From 30 June(06) 1993, they started living seperatly due to lack of adjustment.

On 21st August(08) 1994, they file petition in City Civil Court, Ahmedabad for
divorce by mutual consent under section 13(B) of Hindu Marriage Act. The matter
was adjourned from time to time.

On 1 January 1996, the advocate off Rajesh submitted an application for taking up
the matter on board to expidite the same.

From 1st February 1996, Rajesh and Tina started living together as husband and
wife. Therefore a Criminal Case against Rajesh was filed by Dimple under section
494 of the Indian Penal Code. Other Civil Cases were also filed by Dimple for stay
order against probable disposal of properties by Rajesh.

On 27 th March(03) 1996, Dimple gave an application in City Civil Court revoking

her consent wherein the scope for re union was mentioned. The City Civil Court
dismissed the petition filed under section 13(B) on the ground that the mutuality

must continue till the decree of divorce.

The husband Rajesh Challenged it by filing an appeal before Gujarat High Court.
The single Judge allowed the petition of Rajesh and passed an order of divorce by
