Introduction
This Commitment Statement is a requirement of funding for the Mercedes-Benz Apprentice Programme. It
provides evidence that the Apprentice, their Employer and the Apprenticeship Training Provider (Mercedes-Benz)
all understand their roles and responsibilities in ensuring the Apprentice programme identified, is suitable and
appropriate, successful, and meets the funding requirements as set out by the Education and Skills Funding
Agency. All signatories to this document are required to make sure they fully understand all the information
contained within it, as it forms a schedule of the overall Framework Agreement between the Training Provider and
the Employer and to keep a copy of this document safe for future reference. This Commitment Statement should be
updated as required throughout the programme.

Programme Funding
Funding to support delivery of the Mercedes-Benz Apprentice Programme will be drawn from the Employer’s
Apprenticeship Service online digital account in line with Education and Skills Funding Agency’s Funding Rules.
The ESFA have this year announced, that from 1 st April 2019, the co-investment requirement from the employer
where there is insufficient funding available from an Employer’s Apprenticeship Service online digital account or
where the Employer is non-levy paying, has reduced from 10% to 5%. The Education and Skills Funding Agency
will pay this to Mercedes-Benz Cars UK Limited who operate the Mercedes-Benz Apprentice Programme as the
Training Provider. Incentive payments for 16-18 year olds remain in place, as per the Funding Rules. For all other
payments and schedules, please refer to Appendix K, Payment Schedule. English and Mathematics will be funded
separately by the Education and Skills Funding Agency. This is in line with Education and Skills Funding
Agency’s Funding Rules and is a condition of funding.

Length of Programme
An overview of the Apprenticeship structure and content is provided in Appendix E, Qualification Structure.
Detailed content and timings for the Apprenticeship are set out in Appendix F, the ILP. Appropriate adjustments
will have been, or can be made for prior learning when these are fully understood and verified.
Commitment Statement Responsibilities
The collective responsibilities of the Apprentice, the Employer and the Apprenticeship Training Provider
(Mercedes-Benz) are set out below. By signing this Commitment Statement, all parties are committing to meeting
their responsibilities. The Employer and Training Provider are also committing to adhering to the terms set out in
the Framework Agreement, of which the Commitment Statement forms Schedule 5.

Should the Apprentice fail to meet their obligations and responsibilities in accordance with this Commitment
Statement, the Training Provider reserves the right to take any such action it deems necessary including but not
limited to the suspension or exclusion of the Apprentice from the Mercedes-Benz Apprentice Programme.

Responsibilities of the Apprentice


1. To comply with the Mercedes-Benz Apprentice Academy Code of Conduct (and with any relevant terms and
conditions of employment as notified).
2. To be hard-working, thorough, punctual and committed in both work and training and to keep all the necessary
records in order to achieve the objectives of the Apprenticeship as set out in Appendix F, the Individual
Learning Plan (ILP), including Functional Skills, and to take an active role in their own professional
development.
3. To behave in a safe and responsible manner, in accordance with the requirements of the Health and Safety at
Work Act.
4. To support Mercedes-Benz Apprentice Programme to discharge its responsibilities under the Prevent Duty, as
set out by the Government. This includes promoting British values, and reporting suspicious behaviour to the
Mercedes-Benz Apprentice Programme Operations Manager. In the case of emergency or where individuals
are believed to be at immediate risk the Employer must contact the emergency services on 999, and also notify
the Academy (24-hour contact number is 07827 843550).
5. To promote the best interests of their Employer’s business, and of the Mercedes-Benz Apprentice Programme.
6. To work diligently to acquire the skills and knowledge detailed within the ILP.
7. Together with the Employer and staff of the Mercedes-Benz Apprentice Programme, to agree the ILP, regularly
review progress made in training, and agree any changes needed in the ILP.
8. To listen to feedback, both positive and constructive, from the Employer and Mercedes-Benz staff to enable an
ongoing process of review, evaluation, and improvement.
9. To work to achieve the learning aims outlined in the time available and to endeavour to complete the
Apprenticeship by the Planned End Date.
10. To meet the attendance requirements of the Mercedes-Benz Apprentice Programme, and to adhere to absence
reporting rules and processes as set out in the Contract of Employment and in the ILP.
11. To take responsibility for Equality & Diversity practices whilst working and training. All parties have
responsibilities in terms of Equality & Diversity. If the Apprentice ever feels they are being discriminated
against or being unfairly treated, they should talk to their supervisor at work or their trainer at the Academy. In
the event that they are unable to resolve the problem, they should speak to the Programme Operations Manager
at the Mercedes-Benz Apprentice Academy. Apprentices also have the responsibility to treat other people fairly
whether they are work colleagues, fellow Apprentices or customers.
12. To make full use of their 20% of-the-job training time as the Employer is paying wages for this time and is
contributing to programme costs. Off-the-job training can include attendance at the Academy, one-to-one
training, online learning, webinars, workbooks and computer-based training, all as part of a blended training
approach. Role rotation within the place of work may also feature to provide exposure to other roles linked to
the Apprenticeship.
13. To attend the Mercedes-Benz Apprentice Academy for off-the-job training as required, usually in 1 or 2 week
blocks. Apprentices will be notified of these arrangements accordingly. Joining instructions will be sent to the
Apprentice and their manager at least 3 to 4 weeks prior to commencement of the course.
14. To make every effort to avoid booking holiday during block attendance at the Academy as this will disrupt
training and could lead to the Apprentice falling behind.

15. In the event of sickness or other reasons for non-attendance during training at the Academy, Apprentices must
immediately notify both the Mercedes-Benz Apprentice Programme and their Employer. The Academy 24-
hour contact number is 07827 843550.
16. Apprentices who are absent due to sickness or other reasons while at work must follow their Employer’s policy
on sickness reporting.
17. In any instances where Apprentices stay in hotel accommodation to attend the Academy or any other aspect of
the off-the-job training, they will be representing themselves, their Employer and the Mercedes-Benz
Apprentice Programme. Apprentices are therefore expected to conduct themselves in an appropriate manner at
all times.
18. Apprentices should speak to their Development Coach regarding a grievance or problem that cannot be dealt
with at work. In such instances, the Apprentices should make every effort to do this as soon as possible. If
necessary, they can speak to the Apprenticeship Programme Operations Manager.
19. Apprentices also have a legal duty to obey safety rules and ensure they correctly use all personal protective
equipment supplied by either the Academy or their Employer. It is the Apprentice’s responsibility to follow all
guidance given by the Development Coach or Trainer regarding all matters of Health and Safety. All accidents,
however slight, either at the Academy or at work, must be recorded in the accident report book. In addition,
every incident must be reported to the Apprentice Programme Operations Manager immediately. Any near
misses that may cause damage or injury must be reported to the Apprentice’s supervisor at work or to the
Apprentice Programme Operations Manager immediately. This forms part of the Academy’s Health and Safety
Policy, a copy of which is displayed at the Mercedes-Benz Apprentice Academy.
20. Whilst training in the Academy’s workshops, smocks and safety boots must always be worn. Smocks are made
available by Mercedes-Benz for Apprentices to wear whilst at the Academy. The provision of safety footwear
is in accordance with each Employer’s policy. Apprentices’ failure to present themselves with appropriate
safety footwear when attending the Academy will result in sourcing from a local company at their or their
Employer’s expense.
21. Whilst at work, the company rules and safety precautions do apply, and Apprentices must abide by them at all
times.
22. Apprentices will normally be expected to provide their own pens, paper and drawing equipment. All other
necessary tools and equipment will be provided by the Employer or the Academy.
23. To comply with the Mercedes-Benz Apprentice Academy Code of Conduct and Disciplinary Rules and
Procedures and any instructions or requirements imposed in accordance with these rules and procedures.
24. To not do anything which, in the reasonable opinion of the Training Provider, could directly or indirectly harm
or bring the Training Provider, any member of its group of companies or the Mercedes-Benz brand into
disrepute by association or through continuation of the relationship with the Apprentice.
25. Agree with the Employer and Training Provider when learning is complete, to agree readiness to undertake the
End-Point Assessment.

Responsibilities of the Employer


1. To provide the Apprentice with a Contract of Employment and a salary in line with Government wage
requirements for Apprenticeships. This includes paying the Apprentice whilst undertaking off-the-job training,
as set out in the Funding Rules, and directed by the Education and Skills Funding Agency.
2. To ensure an Apprenticeship Agreement is in place between themselves and the Apprentice. This is a
requirement of Apprenticeship Funding and is covered in further detail under Policies and Procedures.
3. To ensure the Apprentice’s holiday entitlement and the procedure for arranging holidays are contained within
the employing company’s policies, and are explained to the Apprentice as part of their company induction.
Legislation regarding holiday entitlement is laid out in the Working Times Regulations.
4. To set hours of attendance that are subject to any conditions laid down in the Working Time Regulations
regarding minimum and maximum hours of work for an Apprentice and/or Young Person. It is the
responsibility of the Employer to maintain accurate records as evidence of the Apprentice’s attendance at work.
This recording system and the information held within it may be audited under the requirements set by the
Government.

5. To ensure that appropriate Employer’s Liability Insurance is in place. A copy of this must be displayed at the
Apprentice’s place of work.
6. To fulfil all contractual and statutory responsibilities, in particular to take responsibility for Equality &
Diversity practices and for the Health, Safety and Welfare of the Apprentice whilst working and training. This
includes providing all safety equipment as required to work safely in the workplace. All Apprentices are
entitled to the same protection under the law in Health and Safety, and Equality & Diversity matters as any
other employed person.
7. To agree an appropriate ILP based on the nationally-agreed Apprenticeship Framework or Standard.
8. To provide the learning, opportunities, support, experience, facilities and mentoring necessary, within an
agreed timescale, to achieve the objectives in the ILP.
9. To participate in regular reviews with the Mercedes-Benz Apprentice Programme and Apprentice.
10. To sign-off interim achievements made by the Apprentice, in agreement with the Training Provider.
11. To listen to feedback, both positive and constructive, from the Apprentice to enable an ongoing process of
review, evaluation and improvement.
12. To encourage continuous employment and progression on completion of the Apprenticeship.
13. To provide a suitable DBS-checked mentor for guidance and support.
14. To meet the attendance recording and reporting requirements of the Apprentice Programme, and to adhere to
absence reporting rules and processes. This includes immediately informing the Mercedes-Benz Apprentice
Academy if an Apprentice is absent for either of the following:
a. 10 consecutive days of unauthorised absence, or
b. more than 21 calendar days of authorised absence (due to accident, injury or sickness).
15. To support the Apprenticeship Training Provider, Mercedes-Benz, in their approach to the safeguarding of
Apprentices, and to report any concerns to the Mercedes-Benz Apprentice Programme Operations Manager.
16. To support the Mercedes-Benz Apprentice Programme to discharge its responsibilities under the Prevent Duty,
as set out by the Government. This includes promoting British values, and reporting suspicious behaviour to
the Mercedes-Benz Apprentice Programme Operations Manager. In the case of emergency or where
individuals are believed to be at immediate risk the Employer must contact the emergency services on 999, and
also notify the Academy (the 24-hour contact number is 07827 843550).
17. To adhere to any changes to the Funding Rules, as published by the Education and Skills Funding Agency in
relation to Employer contributions or any other changes.
18. To raise any Grievances in terms of the service provided by the Mercedes-Benz Apprentice Programme in a
timely manner. Grievances should be directed to the Mercedes-Benz Apprentice Programme Operations
Manager.
19. To release the Apprentice on the identified days to attend the Apprentice Academy, and allow time away from
their normal duties to participate in other learning activities, that are part of the mandatory 20% off-the-job
training requirements. Off-the-job training can include but is not limited to: one-to-one training, distance
learning, webinars, workbooks, and role rotation within place of work to provide exposure to other roles. The
employer will be responsible for the Apprentice’s travel to and from the Academy.
20. To support the Apprentice’s training at the Academy. To this end, hotel accommodation is available for
Apprentices, dependent on their locality in relation to Milton Keynes. Accommodation costs are the
responsibility of the Employer.
21. To provide necessary and unhindered access to the Employer’s premises, employees, Apprentices and any
required supporting paperwork or evidence as part of Ofsted Inspection, ESFA Audit, Matrix Standard or any
other external governing body or stakeholder as required within the ESFA funding rules.
22. To agree with the Apprentice and the Training Provider when learning is complete and the Apprentice is ready
to undertake the End-Point Assessment.

Responsibilities of the Training Provider


1. The Mercedes-Benz Apprentice Programme operates a policy of Equality & Diversity, which guarantees
equal treatment regardless of age, disabilities, gender reassignment, marriage and civil partnership,
pregnancy and maternity, race, religion and beliefs, sex (gender) and sexual orientation.

2. To address the issue of Equality & Diversity at the Apprentice’s first training session, where a discussion
will be held to inform the Apprentice about a number of ways in which people can be unfairly treated.
3. To provide and agree an appropriate ILP based on the nationally-agreed Apprenticeship Framework or
Standard.
4. To ensure all activities, as described in the ILP, take place in the appropriate timescales, environment and
circumstances, and that these focus on the needs of the Apprentice. This includes providing the necessary
training, learning objectives, support, and facilities.
5. To ensure that the training meets the nationally-required standards of quality assurance, including Health
and Safety and Equality & Diversity contractual requirements, required by the Education and Skills
Funding Agency and its partners. Mercedes-Benz trainers are fully aware of their responsibility for
carrying out Apprentice training within a safe working environment, and will enforce Health and Safety
requirements as necessary. From time to time during their training, all Apprentices will be reminded of the
principles of Equality & Diversity.
6. To endeavour to ensure a Mercedes-Benz Development Coach visits the Apprentice at their place of work
every 8 weeks. This is an opportunity for the Development Coach to engage the Apprentice and their
Employer in a review of progress and agree targets over the ensuing months, as well as provide one-to-one
training for the Apprentice as part of their 20% off-the-job requirement.
7. To provide a high-quality training programme at the Mercedes-Benz Apprentice Academy.
8. To provide all the necessary tools and equipment for Apprentices to use whilst undertaking training at the
Academy.
9. To ensure a register of attendance for off-the-job training (including distance learning) is kept at the
Academy, and any lateness or non-attendance is communicated to the Employer.
10. To listen to feedback, both positive and constructive, from the Employer and Apprentice to enable an
ongoing process of review, evaluation and improvement.
11. To participate in regular reviews with the Employer and Apprentice to evidence records of all interim
achievements made by the Apprentice.
12. To ensure the Apprentice is promptly presented with their completion certificate if undertaking an
Apprenticeship Framework. In the instances where the Apprentice is undertaking an Apprenticeship
Standard, the Apprenticeship Assessment Organisation will apply for and issue the achievement certificate.
13. To discuss any changes to the Funding Rules, as published by the Education and Skills Funding Agency,
with the Employer in relation to Employer contributions or any other changes.
14. To ensure the minimum Apprenticeship duration is in place for any Apprentice as in line with the Funding
Rules, as published by the Education and Skills Funding Agency.
15. To fully support the Apprentices to complete their Apprenticeship by the Planned End Date.
16. To encourage continued employment and progression upon completion of the Apprenticeship.
17. To safeguard the wellbeing of all Apprentices on the Mercedes-Benz Apprentice Programme.
18. To discharge their responsibilities as set out in the Government’s Prevent Duty. This includes promoting
British values, and taking steps to help prevent the radicalisation of young people.
19. To ensure a robust payment system is in place to facilitate the timeliness of the collection of Employer co-
investment contributions (where required), distribution of Employer incentive payments (where applicable)
and management of any other funding associated with the Apprenticeship Programme.
20. To notify the Employer as soon as is practicable of any advanced notification from Ofsted or any other
external governing body or stakeholder as required within the ESFA funding rules that they may require
access to the Employer’s premises, employees, Apprentices and any required supporting paperwork or
evidence of learning, as part of any Inspection or Audit.
21. For Apprentices undertaking off-the-job training at the Academy, a light lunch will be provided. For those
Apprentices staying in hotel accommodation, breakfast and dinner will be included in the arrangements.
22. To agree with the Apprentice and the Employer when learning is complete and the Apprentice is ready to
undertake the End-Point Assessment.

Policies and Procedures

Apprenticeship Agreement
The Apprenticeship Agreement is a statutory requirement for the employment of an apprentice in connection
with a recognised apprenticeship framework or approved apprenticeship standard, and is in the form prescribed
by section 32 of the Apprenticeships, Skills, Children and Learning Act 2009 (ASCLA) and the Apprenticeships
(Form of Apprenticeship Agreement) Regulations 2012.

Mercedes-Benz is committed to ensuring that all the conditions of funding of an Apprenticeship are adhered to.
Confirmation is required that the Apprentice and Employer have both signed the Apprenticeship Agreement. An
Agreement is supplied in order to complete this requirement (Appendix A).

Electronic Evidence
Mercedes-Benz Apprentice Programme recognises the need to ensure the welfare and safety of all young people
in education. Mercedes-Benz will not permit photographs, videos, audio recordings or other images of young
people to be taken without the consent of the Apprentices and/or Parents/Guardians.
By signing this commitment statement, the Apprentice is confirming that they have read, Apprentice
completed and signed the necessary Electronic Evidence Collection Form (Appendix B), and, if tick to

Queries and Complaints


The Mercedes-Benz Apprentice Programme is committed to delivering a high-quality Apprenticeship training
experience. Should any signatory to this commitment statement have a query they wish to raise, or a complaint to
make, the procedure for doing so, and the escalation route for complaint handling is set out in Appendix C.

Safeguarding and Prevent


The Mercedes-Benz Apprentice Programme is committed to safeguarding the wellbeing of its Apprentices at all
times throughout the duration of their Apprenticeship training. A copy of the Safeguarding and Prevent
Statement is included in this Commitment Statement (Appendix D). By signing this Commitment Statement, you
are agreeing to support the Mercedes-Benz Apprentice Programme in its duty to safeguard the wellbeing of its
Apprentices.

Key Provider Policies


The Mercedes-Benz Apprentice Programme is committed to Health and Safety, Equality Diversity and Inclusion
and the prevention of Harassment and Bullying. Our policies are on display at the Academy and copies can be
provided upon request.

forms at the start of my Apprenticeship, or that subsequent to completing the forms I take action to change my
circumstances and eligibility for funding, the Provider may take action against me to recover the tuition fees and the costs of
any other support provided.

April 2012, an Apprenticeship Agreement must be in place at the start of the apprenticeship.

Further to the Apprenticeships (Form of Apprenticeship Agreement) Regulations 3 which came into force on 6th
April 2012, an Apprenticeship Agreement must be in place at the start of the apprenticeship.

The purpose of the Apprenticeship Agreement is to identify:

 the skill, trade or occupation for which the Apprentice is being trained;
 the apprenticeship framework or standard connected to the apprenticeship;
 the dates during which the apprenticeship is expected to take place; and,
 the amount of off-the-job training that the apprentice is to receive.

The Apprenticeship Agreement is incorporated into and does not replace the written statement of particulars issued
to the individual in accordance with the requirements of the Employment Rights Act 1996.

as confidential. We also aim to resolve your complaint as speedily as possible. In the first instance you should
submit your complaint via e-mail to the Apprentice Academy where it will be handled by a Development Coach
or Trainer.

Safeguarding Statement
Mercedes-Benz Apprentice Academy recognise that our moral and statutory responsibility is to safeguard and
promote the welfare of all apprentices. Safeguarding is the action taken to promote the welfare and wellbeing of
children and young people and can be actioned in the following ways:

 Protecting children from abuse and maltreatment


 Preventing harm to children’s health or development
 Ensuring children grow up with the provision of safe and effective care
 Taking action to enable all children and young people have the best outcomes within their lives

The Apprentice Academy endeavour to provide a safe and welcoming environment where apprentices are respected
and valued. The Apprentice Academy are alert to the signs of abuse and neglect and follow our procedures to
ensure that apprentices receive effective support, protection and justice. Mercedes-Benz Apprentice Academy
recognise that all staff, due to their contact and knowledge of the apprentices, are responsible for and have a role to
play in safeguarding the young people they work with, and are responsible for and have a role to play in
safeguarding the young people and at all times the best interest of the young person should be considered. The
Apprentice Academy will act to protect a young person where there is a disclosure or concern about abuse.

Mercedes-Benz Apprentice Academy aims to:

 support the apprentice’s development in a way that will foster security, confidence and independence
 provide an environment where young people feel safe, secure, valued, respected and confident, and know how
to request help if they are in difficulties, knowing they will be listened to

PREVENT Statement
Mercedes-Benz Apprentice Academy supports the government guidelines regarding the PREVENT programme.
‘Prevent’ relates to the Counter Terrorism and Security Act 2015.

The Government has defined extremism in the PREVENT strategy as “vocal or active opposition to fundamental
British values, including democracy, the rule of law, individual liberty and mutual respect and tolerance of different
faiths and beliefs.”

Mercedes-Benz Apprentice Academy believes in the importance of free speech, however when certain speeches
and literature are designed to manipulate those who are vulnerable; this goes against the moral principle in which
free speech is valued by many.

Mercedes-Benz Apprentice Academy aims to:

 ensure all staff have an understanding of the risks affecting individuals, including social media and the internet
i.e. ensure apprentices are protected against extremist and violent messages including, but not limited to, Neo
Nazi White Supremacist ideology, Animal Rights, Irish Nationalist and Islamist ideology. All learner laptops
have restricted access to ensure they are unable to access and become manipulated by extremist views.
 Staff are required to ensure their classroom layout enables them to see what apprentices are accessing/viewing
on their laptops.
 build resilience to radicalisation by promoting British values – democracy, the rule of law, individual liberty,
mutual respect and tolerance for those with different faiths and beliefs

QUALIFICATION STRUCTURES

Standards

Apprenticeship Standards are occupation-focused, they are not qualification-led. They include a list of the skills,
knowledge and behaviours you will need to have learned by the end of your apprenticeship.

Employer groups, known as Trailblazers, have developed the Standard for the relevant occupation. This means the
Standards are related to what is needed in the workforce and the skills required to be capable of carrying out all
aspects of the job.

A minimum of 20% off-the-job learning happens throughout the apprenticeship, completed at your workplace and
the Mercedes-Benz Academy. You are independently assessed at the end of your learning and development
programme.

Functional Skills
Functional Skills are the basic skills that all people need to be able to operate confidently and successfully in work
and in life. We have embedded Maths, English & ICT Functional Skills into our programme of delivery to ensure
continuous development in these core areas.

There are also minimum qualification requirements which must be achieved before the end-point assessment of the
Apprenticeship Standard can be taken in English and Maths.

You may be exempt from one or more Functional Skills if you already hold a Level 1 for Level 2 Apprenticeship
Standards, or Level 2 for Level 3 Apprenticeship Standards

End-Point Assessment

End-point assessment (EPA) is the name given to a series of assessments you will take to prove your ability to do
the job you have been training for. They are carried out by an approved EPA Organisation selected by your
Employer and take place at the end of your apprenticeship following a period of on-programme training and
development.

Where your Apprenticeship Standard includes mandatory requirements, these must be achieved prior to applying
for EPA e.g. minimum duration; functional skills. You, your employer and Mercedes-Benz as your training
provider will then discuss your “readiness” for EPA. This decision process is known as the Gateway to End-Point
Assessment.

The EPA format varies between apprenticeship standards. They are designed by the Employer Trailblazer Groups
to enable you to demonstrate that you have developed the key knowledge, skills and behaviours needed to be able
to do your job effectively.

Mercedes-Benz Competence
Mercedes-Benz Competence is a value-added aspect to your Apprenticeship Programme, on completion of which
you will be eligible to attend a prestigious Graduation event.

Expanding on the minimum requirements of your Apprenticeship Standard, Mercedes-Benz Competence provides
the opportunity to apply your knowledge, skills and behaviours across the range of products and services of
Mercedes-Benz.

Apprentice Academy Code of Conduct


The Mercedes-Benz Apprentice Academy sets high standards of training which are reflected in the training
facilities.

During training, all apprentices are representing the company; therefore, they should uphold and abide by the
expectations indicated below. The rules that are in place are there to try to make their stay and experience at the
academy as enjoyable and as safe as possible.

Attendance

Apprentices are expected to be punctual at all times

Any absences need to be notified to the Mercedes-Benz Apprentice Academy and dealership as soon as possible

Lateness during the week are recorded, three or more lateness’ in one week may result in a verbal warning.

Performance

All assignments and homework set are to be completed by the given deadline and emailed to
assignments.apprentice@daimler.com. If for any reason the deadline cannot be met, it is the apprentice’s
responsibility to contact the Mercedes-Benz Apprentice Academy to explain the circumstances.

It is the responsibility of the apprentice to liaise with their workplace mentor to ensure that they collect the required
job card evidence in a timely manner

Plagiarism

Plagiarism is presenting somebody else’s work as your own. Plagiarism is taken very seriously by Mercedes-Benz
Apprentice Academy, and the IMI.

Those involved in plagiarising their work will need to redo the work and may receive a disciplinary. Managers and
Development Coaches will also be notified.

Health & Safety

Apprentices must abide by the health and safety rules, those who are not abiding by these rules may be required to
leave the premises and return to their dealership.

Any apprentice bringing medication into the Mercedes-Benz Apprentice Academy must make sure that they keep it
secure at all times.

Dress code

Male apprentices must wear a plain white shirt, tie, smart trousers (no denim) and dark shoes.

Female apprentices must wear a plain white blouse, smart dark trousers (no denim) or knee length dark skirt and
dark shoes.

High heels, trainers or canvas shoes are not allowed

A plain black V-neck sweater/cardigan may also be worn.

Apprentices must arrive at the Mercedes-Benz Apprentice Academy dressed to the above code.

Smocks (provided at the Mercedes-Benz Apprentice Academy) and safety boots/shoes (provided by the apprentice)
must be worn for practical workshop based training.

Hats, hoodies and caps are not allowed whilst at the academy.

Earrings and piercings are to be kept to a minimum and should be removed whenever possible whilst at the
Mercedes-Benz Apprentice Academy.

Long hair must be tied back during practical workshop-based training.

Unnatural hair colours are not permitted and could result in an apprentice being returned to their dealership.

Hotel dress code is smart casual, no vest tops. All apprentices must adhere to the Mercedes-Benz Apprentice
Academy dress code whilst having breakfast.

Behavioural expectations

All Mercedes-Benz Apprentice Academy personnel and visitors (who occasionally come on site) must be
addressed in the appropriate manner.

Any form of bullying/harassment by an apprentice towards a fellow apprentice or a member of staff will not be
tolerated and will be fully investigated.

Bad language will not be tolerated

All apprentices must conduct themselves in the appropriate manner whilst attending the Mercedes-Benz Apprentice
Academy.

Workshops

Apprentices must not enter the workshops unsupervised

Personal protective equipment must be worn at all times in the workshops

Personal mobile phones and portable music devices must be placed into the locked box at the start of each session
and should always be returned after breaks and lunch.

Personal jewellery must be removed during workshop activities

Food is not permitted to be eaten in the workshop or classroom

Only water in a plastic cup or a water bottle is allowed in the workshops

Apprentices must conduct themselves in a safe manner in the workshops

Apprentices must not sit on workbenches or the training vehicles in the workshops

Apprentices must not start vehicles unless instructed to do so by the trainer.

All accidents, however minor, should be reported to the trainer and recorded in the accident book.

It is the apprentice’s responsibility to check toolboxes before and after use – loss of tools may be charged to the
group.

The workshop must be left clean and tidy after each session

I.T. Equipment

Apprentices must not touch any I.T. equipment unless authorised by their trainer.

Apprentices must not insert or load any disc software onto the computers until it has been virus checked and
authorised by the trainer.

No games are to be loaded or played on the computers at the Mercedes-Benz Apprentice Academy.
Misuse or damage will not be tolerated. Any damage will be reported and any costs incurred will be charged back
to the employer.

Websites should only be accessed as required to complete coursework.

No unauthorised or inappropriate websites should not be accessed.

Classrooms

Apprentices must not enter the classroom unless their trainer is present.

Personal mobile phones and portable music devices must be places into the locked box at the start of all sessions,
and also after breaks and lunch.

No food should be consumed in the classrooms

Apprentices should not put their feet on chairs and tables

Academy facilities

Chewing gum is not permitted at the Mercedes-Benz Apprentice Academy

Personal protective equipment should be stored in the workshop as instructed by the trainer

Smoking, including the use of e-cigarettes, is only allowed in the designated smoking shelter

Washroom facilities must be left clean and tidy

Apprentices must not sit in, or on parked vehicles in the cark park

Apprentices must not leave the premises for lunch without completing the sign in/out register at reception

All apprentices using the refectory must make sure that they leave their area clean and tidy, picking up any rubbish
left behind.

Apprentices must not put their feet on the table or chairs, nor should they sit on the tables.

Personal vehicles

Apprentices must drive sensibly and carefully when arriving and leaving the premises, adhering to all speed limits

Apprentice’s vehicles must be parked in the designated area, unless there are no spaces available, in which case
when signing in on Monday afternoon they should inform the academy receptionist of where they have parked
Keys will be retained at the Mercedes-Benz Apprentice Academy for residential learners – if emergency access is
required, please inform your trainer who will let the Trainer Manager and Learning Liaison Officer know.
Day students must place their keys in the box with their mobile phones each morning

Personal vehicles cannot be used unless permission is sought from the Trainer Manager or Learning Liaison
Officer
Apprentices must keep away from parked vehicles during break and lunch times

Hotel rules

On arrival, check the room that you have been allocated and report any damage to reception that day

Smoking, including the use of e-cigarettes is permitted only in the designated areas. Possession and use of illegal
drugs are prohibited.

Apprentices found to have been smoking in their room or tampering with the fire sensors located in the hotel room,
will face disciplinary action and their manager will be informed

Alcohol purchase or consumption is prohibited whilst on your training course

No running or misbehavior in corridors. CCTV is installed and the apprentice’s manager will be notified of any
incidents

All rubbish is to be put in the bins provided

Games room, restaurant, leisure facilities and individual rooms should be left clean and tidy

All areas will be inspected on departure. Any damage could result in a recharge to the apprentice or their employer

Staff must be addressed in the appropriate manner

Offensive weapons

As part of our responsibility to safeguard everybody who attends the Mercedes-Benz Apprentice Academy it is
forbidden for anybody to carry an offensive weapon

Any weapons, which are found at the Mercedes-Benz Apprentice Academy or at the hotel, will be handed to the
police for disposal

Nothing that looks like and could be perceived to be an offensive weapon should be brought onto the premises

Transportation

Apprentices must ensure that they present themselves punctually

Transport provided for apprentices will always leave on time – refer to the credit card sized contact card issued by
your trainer/development coach for details

Apprentices who are late and miss the transport will be responsible for costs incurred in travelling to the Mercedes-
Benz Apprentice Academy. If a taxi is called on behalf of the apprentice due to the apprentice not having money, it
will be charged back to the employer

Litter must not be dropped on any transport supplied by the Mercedes-Benz Apprentice Academy

Mercedes-Benz Apprentice Academy reserves the right to withdraw transport facilities from apprentices who
behave irresponsibly whilst travelling between the hotel and the academy

Prevent

Mercedes-Benz Apprentice Academy is government by and supports the Government’s Prevent strategy
established from the Counter Terrorism and Security Act 2015

All apprentices are encouraged to be aware of the signs of radicalisation and to report any concerns they have to
their trainer and/or the Learning Liaison Officer

All apprentices are encouraged to challenge any extremist views they come across appropriately and to inform their
trainer

Safeguarding Policy

abuse or neglect might be alleged
 Policies will be reviewed at least annually unless an incident, new legislation or guidance suggests the need
for an intern review

Mercedes-Benz Apprentice Academy Disciplinary Rules and Procedures
The Mercedes-Benz Apprenticeship Programme expects you to conduct yourself in a responsible manner at all
times. Good discipline is essential for the safety and effective training of you and your colleagues. Any apprentice
found in breach of the Academy Code of Conduct whilst on the programme will be dealt with in accordance with
the Disciplinary Rules and Procedures.

The purpose of this procedure is to ensure that you are aware of the consequences of inappropriate behaviour. Your
employer may be made aware of any disciplinary reviews whilst at the Academy. You are also subject to your
employer’s normal disciplinary procedure.

Stage 1 - Verbal Warning


Stage 2 - First Written Warning
Stage 3 - Final Written Warning
Stage 4a – Suspension pending further investigation
Stage 4b – Dismissal

Review Stage Warning


Stage 1 This will be appropriate where there has been a minor breach of the Code of
Verbal Warning Conduct and standards the Academy expects of its apprentices. The warning will
ordinarily state that any further misconduct will render the apprentice liable for
further more severe disciplinary action.
Stage 2 This will be appropriate where there has been a more serious breach of the Code
First Written Warning of Conduct and standards the Academy expects and a Verbal Warning is either not
appropriate due to the seriousness of the breach, or further minor offences have
been committed following a Verbal Warning
Stage 3 If the misconduct is sufficiently serious, or following the issue of a First Written
Final Written Warning Warning there has been a further incident of misconduct, the apprentice may be
issued a Final Written Warning.
Stage 4a Where the Academy establishes that an apprentice has committed further incidents
Suspension or following the issue of a Final Written Warning, the apprentice will be
suspended pending further investigation which may lead to their dismissal from
the programme
Stage 4b Where the Academy establishes that an apprentice has committed an act of Gross
Dismissal Misconduct or the outcome of investigations from Stage 4a is deemed to require
it, the apprentice will be dismissed from the programme

Any apprentice with a disciplinary record for the same type of offence, older than six months, will not have this
taken into account in any future disciplinary action.

Examples of discipline covered by this procedure are given below under two headings. It should be emphasised
that the list is not exhaustive.

Misconduct
Misconduct refers to occasions where Academy standards are infringed. Examples include but are not restricted to
those given below; this list is not exhaustive and serves only as a guide:

 Unsatisfactory time-keeping or attendance


 Unsatisfactory work performance
 Unacceptable dress code or appearance
 Harassment, bullying or victimisation
 Smoking, including e-cigarettes, other than in designated areas
 Unauthorised absences
 Misuse of Academy property or equipment
 Using and/or driving an Academy or another apprentice’s vehicle without permission
 Misuse of Academy facilities

Gross Misconduct
Gross misconduct refers to offences so severe that the action erodes the trust and confidence of the Academy
and/or fundamentally compromises the integrity of the programme and reputation of the Brand.

Although not an exhaustive list, the following offences may constitute sufficient reason for the Academy to expel
apprentices on the basis of Gross Misconduct who have committed such offences whilst at the Academy:

 Theft or fraud;
 Bribery;
 Physical or verbal abuse or threatening behaviour;
 Fighting and/or assault or attempting to assault;
 Harassment, discrimination, bullying or victimisation;
 Extreme rudeness to staff, visitors, suppliers and/or fellow apprentices;
 Deliberate and serious damage to property;
 Serious misuse of the Academy’s property;
 Deliberately accessing internet sites containing pornographic, radicalised, offensive or obscene
material;
 Serious insubordination;
 Bringing the Academy or Mercedes-Benz brand into serious disrepute;
 Causing loss, damage or injury through serious negligence;
 A serious breach of health and safety rules;
 Being found in possession of illegal drugs either at the Academy or at the hotel;
 The use of illegal drugs or the consumption of alcohol at any time whilst at the Academy or Hotel

Appeals Procedure
Apprentices dissatisfied with the outcome at any stage of the formal disciplinary procedure may appeal by
completing a Disciplinary Appeal form signed by both the apprentice and their manager, within 10 working days of
the date of the initial outcome.

We will endeavour to hold the appeal hearing within 10 working days of receipt of a Disciplinary Appeal form,
although in exceptional circumstances this may be extended. The appeal hearing may take the form of a review of
the earlier decisions or may be a full re-hearing of the disciplinary hearing. Particular attention will be paid to any
new evidence introduced. The appeal investigation will ordinarily be conducted by an impartial manager who has
had no previous involvement with the case. The Appeal Manager will be no less senior than the Disciplinary
Manager.

Following the appeal hearing, any disciplinary penalty imposed will be reviewed, although it cannot be increased in
terms of severity. The outcome of the appeal hearing will be confirmed in writing. In certain limited
circumstances (for example to protect a witness) we retain the right to withhold some information.

Until the outcome of the appeal has been decided, any disciplinary sanction (including dismissal or suspension)
will remain in place. The decision reached at the appeal hearing is final.

ROLE OF APPRENTICE ACADEMY STAFF

Apprenticeship Programme Operations Manager

Helen Taylor is the Apprentice Academy Operations Manager and oversees all aspects of the apprenticeship
programme.

Course Developer and Quality Manager

The Course Developer and Quality Manager, Mick Iannantuono, updates the course material and resources to meet
the requirements of the business and to support apprentices in achieving their qualification alongside assuring
quality of delivery to make the learning experience effective and enjoyable.

Programme Administration & Welfare Team

Members of the Programme Administration Team are responsible for sending out block joining instructions,
organising hotel accommodation, transport to and from the hotel and apprentice welfare whilst on block training.
Other roles include co-ordinating the recruitment process to support employers in appointing apprentices. They
also maintain learner records, manage the Government funding process and certificate qualifications.

Field Development Coaches

Development Coaches visit apprentices in the workplace on an eight week cycle. Their role is to complete welfare
reviews, ensure health and safety requirements are met and carry out workplace assessments and coaching.
Progress is reviewed in the workplace by observations of tasks in the working environment as part of the normal
day to day tasks. Apprentices will also produce job card evidence of tasks that have been carried out at work
between these visits in partnership with their workplace mentors. SMART objectives support apprentices as they
progress through a qualification and develop into competent Technicians or Parts Advisors.

Trainers

The Training Team deliver the theoretical and practical training aspects of the programme to aid apprentices in
developing the right skills, knowledge and behaviours an apprentice will need in order to meet the qualification
standards assessed through or at the end of the programme. Training takes place at the Academy in classrooms and
fully-equipped workshops, using interactive Smart boards and the latest diagnostic equipment.

Internal Quality Assessor (IQA)

The Internal Quality Assessor’s role is to carry out quality control to ensure the qualification has been delivered
against the defined standards in a fair, and consistent, manner by the training and coaching teams.

Ofsted Inspectors

Mercedes-Benz Apprentice Academy is inspected regularly by Ofsted in the same way that schools and colleges
are to ensure the training programmes are being delivered in line with Government policy and the interest of the
learner.

The External Quality Assessor audits the programmes to ensure the Internal Quality Assessor, Coaches and
Trainers are delivering the qualifications to the defined standards.

Education & Skills Funding Agency (ESFA) and European Social Fund (ESF) Auditors

Payment Schedule

1. Payment of the Charges (as detailed below) for the Training Services selected on the Request for Services will be
drawn down from the Digital Account. In the instance where insufficient funding is available in the Digital
Account, the Employer shall pay an outstanding sum, in line with the ESFA Funding Rules, this Schedule 9 and
Clause 7.

2. Payment of 80% of the Charges will be drawn down in equal monthly instalments over the planned duration of the
Training Services programme. The remaining balance (20% of the Charges) will be payable and drawn down on
completion by the Apprentice of the end-point assessment (Apprenticeship Standard) or programme achievement
(Apprenticeship Framework).

3. Where Apprentices are aged 16-18 on registration of the Training Services with the Training Provider, an incentive
payment is payable by ESFA to the Training Provider to be reimbursed to the Employer upon its receipt and for the
amount and at the specific intervals as shown below. The Apprentice is required to be in employment with the
Employer with whom the Apprenticeship programme commenced at the time points referenced below in order for
the Employer to qualify for this incentive:

 End of Month 3 - £500

 End of Month 12 - £500

Any such incentive payments shall only be paid to the Employer following receipt by the Training Provider of the
corresponding payment from the ESFA.

4. When an Apprentice is identified as having prior learning which matches the content of the Training Services
programme they are registered on, the Charges and programme content will be adjusted as applicable following an
assessment of their knowledge, skills and competence.

5. Should an Apprentice leave the Apprenticeship programme before the scheduled end date of the Apprenticeship
programme, the Apprentice’s leaving date will be the last confirmed and recorded point of contact with a member
of the Training Provider’s Apprentice team and for the avoidance of doubt shall not be their last date in
employment with the Employer. Any proportion of the monthly instalments drawn down for the exiting
Apprentice drawn down subsequent to the leaving date will be refunded into the Employer’s Digital Account.

assessment organisation from the Register of Apprentice Assessment Organisations, and agree a price. The Training Provider will
then contract with the assessment organisation and make payment for the end-point assessment.

This shall be the Training Provider training delivery costs plus EPA costs minus any applicable adjustment for prior learning or
sponsorship from Mercedes-Benz Cars UK Ltd. Sponsorship levels are subject to review at each intake.

Where the Approved Assessment Organisation (AAO) is not known when the Request for Services is submitted
and the Charges exceed the ESFA Maximum Funding Band or the Charges are adjusted to account for new
requirements from the Institute of Apprenticeships whilst the Training Services are being delivered, then the
Training Provider shall pay the difference in the Charges and the ESFA Maximum Funding Band, up to a
maximum value of £550.

Where the Charges leave an outstanding amount greater than £550, the Employer shall pay the difference between
the Charges and the ESFA Maximum Funding Band plus any contribution from the Training Provider. This
additional payment shall be invoiced to the Employer by the Training Provider pro-rated for the remaining duration
of the Training Services programme.

NB: For 2019 Mercedes-Benz Cars UK Ltd have increased their sponsorship levels to allow for the notification of
the funding band reviews by ESFA being received after completed Request for Services. Mercedes-Benz Cars UK
Ltd sponsorship level is subject to annual review by the Training Provider and any change shall be at the sole
discretion of the Training Provider and shall be notified to the Employer.

Additional Costs

These costs are ineligible for payment from the Employers Online Account and shall be invoiced to and payable by
the Employer in accordance with this Agreement (“Admin Charges”).

Administration Fee

Heavy Vehicle / Light Vehicle Technician Apprenticeship programmes: £1,800

Retail Parts / Customer Service Apprenticeship programmes: £1,512

The Admin Charges are payable monthly split pro-rata (monthly) for the duration of the Apprenticeship
programme and cover the catering costs, transport and associated contract management of these services whilst at
the Academy.

Should an Apprentice leave the Apprenticeship programme before the expiry of the planned duration of the
programme Admin Charges shall be charged and invoiced by the Training Provider to the end of the month in
which written notification of the Apprentice leaving the Apprenticeship programme is received by the Training
Provider.

Administration Fees are subject to annual review by the Training Provider and any change shall be at the sole
discretion of the Training Provider and shall be notified to the Employer.

Hotel Accommodation

Planned academy attendances at a Training Provider nominated site per Apprenticeship programme duration:

Heavy Vehicle/Light Vehicle Technician: 25 weeks

Retailer (Parts) Level 2: 7 weeks

Retail Team Leader (Parts) Level 3: 7 weeks

Customer Service Specialist: 13 weeks

Cost of hotel accommodation per night: £68.78 (“Hotel Charges”)

Hotel Charges will be invoiced by the Training Provider’s disclosed agent in the month following Training
Provider’s site attendance by the Apprentice. One week is comprised of 4 nights of hotel accommodation.

Additional Training Provider site attendances required as a result of functional skills training; to support additional
learning needs and; Sunday night bookings will be charged at the same rate cost per night as set out above.

Late cancellation costs may be charged by the hotel up to 100% of the Hotel Charges where less than 62 days
notice of cancellation is given.

Hotel Charges are subject to annual review by the Training Provider on 1 January each year and any change shall
be at the sole discretion of the Training Provider and shall be notified to the Employer.

Prior Learning

Where an Apprentice is identified by the Training Provider as having prior learning a skills assessment will be
carried out by the parties to determine if there will be a requirement for an Employer contribution which cannot be
recovered from the Employer’s Online Account. The parties shall enter into good faith discussions to determine the
sums due for any sums due in accordance with this paragraph.
