LEGAL DOC FROM BANSARI

Xiaomi technology India Pvt. Ltd is the 1st other
party here which advertises it's brand in broad scale
on media and other advertising channels including
Newspapers, TV, Magazines, Hoardings and their
army of sales people and distributors. They imply
that their phone is inferior to no one. And that their
technology is world class, good battery, latest
features, and there is no complaints coming across
what so ever. Also that if ever there is a minor
complain, they have protection of 1 year warranty
period to do free of charge service.
Here in, party no.4 here being Amazon, phone was
purchased through it and delivered by Bhavnagar
service centre of red me authorised service centre.
Details of the purchased phone:
Date of purchase: 26/07/2021, Invoice no. SIDA
58859, Model: Red me note10 pro 6/128, price
paid: 17999/-, The order was delivered to
Bhavnagar through party 1 on 28/07/2021
4. We noticed that only after two days of usage
phone started hanging frequently, call sensors
weren't working properly and phone data was
disappearing without any apparent reason.
Subsequently, we contacted Manager, Harsiddhi
InfoTech, red me authorised dealer with the
complaint who is party no. 2 here. Well, they
repaired the phone once but phone hanging, data
disappearing and weak call sensors persisted, the
second time we contacted party no 2. We come to
know that here was the case of unfair trade
practice. Knowingly we were sold a manufacturing
defect phone, also while we were totally in condition
to replace the phone due to warranty period they
did not replaced our phone.
The other party is issued a legal notice in this case
through our advocate, however we did not get any
response from them, they have neighther replaced
our phone nor they have returned our money,
hence as a last resort we were forced to complain
and take legal action.
Hence, the central cause of this legal issue was
happened under your district commission, other
party is bound and responsible to provide
necessary Services subsequent to the purchase of
mobile, we request you herein to bring the case to
justice .
7. We have furnished all related proofs and
documents and we announce them to be original
and true.
Reason being all above, we request you to:
A. Approve our application to announce the other
parties responsible individually and collectively.
Also pls grant us payment of 17999/- with 18%
interest since the purchase date 26/07/2021
B. This legal application was a forceful in nature for
us and that too due to extreme carelessness of
other party so pls provide us the charges for
application that is Rs.15000/-
C. Despite spending full amount we can not use
our mobile, and due to negligence and careless
behaviour we have faced mental trauma in this
case, kindly order them to pay Rs. 10,000 as

compensation.
