Sir
The complainant submits as under: -
1. That no such or similar complaint on the same cause of action has
been filed or is pending between the parties, before this Hon’ble
Commission or any other competent Court of Law having
jurisdiction over the matter.
2. That the complainant is fond of having unique VIP Mobile Numbers,
and is subscriber of Bharti Airtel Limited from last so many years.
3. That in July 2022, complainant came in contact with Mr. Deepak
Mandet and purchased a number “99333-33332” from him by
making online payment of Rs.3,44,000/- in various installments
on 26.07.2022 and 30.07.2022.
4. That complainant being a satisfied customer of the services
provided by the company had immediately applied for port of the
purchased number from Vodafone to Airtel.
5. That the complainant was already using the other mobile number
(76000-00003) in his daily use and was making recharge of the
number in dispute from time to time, despite the fact that same
was not being used by him.
6. That in November 2022, complainant decided to start using the
newly purchased mobile number and noticed that the SIM was
not working. Complainant immediately approached the local
office at Karnal. Complainant was assured by the local office of
opposite parties to activate the mobile number in a short time
span but was not done and a written complaint was sent to
respondents on 06.01.2023 and was also followed up on regular
intervals.
7. That on 23.01.2023 complainant received a mail from opposite
party of assurance to get the issue of activation of SIM resolved
in short span yet there is no proper response till date.
8. That the respondents are well aware of the market value of the
number to be in lakhs of rupees as they are themselves selling
such kinds of numbers after charging huge premium.
9. That deactivation of SIM and illegally retaining the same with the
respondent amounts to obtaining wrongful gain to the
respondents and wrongful loss to the complainants.
10. That the Complainant is permanent resident of Karnal and he has
purchased the aforesaid SIM bearing Mobile No.99333-33332 at
Karnal and the office of the opposite parties is situated at Karnal,
hence this Hon’ble Commission has got the jurisdiction to
entertain and try the present complaint.
It is therefore, prayed that the opposite parties may kindly be
directed to immediately activate the mobile number mentioned above
and retore all the services associated with the activation of mobile
number including voice, SMS and data services or in the alternative
issue some other SIM with similar kind of VIP number with immediate
activation. The opposite parties be further directed to make the
payment of Rs.50,000/- as compensation for the damages Incurred
and further pay Rs. 25,000/- as litigation expenses.
Any other relief/reliefs to which this Hon’ble Commission deems
fit and proper, may also be granted to the complainant.
