EXPLANATORY NOTE

The COMELEC is ordained by Section 55 of Batas Pambansa Bilang 881 or the

Omnibus Election Code, mandating LGUs to provide for a suitable place for the office of
the Election Registrar and staff within their locality, hence, their occupation of the old
City Hall, however, due to the pending rehabilitation of the Department of Public Works
and Highways of the same building, the City Government of Koronadal, deemed it
prudent to house in the vacant stalls, temporarily in the City Terminal as requested by
the Local Chief Executive of this City duly supported by a Resolution No. 6 Series of
2023 of the Terminal Regulatory Board. Such request is considered to be the most cost-
effective measure be deliberated and applied for the smooth operation of the said
agency in the city and without detrimental effect on the operation of the City Terminal.

Thus, this Ordinance.

AN ORDINANCE EXEMPTING THE COMELEC – KORONADAL FROM PAYMENT OF

LEASE OF SPACE AND OTHER FEES AND CHARGES IN THE CITY OF
KORONADAL INTEGRATED TRANSPORT TERMINAL COMPLEX UNDER SECTION
2 OF ORDINANCE NO. 13 SERIES OF 2019

Be it enacted by the Sangguniang Panlungsod of the City of Koronadal, Province

of South Cotabato in session assembled that:

SECTION 1. Grant of Exemption.

The COMELEC – Koronadal is hereby exempted from payment of lease of
space and other fees and charges in the City of Koronadal Integrated
Transport Terminal Complex.
SECTION 2. Period of Coverage
The grant of exemption shall only cover the period from October 2023 to
October 2025 subject to compliance of the rules and guidelines set forth
by
the Terminal Management Office, applicable laws and Ordinances, and
requirements set forth by the LTFRB, LTO Office, Transportation Security,
and other related National Government Agencies.

SECTION 3. Separability Clause

Should any provision of this Ordinance be declared invalid or
unconstitutional, such provisions not affected thereby shall be effective
and
binding.

SECTION 4. Repealing Clause

Section 2 of Ordinance No. 13 Series of 2019 and other rules, regulations,
or part thereof contrary to or inconsistent with the provisions of the
Ordinance is hereby amended, repeal or modified accordingly.

SECTION 4. Effectivity
This Ordinance shall take effect immediately upon approval.
