Sir/Madam,

Under the instructions, information and documents furnished by my client, Shri. Ravindra S/o
Parashram Desai, House No. 509, Ground Floor, Durga Niwas, Saraswati Nagar, Ganeshpur, Belagavi-
591108, and the Proprietor for TRACKSMART stationed at above address, on his behalf am issuing this
Legal Notice to you as under,

1) That my client runs the business of GPS Tracking for his clients in Belgaum since the last 3 years
and was in good business with you for the purpose of accruing sim cards for the tracking
devices.

2) My client as per regular requirements had requested yourself to change the Airtel data tariff
plan of sim cards inserted in the DMG enlisted devices. You were already made aware of the
requirement on the 29 th May 2020 & reminded on the 26 th June 2020. You may have obliged and
done the needful but for 29 Sim Cards you assured to change the plan and raised the invoice
bearing No. INV-000098 dt: 27/11/20 for the amount of Rs. 28,800.02 which was paid in full vide
receipt bearing No. Payment-91 dt: 02/12/20.

3) However, on the 19th Jan 2021 my client faced some issues with the devices enlisted to DMG
and found through reliable sources that the data plan which had to be extended to M2ML 2G
500 MB, 200 SMS-INR75 PM AR Radio: 2G was not changed and remained as in normal plan of
M2ML 2G 120 MB, 200 SMS-INR35 PM AR Radio: 2G.

4) You were informed on phone and WhatsApp about the issue and were requested to enhance
the tariff plan as proposed. My client did wait for some days and again requested you to resolve
the issue in writing on the 25th Jan 2021 via Gmail to your email id. You failed to change the tariff
plan nor supported my client in this crisis as my client had already inserted the sim cards in
vehicles and had to bear a lot of inconvenience since his customers were suffering for not
getting the desired results. You did not serve the required data plan nor clarified your obstacles
 in doing so which resulted in exchange of emails and on the 10 th Feb 2021, you have played a
mischief by sending manipulated data plan of M2ML 2G 500 MB, 200 SMS-INR75 PM AR Radio:
2G which is incorrect and my client does have documentary evidence against your manipulation.
Thus, playing a fraud on my client’s part which therefore confirms that the amount of Rs.
28,800.02. is simple extraction which goes against the law.

5) My client replied to your email stating that the details served are inappropriate for which you
did not pay heed and just to divert my client’s attention you starting playing a new fraud of
threatening to pay the sim card charges for the normal plan of 193 sims prior to the payment
date. The Airtel sim card were on a Post-paid tariff which means that my client rightfully could
pay the amount by the end of the month or on generation of bills. But you threatened to make
my client pay the amount in advance or you shall shut them down just to generate extra
financial aid. Likewise, on the 15th Feb 2021 you deactivated the services of the 193 sim cards.

6) On such an occurrence my client faced unwanted calls from his clients stating that the GPS was
not working. My client being a reputed business person had to reinvest in 193 sim cards to be
bought from other vendors and reinstall the sim cards in vehicles as and when and where they
may be available. Thus, my client had to bear excessive loss of Rs. 350/- @ sim card which as of
now is liable for payments from you for all the 193 sim cards which were deactivated by you.
Pressurising, harassing and forcefully making people to pay the amount are an offence which
you have committed.

7) My client has faced huge monitory loss and mental harassment due to your nature of doing
business. My client has also lost customers who had faith in his business which you have ruined
by providing manipulated data in the first hand and then harassing to make payments in
advance for which you deactivated his services.

8) You no 2 have been served with this notice since the company IT SYSTEM
LOGICS is being owned by you and you have a branch office in Kolhapur.
However, we are making you aware of this fact that such fraudulent acts have
occurred by utilizing your profile by no 1,

which is against the law, and since you being the owner are answerable to this
notice also issued herewith for the act of the No 1 as specified in supra.

It is through this Legal Notice that I hereby on behalf of my client, request you both are
liable to reimburse the amount of Rs. 28,800.02/- (refer para 2) and also Rs. 67,550/- (refer para
6) which amounts to Rs. 96,350/- in total, immediately to my client’s account, within 15 days
from the date of receipt of this Legal Notice.

Failing to which my client is advised to take necessary legal action in proper court of law
and also you both will have to compensate my client of Rs. 25,000/- for mental harassment,
monitory loss and loss of customers due to you. Which please note?

And also please note that, the cost of this legal notice is Rs. 10,000/- which you both are
liable to pay to my client including the above compensation and with the total amount as
mentioned above para.
