PETITION:
MONUMENTAL FRAUD, EMBEZZLEMENT, ABUSE OF OFFICE AND
MALADMINISTRATION IN FEDERAL NEURO-PSYCHIATRIC HOSPITAL, USELU,
BENIN CITY. AN APPEAL TO INVESTIGATE
THE MEDICAL DIRECTOR, DR. IMAFIDON OSAMA AGBONILE

Introduction

We wish to congratulate Your Excellency, on your well-deserved victory

at the 2023 presidential polls and your ascension to the exalted office of
President, Commander-in-Chief of the Armed Forces, Federal Republic of
Nigerian and the affirmation of your victory both at the Presidential Election
Petitions Court (PEPC) as well as the Supreme Court of Nigeria.

We write this petition based on the mantra of the Renewed Hope

Agenda of your administration which is anti-corruption and with the hope that
your administration will take drastic measures to curb this menace. Without
this fight, we dare say, Your Excellency, government scarce resources will not
be available for the benefit of majority but embezzled by a few very corrupt,
unpatriotic and self-centred Nigerians.

One sector where corruption has continued unabated but on a

geometric rise is the health sector. Unfortunately, monumental corruption and
bare-faced embezzlement has grown to monstrous proportion in Federal
Neuro-Psychiatric Hospital, Uselu, Benin City, Edo State. The appointment of
the current Medical Director, Dr. Imafidon Osama Agbonile, has marked and
unprecedented, corrupt, mindless and barefaced expropriation of federal
government funds as never experienced in the annals of the hospital.

Below is a litany of the fraudulent practices and embezzlement

perpetrated by Dr. Imafidon Osama Agbonile, Medical Director, Federal Neuro-
Psychiatric Hospital, Uselu, Benin City, Edo State.

1.0 FRAUDULENT PRACTICES AND EMBEZZLEMENT OF COVID-19 PROJECTS

FUNDS

The hospital was given over N950m for COVID-19 projects in 2021. The
Medical Director did not only mismanage the huge funds, but diverted over
N280m for his personal use, using his proxy contractors such as: Zetron Nigeria
Limited, Agibo, to mention a few through over invoicing. Please find enclosed
herewith a letter from the Bureau of Public Procurement (BPP) to validate the
issue of fraudulent practices and embezzlement of Covid-19 projects funds to
buttress this. As you would see from the letter from BPP, (Annexure 1), the
listed companies where used as a front to siphon funds from government
coffers. You may further investigate this matter at the BPP to confirm the
authenticity of this matter.
Even BPP has written letter to these companies requesting them to refund over
N150m back to federal government coffers, following their due diligence that
the hospital and its contractors over inflated their prices to defraud the federal
government. As at the time of writing this petition Sir, these funds are yet to
be paid back to government treasury.

2.0 EMBEZZLEMENT OF OUT SOURCED CONTRACTED SERVICES FUND IN

THE HOSPITAL

It will interest Your Excellency to know that monies were budgeted and
released for outsourced contractors in 2022 and 2023 for security and cleaning
services in the hospital. Observation on ground show no outsourced staff in
the entire hospital, yet federal government had continued to release funds for
payment of these services for which no body was engaged. The question
therefore is: who are the faceless persons being paid for these services?

This seems a monumental fraud. Dr. Agbonile should be made to

account for all the monies released so far under this sub-head in the past two
years. He should provide the names of the people performing the outsource
services. He should provide their bank details including their BVN.
3.0 PATCHING OF ADMIN BLOCK ROOF TO SIPHON FUND

Dr. Imafidon Osama Agbonile, claimed that he used the sum of N20m to
patch the leaking roof of the Administrative Block when he awarded the
contract to one of the phony companies he uses to siphon government
revenue. This claim is not only outrageous but absurd considering the fact that
the Administrative Block building in question by valuation may not be up to
N10m, to reroof the entire building. This matter should be fully investigated
and all those involved in shortchanging the federal government should be
brought to book.

4.0 OPERATION OF THE DRUG REVOLVING FUND (DRF)

The purpose of the Drug Revolving Fund (DRF) is to ensure availability

and affordability of drugs in the hospital. Sadly, the Medical Director has run
the DRF aground without the input of the Director and head of Pharmaceutical
Services, Pharm. Mary Ibhawoh. The Hospital drugs are exhorbitant and
beyond the reach of patients who are unable to afford drugs in the hospital.
Additionally, the hospital is currently plagued with out of stock syndrome due
to his managerial ineptitude. This petition therefore seeks a thorough
investigation and probe of the DRF fund in the hospital, in order to unravel the
reason(s) why hospital drugs are unaffordable by patients.

5.0 USE OF COMPANY OWNED BY THE MEDICAL DIRECTOR AND CRONIES

COMPANY TO SIPHON MONEY FROM THE HOSPITAL

It is a known fact that the under listed companies are associated to Dr.
Imafidon Osama Agbonile and as such they are the only ones doing all the
phantom contract works and supply in the hospital. Top on the lists are:

1. Greatmiko Integrated Services Limited: UBA, 1023989046 (which he

registered in 2021, few months after he was appointed)
2. Omonic Nigeria Limited: Zenith Bank, 1218063199
3. Chain link Nigeria limited: Access Bank, 138219188
4. Zethron Davis Nigeria Limited: Unity Bank, 0030779910
 5. Agibo Integrated Services Limited: Unity Bank, 0046148597.

These companies should be investigated for fraud and those found liable
to be made accountable.

6.0 USE OF GOVERNMENT FUND TO EMBARK ON IRRELEVANT AND

FRIVOLOUS FOREIGN TRIPS

The Medical Director within the last one year has been embarking on
frivolous foreign trips for jamboree at the expense of the scare resources of
the hospital. These trips are unbudgeted for, irrelevant and has no bearing
whatsoever to enhancing mental health care or improving the hospital
revenue. Rather, he uses such trips to line his pockets and satisfy his greed. He
is unduly wasting government funds.

7.0 PAYMENT OF MONIES ABOVE STIPULATED THRESHOLD INTO

PROCUREMENT OFFICER’S ACCOUNT

In gross violation of extant Financial Regulations (FR) and because of the

Medical Director’s penchant for corruption, Dr. Imafidon authorized the
payment of over N68m into the personal account of a serving Procurement
Officer (Mr. Frank Osueni with bank details: Polaris Bank, 1762123940).
These payments were ‘purported’ jobs done in the hospital which, in
fact, were never executed at all, in a bid to defraud the hospital.

8.0 SEXUAL HARRASSMENT AND INTIMIDATION

Dr. Agbonile has serially violated the Public Service Rules (PSR) on sexual
harassment and intimidation. He has continued to induce and molest female
staff sexually, especially the married women. Those who refuse his sexual
advances he puts in his black book for punishment. Such female staff will not
be sponsored for any training, posted to areas perceived to be “punishment”
zone and denied promotion. Unfortunately, because of fear of retribution,
these ladies will not want their names in print and also for privacy purposes.
Names may be released on request.
9.0 RUNNING THE HOSPITAL WITH HIGH HANDEDNESS AND ARROGANCE

The Medical Director, Dr. Agbonile has continuously boasted to all and
sundry at different foras with staff that he bought this position and paid for it
and as such, will run the hospital as it best suits him. He has also started
boasting that his quest for second tenure is fait accompli as he has everyone at
the Federal Ministry of Health and even the Presidency under his belt. His
arrogance is second to none as he does not welcome inputs from
Departmental Heads. He has made all the Heads of Department and Units to
be in acting capacity in perpetuity in gross violation of extant rule. Whereas,
when he was the Head of Clinical Services, it was never in acting capacity.

Most heads of Department and Unit have been in acting capacity for
over three (3) years clearly against extant rules. Any acting appointment ought
not to exceed six (6) months. This again, shows his administrative inefficiency.
He is not amenable to advice and even at that, would refuse to heed any
advice given to him in line with extant rules, regulations and circulars.

10.0 COLLECTION OF FEDERAL GOVERNMENT REVENUE THROUGH REMITA

It is regrettable that Dr. Agbonile has turned collection of Federal

Government revenue into a racketeering scheme. He has single handedly hiked
the commission payable on collection from 2.5% which is the general rates by
all FG collecting agents in Nigeria to a whopping 7.5%. What has been
happening to the extra 5% inflated rate as mentioned above?

11.0 PRAYERS

I. That the COVID-19 projects should be investigated vis-à-vis the letters

asking the contractors to refund over N150m and that such money are
promptly refunded back to treasury and all those found culpable should
be prosecuted forthwith.

ii. That the out sourced contracts should be fully investigated. The
Administrative Department should provide the staff list of the outsource
contractor for 2022 and 2023 which should include the names, BVN and
NIN as well as the job completion certificate issued for each month. That
Nursing Services Department should also provide the monthly clearance
list of outsource cleaners deployed to the various wards. That the
 company awarded the outsource services contract should provide the
following:
A. Copy of registration certificate of the security outfit with the Nigeria
Security and Civil Defence Corps (NSCDC).
B. List of staff working at the hospital and their distribution.
C. Payroll of outsource staff.
D. Bank statements of the company to confirm receipts and payments
for outsource services.
E. The total amount received for outsource and how such payments
were expended from March 2021 to December 2023.
iii. That the Heads of Accounts, Administration, Procurement and Stores
should be investigated and prosecute if found culpable for their
individual and collective roles in empowering Dr. Agbonile to embezzle
federal government funds.

iv. The DRF Account should be fully investigated to ascertain that only drugs
related receipts and payments were carried out.

v. That the contracts awarded and payments made to:

1. Greatmiko Integrated Limited, UBA, Account No. 1023989046
2. Omonic, Zenith Bank, Account No. 1218063199; and
3. Chain Link, including their accounts be investigated and suspicious
payment(s) should be recovered and paid back to treasury.
vi. That the Heads of Department and Unit currently on acting appointment
should be discretely interviewed to confirm the allegation of being on
acting appointment for over six months

vii. That Mr. Frank Osueni should be investigated for all official monies paid
to his account to confirm violation of the Procurement Act and how the
monies were dissipated.

viii. That the BVN of the Medical Director should be obtained to scrutinize
monies paid to his various accounts and to ascertain its source(s).

ix. That Dr. Imafidion Agbonile, should be made to refund estacode on all
illegal travels including all other associated trips, as these trips were
personal but couched as official.
x. That Dr. Agbonile should proceed on compulsory leave so that
investigations can commence and to safeguard relevant
documentations.
