment,
insurance, overhead, etc. Partial offers are not acceptable. The BoQ shall be sent in 2 different formats:
- BoQ in Excel format
- Signed and stamped BoQ in PDF format.

• Highly recommended that interested bidders visit the site prior to submitting their proposals
• Bidders must quote for all the items and all the sites to get eligibility
• UNICEF will select the lowest offer if there is any discrepancy between the Financial Offer in Annex1 and
the BoQ in Annex 2.
UNICEF will not receive bids in hard copies or by email. All bids must be submitted online through the UNICEF e-
submissions system accessible via www.ungm.org The submissions should be segregated;
Technical Proposal and Financial Proposal and each uploaded to its dedicated intent envelop on the system.
Bids received in any other manner or joining technical and financial parts will be invalidated.
CONDITIONS OF WORK
The price stated in Annex 1 will include all costs related to the activities requested including but not limited to
staff, workers, equipment, transport, material, insurance and warranties UNICEF will not provide any office,
transport, equipment, per-diems, transport, insurance for workers, etc. Specifically, the selected contractor will be
responsible for:

• Ensure necessary safety facilities for workers and the construction site including security fence and all ESS
measures
