I, _______________________ (owner’s name), of legal age, with address at

___________________________ (address), hereby state:

1. I understand and fully acknowledge that the Mckinley Hill Village Homeowners’
Association Inc. (“MKHVA”) regularly trims all the trees growing on the sidewalks of the
Mckinley Hill Village and hauls all the trimmings after the tree trimming activity is completed,
at no cost to the landowners, and that this service includes the trees surrounding my own
lot.

2. I also acknowledge that this activity is to maintain the cleanliness of our streets, and is also
necessary to prevent any potential damage to property and injury to persons which may
result from falling branches and/or other parts of the trees.

3. I recognize and acknowledge MKHVA’s ownership of the sidewalks where trees currently
grow, including the trees in front of my residence.

4. Despite the aforementioned, I do not agree to have MKHVA trim the tree/s on the
sidewalk in front of my residence, and am refusing that such services be conducted on
any of the sidewalks in front of my own residence/lot.

5. I waive any claims against MKHVA, its related entities, or any of its Board Members,
officers, employees, personnel, or members, and any of the officers, employees, or staff
members of its Property Management Office, for injury to any person or damage to any part
of my property which may arise due to the untrimmed trees in front of my residence.

6. I further agree that I will be liable or responsible for any damage to any property and
injury to persons, including those which may result in death, which the untrimmed tree/s
may cause in the event of any untoward accident, natural disaster or inclement weather.
7. I also hold MKHVA, its related entities, or any of its Board Members, officers, employees,
personnel, or members, and any of the officers, employees, or staff members of its Property
Management Office free and harmless from any costs, suits or actions which may be brought
by any person as a result of damage or injury suffered as a result of my refusal to have the
trees fronting my residence trimmed by MKHVA, and agree to indemnify MKHVA, its
Governors, officers and employees, or those of its Property Management Office, for any cost
or award which they may be adjudged to pay, including interests and costs of the suit.

8. Finally, I confirm that I have no cause of action against MKHVA or against any person/s
connected with MKHVA and forever release the latter from any and all liability related to this
matter.
