DEED OF EXCHANGE OF REAL PROPERTIES

KNOW ALL MEN BY THESE PRESENTS:

This Deed of Exchange of Real Properties, made and executed by and


between:
NANCY ASUNCION, of legal age, married to Ernesto E. Sy, Filipino
citizen and a resident of Brgy. Canda, Municipality of Sariaya, Province of
Quezon, herein referred to as the “FIRST PARTY”;

- and-

VIRGILIO ASUNCION, of legal age, married to Nilda Roxas


Asuncion, Filipino citizen and a resident of Brgy. Canda, Municipality of
Sariaya, Province of Quezon, herein referred to as the “SECOND PARTY”;

WITNESSETH:

WHEREAS, the FIRST PARTY is the owner of a certain parcel of land


situated at Brgy. Canda, Municipality of Sariaya, Province of Quezon, known as
LOT No. 1873-B-1, embraced under Transfer Certificate of Title No. 066-
2020005917, and more particularly described as follows:

WHEREAS, due to inadvertence, there was a mistake regarding the


positioning of the respective actual property belonging to each party during the
registration of the subject properties. Hence, it should be the FIRST PARTY who
is the actual owner of Lot No. 1873-B-7 and likewise, it should be the SECOND
PARTY who is the actual owner of Lot No. 1873-B-1. In order to rectify the said
mistake, both parties hereto have voluntarily agreed, by and between
themselves, to exchange their respective properties as above-described.

NOW, THEREFORE, for and in consideration of above premises, the


FIRST PARTY does hereby cede, transfer, and convey unto the SECOND
PARTY the entirety of the real property and described under the first WHEREAS
clause above, and by simultaneous act of the SECOND PARTY to the FIRST
PARTY, the entirety of the other real property and described in the second
WHEREAS clause above;

That both parties hereto do hereby warrant valid title to, and peaceful
possession of, their respective properties they have mutually ceded, transferred
and conveyed, and further declare that the same are free and clear of all liens
and encumbrances of any kind whatsoever.
