INTRODUCTION
In Malaysian plural society, the Muslims
are very sensitive towards their faith and
beliefs especially when it concerns the
food that they take and the issue of halal
and haram.
In this sense, food and consumer
products are contributing factor towards
the unity or disunity in the society of
multi-racial, religious and cultural
background. Therefore, it is important to
have products that can be consumed by
all religious believers. Halal products fit
into human needs as it encompassed
standards that match the demand and
needs of everyone.

The word halal is commonly used to refer to ‘anything


that is considered permissible and lawful under
religion.’ Linguistically, the word halal is derived from
the verb “Halla” meaning “to be or become lawful,
legal, licit, legitimate, permissible, permitted, allowable,
allowed, admissible, un-prohibited, unforbidden.

The Constitutional
Perspectives of Halal
The issue on Halal intersects with constitutional dimension in
two ways, firstly, in relations to fundamental rights of a
person and secondly, the administration of halal affairs.
Relevant constitutional principles will be highlighted in this
part to illustrate on the position of halal in regards of enjoying

one fundamental right and in the administrative field.

Labelling and advertising shall not
contravene the principles of Shariah law
and shall not highlight indecency which
contradicts the Shariah law;
The Malaysia Halal Logo cannot be used on
promotional products in conjunction with
non-Islamic religious festivals or together
with non-Islamic religious emblem;
Name of product does not use the word
‘Halal’ and names with elements of religion
and god;

Conditions on Use
of the Certificate
1. Use of the Malaysia Halal Certificate is subject to
conditions which have been specified for the
certificate;
2. The Malaysia Halal Certificate holder shall be
responsible on any abuse or misuse of the certificate
subject to the laws and regulations;
3. The Malaysia Halal Certificate can be withdrawn or
terminated at any time and use of the halal logo is not
allowed if the applicant is found to violate the Malaysia
Halal Certification standard;
4. The Malaysia Halal Certificate cannot be traded,
leased, exchanged, forged, abused, or amended its
content in whatever form; and
5. The original and valid Malaysia Halal Certificate shall be
displayed at all times at the address stated on the
certificate.

Case Study: Illegal Labeling and The Abuse of Halal Certificate

Issues on Halal
JAKIM introduced their authorized halal logo, it had spawned more awareness
among the Muslims. That accelerated the Muslim consumers to consume halal
products or engage in services thatfollow Shariah guidelines and principles. The
Certified Labelling halal logo also certifies food outlets which are permissible to be occupied by
Muslims. The purpose of this certification is to indicate that their products meet
the Shariah requirements. This indirectly creates noteworthy benefits to the
particular manufacturers that have halal labeling certification as opposed to
their opponents that do not own halal certification.
Halal food demands are rising although the consumers are being cheated with
non–halal products and in the wrong labeling of the products which raise the
sensitivity of Muslims in this country. However, it is not easy to investigate the
product once the food is packed. As a result, the Muslims depend on the
responsible authority to check the status of halal and harmful
products.Nevertheless, holding the halal certificate in Malaysia is a voluntary
act that creates some problems with illegitimate and unlawful use of the halal
logo and halal certificate. That action impinges on the sensitivity of Muslim
consumers in Malaysia and therefore, they may hesitate to buy or have doubt in
selecting food and other goods for their consumption.
