Die Technischen Informationen „Übersicht der Bauteile mit Betriebsmittel Kennzeichnung (BMK)“ wurden für geschulte Service-Monteure zum Zweck der Fehlersuche an von der Liebherr-Werk Ehingen GmbH
hergestellten Kranen erstellt. Sie gehören nicht zum Auslieferungsumfang eines Krans und können vom Auslieferungszustand eines Krans abweichen. Die Technischen Informationen unterliegen keinem
regelmäßigen Änderungsdienst und beinhalten und ersetzen auch nicht alle notwendigen Betriebs-, Montage- und Sicherheitshinweise. Dies gilt insbesondere für Sicherheitsbestimmungen, die sich z.B. aus
der Auslieferungsdokumentation eines Krans sowie aus den gesetzlichen Bestimmungen ergeben. Das vorherige Studium der Bedienungsanleitung, der Betriebs-, Montage- und Sicherheitsbestimmungen
eines Krans ist zwingend notwendig, um ein umfassendes Verständnis über die Bedienung, den Service, die Sicherheitsvorschriften und Warnhinweise zu erlangen.

Für Schäden, die aufgrund der Nutzung der Technischen Informationen entstanden sind, haftet die Liebherr-Werk Ehingen GmbH – aus welchen Rechtsgründen auch immer – nur
• bei Vorsatz,
• bei grober Fahrlässigkeit seiner Organe oder leitenden Angestellten,
• bei schuldhafter Verletzung von Leben, Körper oder Gesundheit,
• bei Mängeln, die arglistig verschwiegen wurden oder deren Abwesenheit garantiert wurde,
• bei Mängeln der Technischen Informationen, soweit nach Produkthaftungsgesetz für Personen- oder Sachschäden an privat genutzten Gegenständen gehaftet wird.
Bei schuldhafter Verletzung wesentlicher Vertragspflichten haftet die Liebherr-Werk Ehingen GmbH auch bei grober Fahrlässigkeit nicht leitender Angestellter und bei leichter Fahrlässigkeit, in letzterem Fall
begrenzt auf den vertragstypischen, vernünftigerweise vorhersehbaren Schaden. Weitere Ansprüche sind ausgeschlossen.

Die Liebherr-Werk Ehingen GmbH haftet nicht für die inhaltliche Richtigkeit sowie die Folgen unüblicher oder zweckentfremdeter Benutzung der Technischen Informationen.
