4. Tracing of title On perusal of the documents


from the concerned registrar
offices it is observed that the land
measuring 61 kanal 14 marlas
was acquired by Smt. Sunita
Narula from original Bhoomidhar/
Zamindara which is evident from
the scruity of Jamabandi registers
maintained in Patwari Office in
the revenue estate of village
Rasoi.

At the outset it is submitted that


Smt. Sunita Narula acquired/
purchased the abovesaid land
from said Bhoomidars /erstwhile
owners against valid sale
consideration through three
different registered sale deeds,
viz (a) sale deed dated
09.03.2006, registered as
Document No.16581 in the office
of S.R. Sonepat, (b) sale deed
dated 08.03.2006, registered as
document No.16580 in the office
of S.R. Sonepat, (c) sale deed
dated 08.03.2006, registered as
document No.16461 in the office
of S.R. Sonepat, for the purpose
of developing residential group
housing colony to be known as
Ushay Towers.

In furtherance of this object the


owner Smt. Sunita Narula
entered into collaboration
agreement dated 20.04.2006 with
the builder/developer M/s CMD
Built Tech Pvt. Ltd. for
development of said land of
procuring all the necessary
permissions for the change of
land use/obtaining licenses etc.
Besides above, Smt. Sunita
Narula also executed irrevocable
Power of attorney dated 25.05.06
in favour of developers
authorizing them to do all acts,
deeds and thing to maintain,
manage, control and administer
the said land or any structure
constructed thereon or part virtue
of abovesaid documents further
authorized the Developer
Company to further sell/transfer/
alienate the said land or part
thereof or any property
constructed thereon to any
person for such consideration
and upon such terms and
conditions as the attorney/
developers may deem fit and
proper and to collect and receive
the considerations thereof and
give valid receipts thereof and to
further execute all necessary
documents for accomplishing the
purpose / objects. The owner
further gave undertaking to
comply with terms and conditions
of licenses as granted by
Haryana Government.
Accordingly through attorney
Smt. Sunita Narula applied to the
town & country planning
department of Haryana Govt. for
grant of licence under Haryna
Development & Regulation of
Urban Areas Act, 1975 for setting
up group housing complex at
Village Rasoi, District Sonepat.
The said department issued
license bearing No.126 dated
27.02.07 subject to the fulfillment
of terms and conditions for grant
of licence enumerated in the
letter of intent. The said licence
was valid upto 27.02.2009.
However, it appears from the
letter by developers addressed to
Town and country planning that
they have paid the necessary
renewal fees. M/s CMD Built-
Tech (P) Ltd. with its associate
companies got necessary
permission/sanctions for the
construction of residential group
housing complex from the
competent authority. It is further
worthwhile mentioning that
licence was granted to the
builder/ developer subject to the
condition that builder shall obtain
necessary approval /NOC from
the competent authority before
starting the development work in
the colony.

Ultimately, M/s CMD Built-Tech


(P) Ltd. with its associate
companies initiated the allotment
of apartment proposed to be
constructed on abovesaid land
inter alia one such apartment was
allotted to Sh. Sachin Kapoor,
Smt. Sudha Rani Kapoor and Sh.
Sudesh Kapoor on 30.01.2010.
Consequently, Flat buyer’s
agreement was executed
between M/s CMD Built-Tech (P)
Ltd. and prospective buyers
containing the terms and
conditions to be fulfilled by the
allottee. The said allottees in
terms of aforesaid agreement
deposited the booking/ earnest
money with the said developers/
owners towards the allotment of
the said apartment.

The apartment allottees


deposited an amount of
Rs.5,75,000/- as earnest money /
booking amount with the builders/
owner against the total
consideration of Rs.28,89,120/-,
at the time of registration.

Hence the said property stands


in the name of Sh. Sachin
Kapoor, Smt. Sudha Rani Kapoor
and Sh. Sudesh Kapoor.

8. I further say that Union Bank of India has given and has agreed to continue to

business on the faith of the assurances which are hereby given viz. that I will
not sell, exchange, partition, mortgage, charge, encumber lease dispose of or
deal with any of our properties and the said property in any manner
whatsoever until such time all the liabilities under the various facilities granted
to me have been paid in full by me and I have got the discharge confirmed in
writing by the bank.

Gurgaon, Haryana and premises/ built up property is standing thereon in the
Registration, Sub-District of Sub-Registrar, Delhi particularly described in the
First Schedule hereunder written (hereinafter referred to as the said property)
and no other person has any share, right title or interest of any kind or nature
whatsoever in the said property.

2. I say that I am entitled to deal with the said property as I like.


3. I say that I have not created any mortgage, charge or encumbrance of any
kind or nature whatsoever on or in respect of the said property. I further
declare that the said property is free from all encumbrances, claims or
demands of any kind or nature whatsoever. I further declare that no adverse
claim of any kind exists against the said property. I further say that I have not
received any notice of any intended or compulsory acquisition of the said
property or any notice that the said property is reserved for any particular
purpose.

4. I further say that the only title deeds documents or writing to the said property
which are in my possession are those specified and mentioned in the second
schedule hereunder written and that I do not have in my possession any other
title deeds, documents or writings, in respect of the said property. I further
declare and say that I have not at any time deposited any of the title deeds
relating to the said property with any person or persons whatsoever as and by
way of security, equitable mortgage by deposit of title deeds, charge, lien or
trust or in any manner whatsoever and that the said property is free from all
encumbrances, claims and demands. No claim has ever been made against
me or against the said property on the ground of any deposit of all or any of
the title deeds documents or writings or any one or more of them as security
or on any other grounds whatsoever.

5. I say that I am the absolute owner of the said property and that the said
property is free from any mortgage, charge or encumbrance of any kind or
nature whatsoever and we are entitled to deal with to dispose of the said
property in any manner I like.

6. I say that there are no land revenue assessment, income tax, wealth tax,
expenditure tax or any other taxes, cesses, dues, assessment due and
payable by me for which the said property and the said property is liable to be
attached nor have we received any notice under the payment of Taxes Act.
The Transfer of Property (Amendment) Act. The Income Tax Act, The Wealth
Tax Act, The Expenditure Tax Act, The Gift Tax Act or any other Act issued or
pending against me over the said property.

7. I say that said property is the not subject matter of any suit or legal
proceedings nor any attachment before or after judgment nor has any trust
secret or otherwise, been created in respect of the said property.

8. I further say that Union Bank of India has given and has agreed to continue to
give me various banking and financial facilities to enable me to carry on my
business on the faith of the assurances which are hereby given viz. that I will
not sell, exchange, partition, mortgage, charge, encumber lease dispose of or
deal with any of our properties and the said property in any manner
whatsoever until such time all the liabilities under the various facilities granted
to me have been paid in full by me and I have got the discharge confirmed in
writing by the bank.

9. I hereby further declare and say that I have agreed and undertaken to
indemnify and keep indemnified the bank fully and effectually against all
claims demands charges and expenses whatsoever in respect of my
properties.

10. I make this declaration solemnly sincerely and conscientiously knowing the
same to be true and knowing that on the faith of the said declaration the bank
has given and agreed to continue to give to me the said banking and financial

AFFIDAVIT

We, Shri Narain Prashad Sharma S/o Sh. _______________________ and Anuradhan
Sharma W/o Sh. Narain Prashad Sharma both R/o plot bearing No.20, Block-H, situated in the colony
known as Bali Nagar area of village Basai Darapur, Delhi, do hereby solemnly and sincerely declare and
say as follows:-

1. We are the joint owner of the built up Eastern/Back side portion of the ground floor measuring
60 sq. yards, Eastern/Back side portion of the mezzanine floor measuring 75 sq. yards the
entire first floor measuring 150 sq. yards eastern / back side portion of the roof/terrace rights of
the second floor measuring 75 sq. yards, the entire basement admeasuring 150 sq. yards of
the built up property built over a plot of land bearing No.20, area measuring 150 sq. yards in
Block-H, situated in the colony known as Bali Nagar area of village Basai Darapur, Delhi
alongwith proportionate rights in land underneath. On __________, I had deposited with Union
Bank of India, the title deeds pertaining to my immovable property i.e. built up Eastern/Back
side portion of the ground floor measuring 60 sq. yards, Eastern/Back side portion of the
mezzanine floor measuring 75 sq. yards the entire first floor measuring 150 sq. yards eastern /
back side portion of the roof/terrace rights of the second floor measuring 75 sq. yards, the
entire basement admeasuring 150 sq. yards of the built up property built over a plot of land
bearing No.20, area measuring 150 sq. yards in Block-H, situated in the colony known as Bali
Nagar area of village Basai Darapur, Delhi alongwith proportionate rights in land underneath
with intention to create security for the repayment of the loans. While creating the said
equitable mortgage I had already informed Union Bank of India that neither any proceeding
under the Income Tax Act is pending against me nor any such proceeding is contemplated
against me and that no notice under Rule 2 of Schedule II of the Income Tax Act is served on
me and no arrears of tax or any other sums are pending payable by me to the Income Tax
Department.
