Dear Judge Weaver,
I hope this letter finds you well. I am writing to respectfully request your attention to a matter concerning a landlord-tenant dispute currently before the court. I am the tenant in question, and I am submitting this Order to Show Cause (OSC) in response to the proceedings initiated by my landlord.
Background: I entered into a lease agreement with Avalon Wharton on 02/07/2020 as
provided in Annexure A. Throughout the duration of my tenancy, I have made diligent efforts to fulfill my obligations under the lease agreement, including timely payment of rent.
Current Situation: I am currently facing eviction proceedings initiated by my landlord,
alleging non-payment of rent for the month of January and February 2024. However, I wish to bring to the court's attention that I have made multiple attempts to submit payment for both January and February rent. Attempted Payments: January Rent: On [Date], I submitted a rent payment for the month of January via [Payment Method]. However, my landlord only partially accepted the payment and has not cashed the remainder. I have made subsequent attempts to rectify this by offering alternative payment methods, including money orders and checks, all of which have been refused by the landlord. February Rent: Similarly, I delivered the rent payment for February to the landlord's designated mailbox on [Date], well in advance of the due date. Despite my efforts, the landlord has not cashed this payment, adding to the confusion surrounding the alleged non- payment. Resolution of Arrears: It is crucial to note that I am not in arrears regarding my rent obligations. In fact, I have maintained meticulous records demonstrating that I am paid in full, with evidence of overpayment in [specify the year]. Furthermore, I have previously been granted rental assistance by the Department of Community Affairs (DCA), which was applied towards my rental arrears, as acknowledged by the court. Relief Requested: In light of the foregoing, I respectfully request the following relief from the court: 1. A stay of eviction proceedings pending resolution of this matter. 2. Clarification from the landlord regarding acceptance of rent payments and confirmation of my current rent status. 3. Any other relief deemed just and equitable by the court. I thank the court for considering this matter and respectfully request a prompt hearing on this Order to Show Cause. I am committed to resolving this dispute in good faith and in accordance with the law. Please find enclosed any relevant documentation supporting my claims. Should the court require any further information or clarification, I am readily available to provide it. Thank you for your attention to this matter.
