COMPROMISE AGREEMENT

THE PLAINTIFF AND THE DEFENDANTS, with the


assistance of their respective counsels, most respectfully submit this
compromise agreement:

1. That the property subject of the instant suit is designated


as Lot No. 11646-E situated at the corner of Riel corner MacArthur
Streets, Brgy. Guindapunan West, Carigara, Leyte, with an area of
269 square meters, more or less;

2. That defendant Arwynn Ramos Apilado shall, at his own


expense, vacate and/or demolish the improvements on the portion of
Lot No. 11646-E he is presently occupying within a period of eight
(8) months from execution of this agreement;

3. That herein plaintiff allows Lota Dacallos Ramos a


reasonable period within which to vacate and/or demolish the
improvements on the portion of Lot No. 11646-E she is presently
occupying, at her own expense, but not to exceed two (2) years from
execution of this agreement;

4. That both parties undertake to mutually assist in
requesting the surviving children of the late Gilda Raagas-Pascual
namely: Mylene Pascual-Balais, Marnie Pascual, Marigil Pascual
Ligan, and Mabel Pascual, who are all residents of MacArthur Street,
Brgy. Guindapunan West, Carigara, Leyte, to fully vacate and
surrender possession of the portion of Lot No. 11646-D (equivalent to
the share of Samuel Pascual) which their house is encroaching;

4. That both parties hereby waive their respective claims for


all types damages and attorney’s fees against each other;

PRAYER

WHEREFORE, foregoing premises considered, it is most


respectfully prayed of this Honorable Court that the instant
Compromise Agreement be NOTED and APPROVED.

Such other reliefs as may be deemed just and equitable under


the premises are likewise prayed for.
