Heard.

Issue notice to the respondents on payment of P.F. within

one week. Notices be made returnable within three weeks.

In addition, a copy of petition along with annexures be

supplied in the office of learned Advocate General within a week,

so that the appearance may be made on behalf of Respondent

No.1 & 2.

In view of statement made by learned counsel for the

petitioner that Mr. Ashish Sharma Upadhayay, Advocate who

usually represents Respondent No.3 as a standing counsel, a copy

of petition along with annexures be also supplied to him within a

week.

Taking into consideration that the validity of the provisions

has already been challenged by filing the D.B. Civil Writ Petition

No. 932/2023 in the case of Sunil Sharma Versus State of

Rajasthan before the Principal Seat at Jodhpur, wherein, Co-

ordinate Bench of this Court has entertained the writ petition and

passed an order on 30.01.2023 and also the order dated

24.02.2023 passed in the case of Dr. Murtaza Ali Saloda Versus

State of Rjasthan & Others, D.B. Civil Writ Petition No. 3106/2023,

we are inclined to pass interim order while reserving the right of

the respondents to move application for stay vacation, if required.

It is directed that till the next date of hearing, the petitioners who

have not so far superannuated from their post shall continue to

serve the College in the present capacity/position on which they

are working as on the date.

List this case on 26.02.2024.
