1. That I have purchased a Redmi Note 7 Pro Mobile IMEI No. 861646041825397 through
Flipkart on dated 04/01/2023 against Invoice of SB TRADERS, Invoice No.
FAES9R2300010538, Order ID: OD426965550805082100.

2. That in August-23, I got problem in my phone and went to Mi Care for solution. Mi Care
checked IMEI number of my phone to make Job Card. They told me this phone is out of
warranty. They told me IMEI number of this phone is activated on 27/05/2019 and
replacement has been made for this serial number, unable to apply after - sale service. They
provided me screen shot of activation date.

3. That after I contacted with Flipkart Support and informed conversation of Mi Care visit. But
Flipkart team told me that phone is under warranty and Mi will provide solution for this.

4. That after again I visited to Mi care. Mi care checked again IMEI number and told me that this
phone is refurbished and out of warranty and activation date of this IMEI number is
27/05/2019 and replacement has been made for this serial number, unable to apply after-
sales service. I asked to Mi care for Job Card, but they told me Job Card cannot be generated
and suggested to go to Flipkart.

5. That after I contacted with Flipkart Support and informed conversation of Mi Care visit. But
Flipkart team told me to ask the deny letter from Mi Care if they cannot provide Job Card.
6. That after again I visited to Mi care and asked for deny letter. Mi Care told me that they are
not denying for service and they confirmed this IMEI number is out of warranty and already
activated on 27/05/2019. They shown me again same screen shot of activation date which
they shown earlier.

7. That after I contacted both parties through phone call, conference call and through mail. But
no any solution received from both of them. Both parties are blaming each other. I informed
both the parties that I will go for legal action against them.

8. That after I applied to consumer help line on dated 27.09.23, Grievance number 4969317.

9. That after on dated 27.09.23 grievance status shown closed by Flipkart & I received a call
from Mi official on dated 28.09.23 to get RWR (return without repair) sheet from Mi Care.
NCH status of grievance shown Dispose Off on 21.10.23.

10. That after I visited again to Mi Care for RWR Sheet. But same issue observed for login and
same reply received from Mi Care that IMEI number is out of warranty and already activated
on 27/05/2019.

11. That after again I applied to consumer help line on dated 04.10.23. Grievance number
4993802.

12. That after on dated 05.10.23 again status shown closed by Flipkart and on dated 10.11.23
status shown Dispose Off.

PRAYER:

In the light of above statement, forum is prayed to make direction to opposite party, for :

 Replacement of New Mobile Phone against refurbished phone or refund of money taken for
the refurbished phone.
 Pay compensation for causing mental harassment and agony to the complaint the sum of Rs.
180000/-
 Pay cost of litigation to the sum of Rs. 750/-
