Ramas , who being first duly sworn, deposes and says that on the 28" day of December , 2023 A.D., in the county aforesaid, one Joshua James Nareau , being further described as white male, with a date of birth of 04/11/2000, ha g black hair and brown eyes, standing 5'10 in height, weight approximately 200 pounds, with a last known address of 8449 Topeka Circle, Port Charlotte, Charlotte County, Florida 33981, did commit the offense of second degree murder, in violation of the Florida State Statute 782.04 (2). There is evidence to support this in that: On December 28, 2023, at approximately 5:15am, deputies with the Charlotte County Sheriff's Office responded to 8432 Matecumbe Road, Port Charlotte, Charlotte County, Florida, 33982 in reference to a shooting; The caller, Lynda Khoury, had called stating that her husband, James Khoury, had been shot in front of the home. : Deputy J. Schwartz arrived on scene at approximately 5:21am and observed Lynda standing in the front entryway on the phone with 921. James was lying on his back,arms outstretched on the front pathway. He observed what appeared to be a gunshot wound to the center of his chest. Lynda told Deputy Schwartz she did not see what happened. Deputy Schwartz began first aid but could not feel a pulse for James, Deputy Schwartz observed a lunch box and a handgun in a holster lying next to James. He checked the firearm in the holster to see if it had been fired but it initially appeared that it rad not been fired. Once additional deputies arrived on scene, Deputy Schwartz conducted a safety sweep of the residence, Deputy First Class J. Moritz also responded to 8432 Matecumbe Rd. Upon his arrival, Deputy First Class Schwartz was on scene and advised that there was one subject down in the driveway, Deputy First Class Moritz checked the residence for the caller who advised that she was the only one in the residence. Deputy First Class Moritz then began to check the subject identified as, James S. Khoury, ‘W/M, DOB: 01/21/1952. Deputy Frist Cass Moritz advised Central Communications that it was clear for EMS to enter, and he began to cut the subject's shirt using trauma sheers. Deputy First Class Moritz observed that there was a single gunshot wound to the subject's chest. The subject also did not have a pulse. While checking the subject, a white male subject began to walk from the side of the house. Other Nv-RP 16052621 PAGE 1 OF 8deputies on scene backed him up from the front of the residence and identified him as Joshua Nareau 0B (04/11/2000). Charlotte County Fire & EMS responded and began to run a medical strip on the subject. EMS advised that the subject was deceased. Deputy Frist Class Moritz removed the subject's driver's license from his wallet and identified him. Deputy P. Gerhart also responded to this scene and while on scene, he observed Joshua sitting in the grass outside the residence. Joshue told Deputy Gerhart that he received a phone call from his grandmother, Lynda, explaining that his grandfather, James, had been shot. Joshua explained that he immediately ran here from his residence, which is located at 8449 Topeka Circle, Port Charlotte, Charlotte County, Florida 33981, utilizing paths that are in the woods between his residence and the incident location. Due to the nature of the incident, |, Detective R, Ramas with the Charlotte County Sheriff's Office Major Crimes Unit, was called out to further investigate. | responded to the scene and observed James lying on the front walkway, where it meets the driveway. ‘There was a blue lunchbox and a holster with firearm next to James. There did not appear to be a hole inthe holster consistent with the firearm being accidentally fired while holstered. Detective Lindsey and I spoke with Lynda Khoury in my unmarked patrol vehicle. Lynda was seated in the front passenger seat of the vehicle for the interview. | read Lynda Miranda, and she provided @ sworn recorded statement. Post Miranda, Lynda wanted to explain something that happened yesterday (12/27). She mentioned every morning, she sees him to the door, and gives him a kiss goodbye. There is. a litle chair right near the door, she sits on. She locks the door. She watches out the door, until he backs up, when he gets to the road, and heads this way, she shuts the motion detectors off, James called Lynda from his phone and told her; he heard a gunshot. Lynda sald that’s strange but explained they have heard gunshots before in the neighborhood, Lynda sald they sort of dropped it, they did not call the police, they did not do anything, Today James got up, he was at the door, she gave him a kiss. He carries his lunch, has his gun, wallet, and keys. Lynda heard a gunshot and heard James yell Lynda". She ran out there, and she heard him hit the ground. Lynda heard 2 “thud”. Lynda went up there, his lunchbox was there, his keys were on the floor. There were two blood spots, and a hole in his chest. Lynda said she knew he was dead. She ran back into the house and locked the door. She immediately called 911. Lynda heard a thud but did not see James fall. ‘When asked when he walks out the door and goes to his car, how long before she heard the shot. Lynda sald seconds. Two seconds after she shut the door and locked it. When asked to clarify what she meant by James screamed her name, Lynda explained he yelled out her name. Lynda thinks the thud was going on while she ran out the door. Lynda did not hear anything or see anyone when she ran outside, Lynda mentioned what scared her, she looked around and thought maybe she was going to be next. She got, scared and ran into the house. ‘When asked how Joshua got here. Lynda sald she called him after 911. When asked if the cops were here already when Joshua got here. Lynda was in the house and did not know. Lynda called him, he said ‘grammy, what's the matter, what's the matter. Lynda told him your grandfather has been shot. Joshua was seated in the front passenger seat of the vehicle for the Interview. | read Joshua Miranda, and he provided a sworn recorded statement which is in summary and not verbatim. Post Miranda, Joshua said he woke pa little bit before his alarm to go to work. He was lying in bed watching YouTube, because he lets it auto play when he goes to sleep. His phone starts ringing, he reaches over and grabs it, and answers the phone, it was his grandmother. She said he was shot, he asked who, she said the police are here, and they are worried about a sniper or something, Joshua said OK, I'l be right there, call mom. He hung up the phone, got dressed as fast as possible, and "ran over here”. Joshua ran up the house, came out of the path, and saw a police officer, driving down the street alittle way. He saw the flashing lights but did rot see any cars at that point aside from that one driving by. Joshua ran up to the side of the building, he turned the corner, and saw two officers kneeling over his grandfather, He asked what happened. “They told him to back up, he backed up. They had him walk around the corner of the house and told him what was going on. They patted him down; Officer "Pete" spoke with him for a litle bit. They would not let him in the house to see his grandmother. Joshua sat down and waited to see what was going on. He mentioned at some point, the officer had him walk back around the house and told him they were going to go to the car. Joshua said everyone was walking around and he kind of knew what that meant. He got in the car and that was the end of it. Joshua's grandmother is Lynda Khoury and grandfather is James Khoury. When asked what exactly grandma said when she called him, She said he had been shot, Joshua asked who, she said the police are here, something about a sniper, and she's worried. Joshua lives at 8449 Topeka Circle, which is the street behind the grandparents residence. When asked what the quickest way is to get from there to there. Joshua sald through the pathway, they made through the woods. When asked who made that pathway, Joshua said, him and his grandfather (James). When asked how long it takes to get there, if he walks briskly, Joshua sald including getting dressed, and running out the front door, it probably took him no more than three minutes to get there, four minutes, that's including getting dressed. When asked if he heard anything when running, he sald not exactly. When asked if he saw anyone, he said no. He did not hear any gunshots when running. When asked if he heard any gunshots before his grandmother called him, he said no. ‘When asked if he was sleeping before she called him. Joshua woke up a litle bit before his alarm, he ‘was kind of watching the YouTube auto plaything, as he was fading back in and out of sleep before his alarm went off. When asked if they had any issues in the neighborhood, he said no. It should be noted that during my interview with Lynda Khoury, she never mentioned to me that she told Joshua there was a sniper. Detectives later spoke with neighbor, Julio Morales (008 5/27/87) who told them they also heard @ gunshot earlier in the week that sounded close and sounded like it came from the direction of the victim's residence. Joshua signed a waiver of search for his house at 8449 Topeka Circle, where it was observed that he had several firearms in the residence, to include a loaded revolver with an empty shell casing in the cylinder, consistent with the firearm being fired once, but not unloaded. The other casings in the cylinder contained live rounds. Also observed was a "Savage" bolt action rifle, chambered in 30-30, in a gun safe. V-RP.16.052621 PAGE 3 OF 8On December 28, 2023, an autopsy was done on James Khoury at the district twenty-two medical examiner's office in Port Charlotte. The medical examiner determined he was shot in the back and the projectile exited through his chest. The couse of death was listed as gunshot wound of chest perforating lung and heart and transecting spinal cord and aorta. The manner of death was listed as homicide, ‘This was consistent with James being shot while walking to his vehicle, The residence at the incident location had been checked but no bullet holes, or other signs of a projectile striking the home, were observed, This meant the shot likely did not come from the roadway, or the vacant lot across the street and possibly came from elther side of the residence. A search warrant was obtained for the wooded lot, located at 8424 Matecumbe Road, which is to the left of the incident location, and the wooded lot to the right of the incident location, located at 8448 Matecumibe Road, with the intention of searching for the projectile. On December 30th, the projectile was located in a large pine tree on £424 Matecumbe Road. This was consistent with the shooter being on the south side of the residence, the side that faces the detached structure on 8440 Matecumbe Road. The pathway Joshua would have taken to walk to the incident location is on this side of the residence, and he was also observed on body worn camera on this side of the residence when he arrived. search warrant was also obtained for Joshua's cellphone to confirm his story about Lynda calling him after the shooting. The results of the download confirmed Lynda had called Joshua, however the activity con his phone contradicted his story. Joshua's cell phone is an iPhone and provided his walking activity, which showed he had walked several hundred meters during the timeframe the shooting had taken place, which is consistent with a walk to the incident location and then back to his residence. There was also matching walking activity on Tuesday, which is within the same timeframe of the gunshot the victim hhad told Lynda that he had heard. The walking activity does not provide location information, only the ‘number of steps taken, and distance walked, It also showed the cell phone connected to audio devices, that were riamed "Ear dildos", during the time period the shooting took place. These devices are believed to be his Apple Air pods. On January 3, 2024, | brought the projectile to the Florida Department of Law Enforcement (FDLE) for examination. On January 4, 2024, | spoke with M. Alvarez, a Crime Laboratory Analyst with FOLE. She told him that based on its design features, the bullet is 30/7.62 caliber class and is consistent with bullets loaded in 30-30 Winchester caliber cartridges. The bullet displays rifling characteristics similar to rifles by Savage, Winchester, and Revelation, among others. ‘On January 4, 2024, Detective Lindsey and | spoke with Joshua Nareau at the Charlotte County Sherif's District One Office, located at 11054 Willmington Boulevard, Englewood, Florida. | read Joshua Miranda, and he provided 2 sworn recorded statement which is in summary and not verbatim. Post Miranda, ‘when asked ihe still had all the guns that he had. Joshua said yea, and nothing's changing. Joshua mentioned most of the guns in the house are his grandfathers. The .308, 30-30, the brown bolt action rifle, is his grandfathers. He mentioned it was a birthday gift one year, but it was still his. He satd both of the 22 pistols, and both of the 38's. The two .22 rifles are Joshua's, along with the .22 revolver, that does not fire. When talking about the gun shot residue, that he did the waiver for. Joshua mentioned that he had cleaned a gun about two days prior. Joshua said correct, and that he cleans a lot of his guns. When asked why. Joshua said he cleans them regularly, and that his grandfather taught him, you treat your {Buns respectfully, if they sit for too long, they will collect dust. You don’t want dust. Joshua sald 5:22 ifhe remembered correctly. | asked Joshua to walk me through his morning that day. He was lying in bed, he was awake, he had YouTube kind of just playing, he was in and out, kind of, the phone started ringing. He first thought it was his alarm, but it did not sound anything like it, he leaned over and saw Grammy. He explained in his phone that its Grammy L and Grampy J. His phone is ringing, it says Grammy L, he answers it, he got he has been shot, the police are here, help. Joshua went over and we know the story from there. When asked if he remembers what time he woke up, prior to that. Joshua said not really. He ‘woke up, the alarm was not on, the television was paused, and was asking if it should continue playing things. He explained YouTube has an auto plaything that it plays, after you don’t watch it for enough, it's like, hey, are you stil here. He woke up, that was stil on, he clicked the yes button, and watched what it ‘was trying to play. When asked if he wes just kind of hanging around in bed, Joshua said he was still in his underwear, just lying there, kind of curled in his blanket. He left the house once grandma called him. When asked if there was any reason that his phone woul tell us something different than what he was telling us, Joshua said no. Detective Lindsey explained it was telling us alittle different story. Detective Lindsey told Joshua on the 26". | provided Joshua a printout to look at. Detective Lindsey explained that his phone has something called an activity sensor, it's kind of a pedometer that’s built into your shone. ‘They're in the background; most people don’t even know they're on. Detective Lindsey explained on 12/26, the day the first shot was heard, at 4:38, 4:48. His phone is telling she walked 194 meters and 116 meters. That's a lot different than laying in bed. When asked if there is anything he could tell us about that, Joshua said no, sit. When asked if there was any reason his phone ‘would say that. Does anybody else use his phone in the morning. Joshua said no, he lives alone. Joshua confirmed he typically has his phone on him. When asked if he was at his grandfather's house, he said no. | explained to Joshua that the phone thing is really hanging me up. Joshua said he completely understood. He stated. "\'m not arguing the fact that that’s". lexplained | told him from day one my job is to check boxes. | explained this is a box I really got to check, and I just can't. Johsua said no, he understands, | told Joshua the only person who could tell me is. Joshua stated, "is me". | asked Joshua to help me explain that. Joshua stated. "I told you, | don’t know" On January 4th, a search warrant was served for Joshua's residence at 8449 Topeka Circle, and the Savage" bolt action rifle, and the corresponding ammunition were collected. On January Sth, | brought the rifle to FOLE for analysis. On January 10, FDLE contacted me and requested that | bring them the collected 30-30 ammunition for analysis as well (On Monday, January 8, 2024, Detective N. Wrasse, obtained e copy of the forensic download of an iPhone identified as belonging to Joshua. He opened the file in Cellebrite Reader and organized the data Using the timeline view option within the client. Detective Wrasse kept the download in native Coordinated Universal Time (UTC) Format, but for ease of reading will refer to the times using both UTC and the negative 5-hour conversion to Eastern Standard Time (EST), It should be noted that, corresponding with the above information, on Thursday, December 28, 2023, at approximately 0956 Hours UTC (0456 Hours EST), the device showed as using iPhone Network Data. ‘Additionally, the location data at the same time, showed that the device was no longer connected to the Wifi, and showed the device at a location of 26.905363 Latitude and -82.208046 Longitude which is INV-RP.16.052621 PAGE 5 OF 8within 8458 Topeka Circle, Port Charlotte, Charlotte County, Florida, directly across the street from Joshua's residence, with a Horizontal Precision of 26. This would be consistent with the device travelling into and through the path, adjacent to 8458 Topeka Circle that cuts through to the rear of the decedent's property. ‘On Thursday, December 28, 2023, at approximately 10:00 Hours UTC (05:00 Hours &5T) the location data showed the device was still no fonger connected to the WiFi and showed the device at a location of 26,905030 Latitude and -82.208405 Longitude which is to the rear of the decedent's shed outparcel, located at 8440 Matecumbe Road, Port Charlotte, Charlotte County, Florida, with a Horizontal Precision of approximately 69. From Thursday, December 28, 2023, at approximately 10:00 Hours UTC (05:00 Hours EST) through approximately 10:16 Hours UTC (05:16 Hours EST), there continues to be location data in the aforementioned area with Horizontal Precision locations of less than 100, as well as outlier location data in neighboring streets with Horizontal Precision locations of greater than 100 and into the 1000s: The device also shows a consistent connection to Spotify during that time frame, Also on Thursday, December 28, 2023, at approximately 20:00 Hours UTC (0500 Hours EST) there is Activity Sensor Data that shows a distance travelled of 568,02 (believed to be feet), with 2 max speed of 1.22 (believed to be MPH), and a second data set indicating a distance travelled of 272.73 (believed to be feet) and a max speed of 1.24 (believed to be MPH) for the preceding hour. For reference, the distance from the front of Joshua's residence to the right side of the decedent's residence, the direction the shot was determined to have come from, is approximately 440 Feet according to Google Maps. On Thursday, December 28, 2023, at approximately 10:17 Hours UTC (05:17 Hours €5T), just after the shooting, the device is shown connecting back to the Wireless Network at Joshua's residence, with a corresponding location data consistent with this connection. Spotify Is still active during this time. ‘The location data remains in the area of Joshua's residence, and the adjacent woods to the right of the residence, for the remainder of the duration leading up to Thursday, December 28, 2023, at approximately 1022 Hours UTC (0522 Hours EST) when Joshua receives a call from his grandmother to inform him that his grandfather has been shot. (On Thursday, December 28, 2023, at approximately 10:24 Hours UTC (05:24 Hours EST), the device is again seen near the trail that cuts through to the decedent's residence, at 26.905443 Latitude and - £82.208313 Longitude, to the rear of 8458 Topeka Circle, with a Horizontal Precision of 35. According to Joshua's statement to law enforcement, this is when he was cutting through the trail to go to his grandparent’s residence after receiving the phone call. It should be noted that the above referenced time frame is also when Joshua is physically observed by law enforcement on scene at the side of the residence. During the aforementioned timeframe, according to Joshua's statement and consistent with the cellular download, Joshua is making a phone call, at approximately 10:25 Hours UTC (05:25 Hours EST), to his mother. The device also shows an additional phone call at approximately 10:27 Hours UTC (05:27 Hours EST), to his grandmother. INV-RP.16052621 PAGE 6 OF 8On Thursday, December 28, 2023, at approximately 11:00 Hours UTC (06:00 Hours EST} there is Activity Sensor Data that shows a distance travelled of 568.02 (believed to be feet), with a max speed of 1.22 (believed to be MPH}, and a second data set indicating a distance travelled of 28.08 (belleved to be feet) and no max speed for the preceding hour. It should be noted that, according to Joshua's statement, during this time he received the phone call, left his residence, and walked over to the decedent's residence. Joshua was then subsequently placed into a patrol car and stationery for the remainder of ‘the hour. During Joshua's statements to law enforcement, he had specifically Indicated that he had set his alarm for 05:45 Hours EST but had woken up slightly earlier and was watching videos on YouTube, prior to and during the time of the shooting, before receiving a call from his grandmother. On Thursday, December 28, 2023, between approximately 06:34 Hours UTC (01:34 Hours EST) and 08:03 Hours UTC (03:03 Hours EST) the cell phone shows that the user was using various applications, to Include but not limited to, Discord, Spotify, text messages, and what is believed to be a workout application, MyLiftMaster. Biometrics data for this time period also showed that the user of the device expended energy, consistent with a workout during that time period. On Thursday, December 28, 2023, at 0945 Hours UTC (0445 Hours EST), a preset alarm went off on the device. The corresponding location data again showed that the device was connected to the residential Wifi at Joshua's residence and showed the device at that location. As a note, | later checked all the alarm data on the phone for the month of December, to determine if this was a regularly established alarm for work, and no other alarm data was present outside of alarms set significantly later in the PM hours. ‘On December 28, 2023, Detective Lindsey and Detective Morgan conducted a second interview with Joshua Nareau the Charlotte County Sherif's District One Office, located at 13054 Willmington Boulevard, Englewood, Florida, Post Miranda, a detective asked if the victim has, for a lack ofa better word, does he have a routine that he follows. Joshua sald he knows he told him he wakes up for work at 4:20, and he tries to be on the road by 5:30. Between that, he doesn’t know what he does, Joshua said he does know that he says he wants to be out of the house and on the road by 5:30, is all he knows. On February 14, 2024, | received a laboratory report from the Florida Department of Law Enforcement. ‘The results section listed projectile, item 1. The report stated the bullet was identified to the item 3 rifle. Item 3 Is the Savage 30-30 Winchester caliber bolt-action rifle, model 340AN, with no serial number and no areas of obliteration seen In the report identified states agreement of all discernible class characteristics end sufficient agreement of individual characteristics where the extent of agreement leads to the conclusion that the items were fired in/from the same firearm. Based on the above, there Is probable cause for the arrest of Joshua Nareau for second degree murder. Joshua Nareau did unlawfully and by an act imminently dangerous to another and evincing a depraved mind, regardless of human life, although without any premeditated design to effect the death of any particular individual, kill and murder James Khoury, a human being, by shooting him with a firearm.
