Subject: Legal Notice for Breach of Agreement and Misrepresentation Regarding Sale of Apartment T-5/608, GLS Arawali
Homes, Sohna, Gurugram

Dear Mr. Thomas,

This Legal Notice is served upon you, Mr. L V Thomas, on behalf of my client Mrs Pulin Mishra W/o Pankaj Mishra R/o
H No 45D, Gali no - 5, Durga Vihar Phase 2, Deendar Pur, Najafgarh , New Delhi, Delhi - 110043 , hereinafter referred to
as the "Purchaser," regarding your repeated breach of agreement and misrepresentation in the sale of your apartment
T-5/608, situated in GLS Arawali Homes, Sohna, Gurugram (the "Property").

Background:

 That On 21 November 2023, the Purchaser, through your agent, expressed interest in purchasing the Property.
 That On the same date, the Purchaser paid you an earnest money deposit of INR 21,000 (Rupees Twenty-One
Thousand Only).
 That You verbally confirmed completion of the sale and purchase agreement within 45 days.
 That Based on your confirmation, the Purchaser applied for a bank loan and incurred further expenses of INR
20,000 (Rupees Twenty Thousand Only) in fees, legal valuation, and other charges.
 That Since December 20, 2023, you have consistently ignored the Purchaser's attempts to communicate
regarding the sale, failing to answer calls, replying to messages, or providing a clear timeline for completion.
 That Shockingly, it has come to light that the Property is under mortgage, a crucial fact you deliberately
concealed from the Purchaser.

Breach of Agreement and Misrepresentation:

Your verbal confirmation of completion within 45 days constitutes an agreement, which you have continuously breached
by your inaction and lack of communication.

Your failure to disclose the mortgage on the Property amounts to misrepresentation and a clear attempt to deceive the
Purchaser.
Consequences for the Purchaser:

The Purchaser has incurred significant financial losses due to your actions, including the earnest money deposit, loan
application fees, and additional charges.

The delay in finalizing the sale has jeopardized the Purchaser's loan approval and potential credit standing.

Your deceitful behavior has caused immense mental stress and damaged the Purchaser's goodwill.

Demands:

We demand the immediate return of the earnest money deposit of INR 21,000 (Rupees Twenty-One Thousand Only)
along with accrued interest from the date of deposit.

We demand compensation for the incurred expenses of INR 20,000 (Rupees Twenty Thousand Only) related to the loan
application and other charges.

We demand compensation for the time wasted and the mental distress caused to the Purchaser due to your actions.

We demand immediate disclosure of the details of the mortgage and a clear plan for resolving the encumbrance on the
Property.

Notice:

If you fail to comply with the demands outlined above within 7 days from the date of receipt of this Legal Notice, we will
be forced to initiate legal proceedings against you to recover the above-mentioned financial losses and seek further
compensation for damages.

This Legal Notice constitutes a final attempt to amicably resolve this matter. We implore you to act reasonably and fulfill
your obligations to the Purchaser. We reiterate that we are seeking only purchase of the flat failing which we demand
our compensation. It is our hope that your will demonstrate a genuine willingness to cooperate and remedy this
situation promptly.

Copy of this legal notice is also kept at our office for further ready reference if required in future.
