Introduction

This module discusses what are the laws governing the criminology. This was further
explained the three laws that governs the criminology. This module teaches students regarding
the RA 6975, RA 8551 and RA 11131.

At the end of the topic, students are expected to:

REPUBLIC ACT 6975

Otherwise known as the Department of the Interiorand Local Government Act of


1990, enacted on December 13, 1990; reorganized the DILG and established the Philippine
National Police, Bureau of Fire Protection, Bureau of Jail Management and Penology and the
Philippine Public Safety College

Declaration of Policy
This law was enacted to strengthen local government capacity in order to provide effective
basic services to citizens. Under the law , the police force must work to be highly efficient and
competent that is “NATIONAL IN SCOPE AND CIVILIAN IN CHARACTER”.
The Department
It shall consist of:

 PHILIPPINE PUBLIC SAFETY COLLEGE
 TRI-BUREAUS(PNP, BFP AND BJMP) The department shall consist of : that shall be headed by
the SECRETARY

FUNCTIONS OF THE SECRETARY


Prepare and submit regular reports this includes a Quarterly Anti-Crime Operations Report and such as
the President and Congress may require; Act as the Chairman and Presiding of the National Police Commission;
and Delegate authority to exercise any substantive or administrative function to the members of the
NAPOLCOM or other officers of rank within the Department.

WHAT IS THE RELATIONSHIP BETWEEN AFP AND PNP?


The PNP enforces laws and ordinances and performs statutory functions while the AFP exercises
primary responsibility on matters involving suppression of insurgency and other serious threats to national
security.

THE COMMISSION
The National Police Commission (NAPOLCOM) hereinafter refer as the Commission. The commission
shall be a collegial body within the Department (DILG). It shall be composed of a Chairman, and four (4)
Regular Commissioners, and one (1) of whom shall be designated as Vice-Chairman by the President.

COMMISSION PROPER AND TERM OF OFFICE


 Chairman – 6 years
 4 Regular Commissioners
A. The two regular commissioner shall serve for six years
B. The two regular commissioner, shall have a tour of duty for 4 years
Note: The appointments of the Chairman and the Commissioners shall not have an extension or
reappointment.

QUALIFICATIONS OF A COMMISSIONER
1. He is at least thirty-five (35) years old;
2. A member of the Philippine Bar or Holder of a masters degree in public administration, business
administration, management, sociology, criminology, law enforcement, national security administration,
defense studies, and other related discipline;
3. He had an experience in law enforcement work atleast five (5) years

POWERS AND FUNCTION OF THE COMISSION


a) Exercise administrative control over the Philippine National Police;
b) Advise the President on all matters involving police functions and administration;
c) Foster and develop policies and promulgate rules and regulations, standards and procedures to
improve police services based on sound professional concepts and principles;
d) Examine and audit, and thereafter establish the standards for such purposes on a continuing basis,
the performance, activities, and facilities of all police agencies throughout the country;
e) Prepare a police manual prescribing rules and regulations for efficient organization, administration,
and operation, including recruitment, selection, promotion and retirement;
f) Establish a system of uniform crime reporting;
g) Conduct surveys and compile statistical data for the proper evaluation of the efficiency and
effectiveness
of all police units in the country;
h) Render to the President and to Congress an annual report on its activities and accomplishments
during the thirty (30) days after the end of the calendar year, which shall include an appraisal of the
conditions obtaining in the organization and administration of police agencies in the municipalities,
cities and provinces throughout the country, and recommendations for appropriate remedial
legislation;
i) Approve or modify plans and programs on education and training, logistical requirements,
communications, records, information systems, crime laboratory, crime prevention and crime
reporting;
j) Affirm, reverse or modify, through the National Appellate Board, personnel disciplinary actions
involving demotion or dismissal from the service imposed upon members of the Philippine National
Police by the Chief of the Philippine National Police;

k) Exercise appellate jurisdiction through the regional appellate boards over administrative cases
against
policemen and over decisions on claims for police benefits;
l) Recommend to the President, through the Secretary, within sixty (60) days before the
commencement of each calendar year, a crime prevention;
m) Prescribe minimum standards for arms, equipment, and uniforms and, after consultation with the
Philippine Heraldy Commission, for insignia of ranks, awards and medals of honor;
n) Issue subpoena and subpoena duces tecum in matters pertaining to the discharge of its own powers
and duties, and designate who among its personnel can issue such processes and administer oaths in
connection therewith; and
o) Perform such other functions necessary to carry out the provisions of this Act and as the President
may direct.

DISCIPLINARY BOARD
The commission shall establish a formal administrative disciplinary appellate machinery consisting of
the National Appellate Board and Regional Appellate Board

THE PHILIPPINE NATIONAL POLICE

Initially consisting of the members of the police forces who were the Integrated National Police (INP)
and the officers and enlisted personnel of the Philippine Contabulary (PC) which include the narcotics command
(NARCOM), or the criminal investigation service (CIS).

POWER AND FUNCTIONS OF PNP

1. Enforce the laws and ordinances relative to the protection of lives and properties Maintains peace and
order and take all necessary step to ensure public safety.

2. Promote a more pro-active community in crime prevention and cooperation with the media for factual
accounts of crime incidents and perceptions of the police.

3. Maximize prevention of crimes through continuing police visibility, investigate crime and effect the
arrest of criminal offenders and assist in their prosecution.

4. Neutralize of organized crime groups, especially kidnappers, terrorist, bank robbers and carnappers.

5. Sustain campaign against dangerous drugs. Expedite the processing of personnel transactions in favor of
deserving personnel.

6. Detain an arrested person for a period not beyond what is prescribed by law, informing the person so
detained of all his rights under the Constitution;

7. Issue License for the possession of firearms and explosives in accordance with the law.

8. Supervised and control the training and operations of security agencies and issue licenses to operate
security agencies , and to security guards and private detectives, for the practice of their professions.

SECTION 30: Qualifications


PNP Qualifications UNDER RA 6975
a) A citizen of the Philippines;
b) A person of good moral conduct;
c) Of sound mind and body;
d) Must possess a formal baccalaureate degree for appointment as officer and must have finished at
least second year college or the equivalent of seventy-two (72) collegiate units for appointment as
nonofficer or an equivalent training or experience for those already in the service upon the effectivity
of this Act.
e) Must be eligible in accordance with the standards set by the Commission;
f) Must not have been dishonorably discharged from military employment or dismissed for cause from
any civilian position in the Government;
g) Must not have been convicted be final judgment of an offense or crime involving moral turpitude;
h) Must be at least one meter and sixty-two centimeters (1.62 m.) in height for male and one meter and
fifty-seven centimeters (1.57m.) for female;
i) Must weight not more or less than five kilograms (5 kg.) of the standard weight corresponding to his
or her height, age, and sex; and
j) For a new applicant, must not be less than twenty-one (21) nor more than thirty (30) years of age
PROMOTIONS AND RETIREMENT
PROMOTION: Confermenet to the next higher rank with an increase duties and responsibilities,
accompanied by the corresponding increase in salary. A member of the PNP shall not be eligible for
promotion to a higher position or rank unless he has successfully passed the corresponding promotional
examination given by the Commission, or the Bar or corresponding board examinations for technical services
and other professions, and has satisfactorily completed an appropriate and accredited course in the PNPA or
equivalent training institutions. In addition, no member of the PNP shall eligible for promotion unless he has
been cleared by the People’s Law Enforcement Board (PLEB) of complaints proffered against him, if any.

KINDS OF PROMOTION

Compulsory retirement - for officer and non-officer, shall be upon the attainment of age fifty-six (56):
Provided, that, in case of any officer with the rank of chiefsuperintendent, director or deputy director general,
the Commission may allow his retention in the service for an unextendible period of one (1) year.
Optional Retirement — Upon accumulation of at least twenty (20) years of satisfactory active service, an
officer or nonofficer, at his own request and with the approval of the Commission, shall be retired from the
service and entitled to receive benefits provided for by law.

PLEB
The PLEB shal l be the central receiving entity for any citizen’s complaint against to any erring
police officers. Provided, that there shal l be at least 1 PLEB for every 500 city or municipal personnel and
for each of the legislative districts a city. The PLEB shal l take cognizance of or refer the complaint to the
proper discipl inary or adjudicatory authority within 3 days upon the filing of the complaint.

PLEB`S COMPOSITION
1. Any member of the Sangguniang Panlungsod or bayan chosen by his respective sanggunian;
2. Any barangay chairman of the city or municipality concerned chosen by the association of
barangay chairman; and
3. Three (3) other members, who can be removed only for cause to be chosen by the
city/municipal peace and order council from among the respected members of the community
known for their probity and integrity, one (1) of whom must be a woman and another a
member of the Bar, or, in the absence thereof, a college graduate, or the principal of the
central elementary school in the locality.
4. The Chairman of the PLEB shall be elected from among its members. The term of office of
the members of the PLEB shall be for a period of 3 years from assumption of office. Such
member shall hold office until his successor shall have been chosen and qualified.

PLEB's Request for Preventive Suspension


1. The respondent refuses to heed the PLEB's summons subpoena;
2. The PNP personnel has been charged with offenses involving bodily harm or grave threats;
3. The respondent is in a position to tamper evidence; and
4. The respondent is in a position to unduly influence the witnesses

INTERNAL DISCIPLINE
On dealing with minor offenses involving internal discipline found to have been committed by any
regular member of their respective commands, the duly designated supervisors and equivalent officers of the
PNP shall, after due notice and summary hearing.

MINOR OFFENSE
1. Simple misconduct or negligence
2. Insubordination
3. Frequent absences and tardiness
4. Habitual drunkenness
5. Gambling prohibited by law

INTERNAL DISCIPLINE
1. CHEIF OF POLICE OR EQUIVALENT SUPERVISOR- not exceed 15 days
2. PROVINCIAL DIRECTOR OR ES- not exceed 30 days
3. Police regional directors or equivalent supervisor- not exceed 30 days
4. Chief of the PNP- period not exceeding one 180 days

POWER OF LOCAL GOVERMENT OFFICIALS OVER PNP


Powerto Choose Provincial Director by Provincial Governors: The provincial governor shall choose the
provincial director from a list of 3 eligible recommended by the PNP regional director.
Powerto Choose City or Municipal Chief of Police: The mayors have the authority to choose the COP from
a list of 5 eligible candidates or applicants recommended by the provincial police director, preferably from
the same province, city or municipality.

Bureau of Fire & Protection


The Bureau of Fire Protection, hereinafter referred to as the Fire Bureau, is hereby created initially
consisting of the existing officers and uniformed members of the fire service of the Integrated National Police
as constituted under Presidential Decree No. 765.
Fire Bureau shall be responsible for the prevention and suppression of all destructive fires on
buildings, houses and other structures, forest, land transportation vehicles and equipment, ships or vessels
docked at piers or wharves or anchored in major seaports, petroleum industry installations, plane crashes and
other similar incidents, as well as the enforcement of the Fire Code and other related laws.
Bureau of Jail Management and Penology
The Bureau of Jail Management and Penology, hereinafter referred to as the Jail Bureau, is hereby
created initially consisting of officers and uniformed members of the Jail Management and Penology Service
as constituted under Presidential Decree No. 765.
The Jail Bureau shall exercise supervision and control over all city and municipal jails. The
provincial jails shall be supervised and controlled by the provincial government within its jurisdiction, whose
expenses shall be subsidized by the National Government for not more than three (3) years after the
effectivity of this Act.

The Philippine Public Safety College


It shall be the premier educational institution for the training, human resource development and
continuing education of all personnel of the PNP, Fire and Jail Bureaus. Said College shall be under the direct
supervision of a Board of Trustees composed of the Secretary and the three (3) bureau heads. The College
shall consist of the present Philippine National Police Academy (PNPA) established pursuant to Section 13 of
Presidential Decree No. 1184, the Fire Service Training Center, the Philippine National Training Center
(PNTC), the National Police College, and other special training centers as may be created by the Department.

OTHER PROVISION OF THE LAW


PHILIPPINE NATIONAL POLICE (PNP)
This law stated that PNP is supposed to have a Maritime Police Unit, to absorb the police functions of
the Coast Guard and to be provided with sea capabilities.
RA 6975 is to help monitoring not only on the mainland but for also for the sealife. It will also
enforce all laws to protect lives and properties of each Filipino. The law also promised to protect everyone in
the public.

RA 8551
“Philippine National Police Reform and Reorganization Act of 1998”
An Act Establishing the Philippine National Police under a reorganized Department of the Interior and
Local Government and Other Purposes as amended by RA 8551 Philippine National Police Reform and
Reorganization Act of 1998 and further amended by RA 9708.
.AMENDMENTS TO RA 6975
THE NATIONAL POLICE COMMISSION
The Commission shall be an agency attached to the Department for policy and program coordination.
It shall be composed of a Chairperson, four (4) regular Commissioners, and the Chief of PNP as ex-officio
member. Three (3) of the regular commissioners shall come from the civilian sector who are neither active
nor former members of the police or military, one (1) of whom shall be designated as vice chairperson by the
President. The fourth regular commissioner shall come from the law enforcement sector either active or
retired: Provided, That an active member of a law enforcement agency shall be considered resigned from said
agency once appointed to the Commission: Provided, further, That at least one (1) of the Commissioners shall
be a woman.

SECTION 14
a) A citizen of the Philippines
b) A person of good moral conduct;
c) Must have passed the psychiatric/psychological, drug and physical tests to be administered by the
PNP or by any NAPOLCOM accredited government hospital for the purpose of determining
physical and mental health.
d) Must possess a formal baccalaureate degree from a recognized institution of learning
e) Must be eligible in accordance with the standards set by the Commission;
f) Must not have been dishonorably discharged from military employment or dismissed for cause
from any civilian position in the Government;
g) Must not have been convicted by final judgment of an offense or crime involving moral
turpitude;
h) Must be at least one meter and sixty-two centimeters (1.62 m.) in height for male and one meter
and fifty-seven centimeters (1.57 m.) for female;
i) Must weigh not more or less than five kilograms (5 kgs.) from the standard weight corresponding
to his or her height, age, and sex; and

j) For a new applicant, must not be less than twentyone (21) nor more than thirty (30) years of age:
except for the last qualification, the above-enumerated qualifications shall be continuing in
character and and absence of any one of them at any given time shall be a ground for separation
or retirement from the service: Provided, That PNP members who are already in the service upon
the effectivity of this Act shall be given at least two (2) more years to obtain the minimum
educational qualification and one (1) year to satisfy the weight requirement.;
"For the purpose of determining compliance with the requirements on physical and mental health,
as well as the non-use of prohibited drugs, the PNP by itself or through a NAPOLCO accredited
government hospital shall conduct regular psychiatric, psychological drug and physical tests
randomly and without notice”

SECTION 15. WAIVERS FOR INITIAL APPOINTMENTS TO THE PNP.


Age, height, weight, and educational requirements for initial appointment to the PNP may be waived
only when the number of qualified applicants fall below the minimum annual quota: Provided, That an
applicant shall not be below twenty (20) nor over thirty-five (35) years of age: Provided, further, That any
applicant not meeting the weight requirement shall be given reasonable time but not exceeding six (6) months
within which to comply with the said requirement: Provided, furthermore, That only applicants who have
finished second year college or have earned at least seventy-two (72) collegiate units leading to a bachelor's
decree shall be eligible for appointment: Provided, furthermore, That anybody who will enter the service
without a baccalaureate degree shall be given a maximum of four (4) years to obtain the required educational
qualification: Provided, finally, That a waiver for height requirement shall be automatically granted to
applicants belonging to the cultural communities.

It is essential part of the disciplinary mechanism of the PNP. It serves as the monitoring body of the
character and behavior of all policemen and operates as the investigating and adjudicatory body on all
administrative offenses committed by PNP personnel.
The National, Regional, and Provincial offices of the Internal Affairs shall be established that shall be
headed by an INSPECTOR GENERAL who shall be assisted by a DEPUTY INSPECTOR GENERAL.
That the head of IAS shall be a civilian who shall meet the qualifications.

Appointments and Entry Qualification


QUALIFICATIONS: It shall be voluntary and subject to rigid screening where only PNP personnel who
have at least five (5) years experience in law enforcement and have no derogatory record shall be considered
for appointment.
APPOINTMENT: The INSPECTORGENERAL shall be appointed by the PRESIDENT upon the
recommendation of the Director General and duly endorsed by the Commission.
FUNCTIONS:

 Pro-actively conduct inspections and audits on PNP personnel and units;


 investigates complaints and gather evidence in support of an open investigations;

 conduct summary hearings on PNP members facing administrative charges

 submit periodic report on the assessment, analysis and evaluation of the character and behavior of the
PNP personnel and units to the Cheif PNP and the commission

 file appropriate criminal cases against PNP members before the court as evidence warrants and assists
the prosecution

 provide assistance to the Office of the Ombudsman in cases involving the personnel of the PNP

AUTOMATIC INVESTIGATIONS
A. Incidents where a police personnel discharges a firearm
B. Incidents where death, SPI, or any violation of HR occured in the conduct of a police operations;
C. Incidents where evidence was compromised, tampered with, obliterated, or lost while in the custody
of police personnel;
D. Incidents where a suspect in the custody of the police was seriously injured and established rules of
engagement have been violated.
TITLE VII
CREATION OF THE WOMEN`S DESKS IN ALL POLICE STATIONS AND THE
FORMULATION OF GENDER SENSITIVITY PROGRAM
The PNP shall establish womens desks in all police stations throughout the country to administer and
attend cases involving crimes against chastity, sexual harassment, abuses committed against women and
children and other similar offenses.
PRIORITIZATION OF WOMEN FOR RECRUITMENT
The PNP shall prioritize the recruitment and training of women who shall serve in the womens desk.
The PNP shall reserve ten (10) percent of it`s annual quota.

RA 6506: AN ACT CREATING THE BOARD OF EXAMINER FOR CRIMINOLOGISTS IN THE
PHILIPPINE AND FOR OTHER PURPOSES
WHO IS CRIMINOLOGIST?
A criminologist is any person who is a graduate of the Degree of Criminology, who has passed the
examination criminologists and is registered as such by the Board ( Section 22 of RA 6506):
A. Finish degree of Criminology;
B. Pass the Licensure Examina on for the Criminologist; and;
C. Be Registered by the professional regulatory board for the Criminologist.

The Philippine Criminology Profession act of 2018 act regulating the practice of criminology
profession in the Philippines APPROPRIATING FUNDS THEREFOR, REPEALING FOR THE PURPOSE
REPUBLIC ACT NO. 6506, OTHERWISE KNOWN AS "AN ACT CREATING THE BOARD OF
EXAMINERS FOR CRIMINOLOGISTS IN THE PHILIPPINES”.
The State recognizes the importance of criminology profession in national security, public safety,
peace and order, and in nationbuilding and development. Hence, it shall develop and nurture competent,
virtuous, productive and wellrounded criminologists whose standards of professional practice and service
shall be excellent, qualitative, world-class and globally competitive through sacred, honest, effective and
credible licensure examinations, coupled with programs and activities that would promote professional
growth and development.
OBJECTIVES:
(a) The examination, registration and licensure for criminologists;
(b) The supervision, control and regulation of the practice of criminology;
(c) The standardization and regulation of criminology education;
(d) The development of the professional competence of criminologists through Continuing Professional
Development (CPD); and
(e) The integration of all criminology professional groups, and membership of all registered criminologists to
the accredited professional organization.
SEC 5. SCOPE OF PRACTICE
(a) In line with the practice of profession or occupation as a law enforcement administrator,
executive, adviser, consultant, officer, investigator, agent or employee in any private or
government agencies performing law enforcement and quasi-police functions at the Philippine
National Police (PNP), the National Bureau of Investigation (NBI), the Philippine Drug
Enforcement Agency (PDEA), the Bureau of Fire Protection (BFP), the Bureau of Jail
Management and Penology (BJMP), the Provincial Jail, the Bureau of Corrections (BUCOR), the
Probation and Parole Administration (PPA), the Bureau of Internal Revenue (BIR), the Bureau of
Customs (BoC), the Bangko Sentral ng Pilipinas (BSP), other government and private banks, the
Philippine Postal Corporation (PPC), the Sea and Air Marshalls, the VIP Security, Airport and
Seaport
Police, the National Intelligence Coordinating Agency (NICA), the Intelligence Service of the
Armed Forces of the Philippines (ISAFP), and other intelligence service or agencies of the
government exercising similar functions
(b) In line with the practice of teaching profession such as those performed by a professor,
instructor or teacher in any university, college or school duly recognized by the government of
any of the following professional and component subjects of the criminology program: (1)
Criminal Jurisprudence and Procedure; (2) Criminalistics; (3) Law Enforcement Administration;
(4) Crime Detection and Investigation; (5) Correctional Administration; and (6) Criminal
Sociology and Ethics, and other technical and specialized subjects in the criminology curriculum
provided by the CHED;
(c) As a technician, examiner/criminalist, or specialist in dactyloscopy, questioned document,
deoxyribonucleic acid (DNA), lie detection, firearms identification, forensic photography,
forensic chemistry and other scientific crime detection and investigation;
(d) As a correctional administrator, executive, supervisor, or officer in any rehabilitation,
correctional, and penal institution or facility, and in any community-based corrections, and
rehabilitation agencies and/or programs;
(e) As a counsellor, consultant, adviser or researcher in any government or private agency on any
aspect of criminological research or project involving the causes of crime, children in conflict
with the law, treatment of offenders, police operations, law enforcement administration, scientific
criminal investigation or public safety and national security administration; and
(f) As a private investigator, administrator, consultant or agent, or detective in any private
security and investigation agency organized under the laws of the Philippines.

Qualifications of the Chairperson and members of the board
(a) Must be a natural-born Filipino citizen and a resident of the Philippines;
(b) Must be of good moral character, good reputation and of sound mind and body;
(c) Not convicted by a court of competent jurisdiction of any offense involving moral turpitude;
(d) Must be a graduate of Bachelor of Science in Criminology, and a holder of a Post-Graduate
Degree in Criminology or a lawyer in any reputable school recognized by the CHED; (e) Must be a
registered criminologist with a valid certificate of registration and a valid professional identification
card, having at least ten (10) years of practice in the profession prior to the appointment including no
less than two (2) years teaching experience of criminology or law subjects in full-time or part-time
capacity in the college of criminology or college of law recognized by the government through the
CHED;
(f) Must be a member in good standing of the APO but not an officer or trustee thereof; and
(g) Must not be a member of the faculty of any school, college or university where a regular class or
review course in criminology is offered, nor a member of the staff of reviewers in a review school or
center, and must not have any direct or indirect pecuniary interest in any such institution.
SEC 10. POWERS, FUNCTIONS, DUTIES AND RESPONSIBILITIES
(a) To administer, supervise, and monitor the conduct of the licensure examination, registration,
membership in the APO and the practice of criminology in accordance with the provisions of this
Act;
(b) To receive complaints and decide the matter as to the malpractices and unethical conduct in the
practice of the criminology profession;
(c) To promulgate and issue rules and regulations implementing the provisions of this Act;
(d) To promulgate and adopt Code of Ethics and Code of Good Governance for the practice of
criminology;
(e) To adopt an official seal of the Board;
(f) To prescribe and promulgate guidelines on the conduct of a CPD program for criminologists in
consultation with the APO;
(g) To promulgate, adopt or amend the syllabi and tables of specifications of the subjects for the
licensure examination/s in consultation with the APO, the academe, and the CHED Technical Panel
for Criminology, prepare questions for the licensure examination which shall strictly be within the
scope of the syllabi of the subjects for examination, as well as administer and correct, and release the
results of the licensure examinations;
(h) To issue, suspend, revoke or reinstate the certificate of registration of the registered criminologist
or cancel temporary/special permit granted to foreign criminologist;
(i) To administer oaths in the performance of its functions such as, but not limited to, the oath of a
professional to successful examinees in licensure examination for criminologist together with the
APO in an appropriate mass oath-taking ceremony to be held for the purpose;
((j) To monitor the conditions affecting the practice of criminology and whenever necessary, adopt
such measure as may be deemed proper for the enhancement of the profession and the maintenance of
high professional, ethical and technical standards; for this purpose, the members of the Board, duly
authorized by the Commission, may conduct ocular inspection of establishments where criminology
is practiced, and recommend sanction as it may deem proper to the appropriate government agency
concerned;
(k) To monitor all colleges and universities offering criminology program and recommend sanctions
to the CHED or to other authorized government offices, for noncompliance with the policies,
standards, and requirements as to faculty qualifications, laboratory, library, facilities and equipment,
research outputs, curriculum and administration of the criminology education;
(l) To hear and investigate cases on violations of this Act, its implementing rules and regulations
(IRR), the Code of Ethics, the Code of Good Governance and other policies, and for this purpose, to
issue summons, subpoena ad testificandum and subpoena duces tecum to alleged violators and/or
witnesses to compel their attendance in such hearings or investigations and the production of
documents in connection therewith:
(m) To delegate to the Commission the hearing or investigation of cases against the alleged violators:
Provided, That the hearing or investigation of cases wherein the issue or question involved strictly
concerns the technical practice of criminology shall be presided over by at least one
(1) member of the Board assisted by a Legal or Hearing Officer of the Commission;
(n) To recommend to the Commission the endorsement of cases involving criminal violations of this
Act, its IRR, and other laws to the Prosecution Office or appropriate government agency, for
investigation and appropriate action;
(o) To disqualify applicants for the licensure examination who has been previously convicted of a
crime with finality involving moral turpitude. Hear and decide administrative cases against the
examinees or registered criminologists if they have been convicted of a crime involving moral
turpitude: Provided, That if they are found guilty, the Board shall cancel their examination papers
and/or preclude them from taking another licensure examination, or to revoke/suspend their
certificates of registration and cause the surrender of their professional identification card subject to
the rules and regulations of the PRC: Provided, further, That the decision of the Board shall, unless
appealed to the Commission, become final and executory after fifteen (15) days from receipt of notice
of judgment or decision;
(p) To conduct, through the Legal or Hearing Officers, summary proceedings against the examinees
who commit violations of this Act, its IRR, any of the Codes aforementioned, including violation of
the General Instructions to Examinees, and to render summary judgment thereon which shall, unless
appealed to the Commission, become final and executory after fifteen (15) days from receipt of notice
of judgment or decision;
(q) To prepare an annual report of accomplishments on programs, projects and activities of the Board
for submission to the Commission after the close of each calendar year and make appropriate
recommendations to the Commission on issues or problems affecting the criminology profession; and
(r) To exercise such other powers as may be provided by law as well as those which may be implied
from, or which are incidental or necessary to the effective carrying out of the express powers granted
to the Board to achieve the objectives and purposes of this Act. The resolutions, rules and regulations
and other policies issued and promulgated by the Board shall be subject for review and approval by
the Commission.

APPLICANT QUALIFICATION
1. Must be a Filipino citizen or foreign citizen whose country has reciprocity with Philippines;
2. Have a good moral character and of sound mind and body certified by the school where
he/she graduated and the barangay where he/she lives, unless the examinee is a foreign
national a certification from any professional of good standing will do;
3. (Must hold a bachelor's degree in criminology duly accredited by the CHED) and conferred
by a school/college/university duly authorized by the government or its equivalent degree
obtained by either a Filipino or foreign citizen from an institution of learning in a foreign
country/state: Provided, That it is duly recognized and/or accredited by the CHED;
4. Must not have been convicted of an offense involving moral turpitude by a court of
competent jurisdiction; and
5. Those who failed five (5) times whether consecutive or cumulative in the criminologist
licensure examination, must present a certification issued by a reputable institution duly
recognized by the CHED that such applicant has satisfactorily completed a refresher course
in criminology.

Rating in the Licensure Examination


PASSES: To pass the licensure examination for criminologist, a candidate must obtain a weighted average
rating of seventy-five percent (75%) with no grade less than sixty percent (60%) in any given subject.
DEFFERED:In case the examinee obtains a weighted average rating of seventy-five percent (75%) but, has a
grade below sixty percent (60%) in any of the subjects, the result of the examinee shall be deferred.
FAILED: Any examinee who failed three (3) or more board subjects shall be deemed to have failed the board
examination and hose who did not obtain a weighted average rating of seventyfive percent (75%), is
considered as FAILED.

Conditions to the Deferred


STEP 1: The deferred examinee shall only be allowed to retake once within two (2) years from the date
of the examination, and shall be required to obtain a grade not lower than eighty percent (80%) on the
subject, to be considered to have passed the licensure examination.
STEP 2: If the examinee failed to retake after the lapse of two (2) years or failed to get the passing
mark of eighty percent (80%), the examinee shall retake all the board subjects.

CRIMINOLOGIST
SEC. 22 of RA 6506 Criminologist defined.
A criminologist is any person who is a graduate of the Degree of Criminology who has passed the
examination for criminologists and is registered as such by the Board.
RA 11131 defined REGISTERED CRIMINOLOGIST.
Registered criminologist refers to a natural person who holds a valid certificate of registration and an
updated professional identification card as criminologist issued by the Board and the Commission pursuant to
this Act, a “ RCrim” , suffixed for every Registered may attached it to their name.

PRIVILEGES OF REGISTERED CRIMINOLOGISTS


All registered criminologists shall be exempt from taking any other entrance or qualifying
government or civil service examinations and shall be considered civil service eligible to the following
government positions, among others: (1) Dactylographer; (2) Ballistician; (3) Questioned Document
Examiner; (4) Forensic Photographer; (5) Polygraph Examiner; (6) Probation Officer; (7) Parole Officer; (8)
Special Investigator; (9) Special Agent; (10) Investigative Agent; (11) Intelligence Agent; (12) Law
Enforcement Evaluation Officer; (13) National Police Commission (NAPOLCOM) Inspector; (14) Traffic
Operation Officer; (15) Associate Graft Investigation Officer; (16) Special Police Officer; (17) Safekeeping
Officer; (18) Sheriff; (19) Security Officer; (20) Criminal Investigator; (21) Warden; (22) Reformation
Officer; (23) Firefighter; (24) Fire Marshall; (25) Jail Officer up to the rank of Jail Superintendent; (26)
Police Officer up to the rank of Police Superintendent and other law enforcement agencies, and agencies
under the Criminal Justice System.
