1. If the bidder is a Micro or Small Enterprise as per latest definitions under MSME rules, the bidder shall be
exempted from the requirement of "Bidder Turnover" criteria and "Experience Criteria" subject to meeting of
quality and technical specifications. If the bidder is OEM of the offered products, it would be exempted from the

"OEM Average Turnover" criteria also subject to meeting of quality and technical specifications. In case any
bidder is seeking exemption from Turnover / Experience Criteria, the supporting documents to prove his eligibility
for exemption must be uploaded for evaluation by the buyer.
2. If the bidder is a Startup, the bidder shall be exempted from the requirement of "Bidder Turnover" criteria and
"Experience Criteria" subject to their meeting of quality and technical specifications. If the bidder is OEM of the
offered products, it would be exempted from the "OEM Average Turnover" criteria also subject to meeting of
quality and technical specifications. In case any bidder is seeking exemption from Turnover / Experience Criteria,
the supporting documents to prove his eligibility for exemption must be uploaded for evaluation by the buyer.
3. The minimum average annual financial turnover of the bidder during the last three years, ending on 31st
March of the previous financial year, should be as indicated above in the bid document. Documentary evidence in
the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant /
Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the
date of constitution / incorporation of the bidder is less than 3-year-old, the average turnover in respect of the
completed financial years after the date of constitution shall be taken into account for this criteria.
4. Years of Past Experience required: The bidder must have experience for number of years as indicated above in
bid document (ending month of March prior to the bid opening) of providing similar type of services to any
Central / State Govt Organization / PSU / Public Listed Company. Copies of relevant contracts / orders to be
uploaded along with bid in support of having provided services during each of the Financial year.
5. Estimated Bid Value indicated above is being declared solely for the purpose of guidance on EMD amount and
for determining the Eligibility Criteria related to Turn Over, Past Performance and Project / Past Experience etc.
This has no relevance or bearing on the price to be quoted by the bidders and is also not going to have any
impact on bid participation. Also this is not going to be used as a criteria in determining reasonableness of
quoted prices which would be determined by the buyer based on its own assessment of reasonableness and
based on competitive prices received in Bid / RA process.
6. Short Duration Bid has been published by the Buyer with the approval of the Competent authority due to
Emergency procurement of critical products/services.

Section 9(3) Of GST/जीएसट क धारा 9(3)।

Where ever RCM is applicable, sellers (Regular GST registered seller who opted out of FCM , unregistered seller,
seller registered under composition scheme)will be forced to put Zero GST and GST cess in their bids. Buyer will
have liability of paying the GST and GST cess to the government on the specified rate mentioned by them in this
Bid.

OPTION CLAUSE: The buyer can increase or decrease the contract quantity or contract duration up to 25
percent at the time of issue of the contract. However, once the contract is issued, contract quantity or
contract duration can only be increased up to 25 percent. Bidders are bound to accept the revised
quantity or duration

Sub: TERMS AND CONDITIONS for hiring of four-wheel vehicles through GEM porta
l on ‘as and when required’ basis for official use in QCA Project of PWD & WRD in
State of Goa.

Ref: Approval from competent authority vide File No. HW-CS09017(TECH)/18/ 2023-HW
C-RITES LIMITED (Computer No. 46768 ), dated 16.11.2023

With reference to above approval from Competent Authority, theprocess for hiring of fo
ur-wheel vehicles on ‘as and when required’ basis for official use of this Project
Office may be initiated through GEM portal, as per the following terms and conditions
:

1. A total of upto 06 (Six) vehicles may be required on any day on‘as and when r
equired basis’ depending on RITES office work-load. Someday no vehicle may be req
uired at all.

2. The vehicle supply period will be One Year starting from 10th December 2023 t
o 09th December 2024.

3. The type of vehicle shall beSwift Dzire and above type with A/C.

4. The vehicles shall not be older than four years i.e. before 01.01.2019. Copies
of RC book, Road tax and fitness certificate, etc., from statutory authorities along with insu
rance policies etc needs to be produced.

5. The vehicles are required to move/run anywhere within the State of Goa.

6. Daily Rate: Daily rate (excluding GST) shall be quoted for running up to 10
0 kms with A/C. Daily rate shall be inclusive of cost of CNG/Petrol/Diesel, cost of repairs
& maintenance, insurance, all inputs, cost of fuel, road taxes, ferry charges, driver’s wages
, etc.

7. Extra Km: Extra km charges will be paid Rs.20/- per extra km to successfu
l bidder for vehicles usage beyond 100 km per day.

8. Duty Hours: Timing for use of the vehicle shall usually be 12 hours a da
y.

9. Extra Hours: Extra Hours charges will be paid Rs. 100/-per extra hour b
asis to successful bidder for vehicles usage beyond 12 hours period.

10. Night Duty charges: Night duty charges will be paid Rs.550/- (i.e., in ad
dition to the daily rate) for each night duty, whenever the vehicle is required onl
y for night duty and duty time starts after 7:00pm.

11. Vehicles shall be required on ‘as and when required basis’ for a period from10.12.
2023 to 09.12.2024. The rates quoted by you shall be valid up to that period.The agreem
ent may be terminated by RITES at any time by serving one week notice to agency. Howev
er, agency may also terminate the agreement by issuing one week advance notice to RITES
in writing.

12. The requirement of vehicle/s will generally be issued/conveyed one day pri
or and supply of vehicle/s on time & ‘as and when required’ is the responsibility of the supp
lier.

13. The payment will be made on the basis of trip sheets, recording the time & the km r
unning of vehicle for a day, duly signed by the officer using the vehicle and certified by Tea
m Leader, RITES/QCA after submission of trip sheet. The trip sheet shall be filled in by the o
fficer using the vehicle.

14. The vehicle bill/invoice will be raised once in a month, incorporating all the
trip sheets in that particular month, by the owner of the agency before 10th of the foll
owing month. Income tax will be deducted at source from bills as per extent rules.

15. The vehicles may also require to carry general accessories like tools, kits, etc., and
sampling materials. Up-keeping/maintenance of vehicle is the responsibility of the agency s
upplying the vehicles. The vehicle shall be in good running condition and must be clean.

16. If the vehicle breakdown while on duty, supplier shall provide an alternative vehicle,
failing to which, RITES shall have the right, to deduct a proportionate amount from the amo

 unt due to the supplier.

17. The vehicles must have fitness, registration certificates, etc., from statutory authori
ties along with insurance policies for the vehicle duly renewed and the agency shall be resp
onsible for all statutory requirements like road tax, insurance, etc., of the vehicle. The driv
er of the vehicle provided by the agency must have valid taxi driving license.

18. The agency will be responsible for the behavior and conduct of the driver towards t
he officers and staff of RITES. The agency has to replace the driver against such complaint,
if any, from the officer in-charge. The decision of the officer in-charge shall be final in this r
espect.

19. Any damage caused to the third party or RITES property due to negligence of the dr
iver/agency will be made good by the agency. Any fine/penalty imposed by state governme
nt officials due to non-compliance of statutory rules shall be borne by the agency and agen
cy will be solely responsible for follow up of case during such situations and RITES will not
be in any case responsible for such act.

Disclaimer/अ वीकरण

The additional terms and conditions have been incorporated by the Buyer after approval of the Competent
Authority in Buyer Organization, whereby Buyer organization is solely responsible for the impact of these clauses
on the bidding process, its outcome, and consequences thereof including any eccentricity / restriction arising in
the bidding process due to these ATCs and due to modification of technical specifications and / or terms and
conditions governing the bid. Any clause(s) incorporated by the Buyer regarding following shall be treated as
null and void and would not be considered as part of bid:-

1. Definition of Class I and Class II suppliers in the bid not in line with the extant Order / Office Memorandum
issued by DPIIT in this regard.
2. Seeking EMD submission from bidder(s), including via Additional Terms & Conditions, in contravention to
exemption provided to such sellers under GeM GTC.
3. Publishing Custom / BOQ bids for items for which regular GeM categories are available without any
Category item bunched with it.
4. Creating BoQ bid for single item.
5. Mentioning specific Brand or Make or Model or Manufacturer or Dealer name.
6. Mandating submission of documents in physical form as a pre-requisite to qualify bidders.
7. Floating / creation of work contracts as Custom Bids in Services.
8. Seeking sample with bid or approval of samples during bid evaluation process.
9. Mandating foreign / international certifications even in case of existence of Indian Standards without
specifying equivalent Indian Certification / standards.
10. Seeking experience from specific organization / department / institute only or from foreign / export
experience.
11. Creating bid for items from irrelevant categories.
12. Incorporating any clause against the MSME policy and Preference to Make in India Policy.
13. Reference of conditions published on any external site or reference to external documents/clauses.
14. Asking for any Tender fee / Bid Participation fee / Auction fee in case of Bids / Forward Auction, as the

 case may be.

Further, if any seller has any objection/grievance against these additional clauses or otherwise on any aspect of
this bid, they can raise their representation against the same by using the Representation window provided in
the bid details field in Seller dashboard after logging in as a seller within 4 days of bid publication on GeM. Buyer
is duty bound to reply to all such representations and would not be allowed to open bids if he fails to reply to
such representations.

This Bid is governed by the General Terms and Conditions/सामा य िनयम और शत, conditons stipulated in Bid and
Service Level Agreement specific to this Service as provided in the Marketplace. However in case if any condition
specified in General Terms and Conditions/सामा य िनयम और शत is contradicted by the conditions stipulated in
Service Level Agreement, then it will over ride the conditions in the General Terms and Conditions.
In terms of GeM GTC clause 26 regarding Restrictions on procurement from a bidder of a country which shares a land border with India, any bidder from a country which
shares a land border with India will be eligible to bid in this tender only if the bidder is registered with the Competent Authority. While participating in bid, Bidder has to
undertake compliance of this and any false declaration and non-compliance of this would be a ground for immediate termination of the contract and further legal action

in accordance with the laws./ जेम क सामा य शत के खंड 26 के संदभ म भारत के साथ भूिम सीमा साझा करने वाले दे श के बडर से खर द

गलत घोषणा कए जाने व इसका अनुपालन न करने पर अनुबंध को त काल समा करने और कानून के अनुसार आगे क कानूनी कारवाई
का आधार होगा।
