FACTS On December 25, Werherlina Colipano (respondent) together with her child,
rode a jeepeny as paying passenger. The said jeepney is operated by Sanico
(petitioner) and being drived by Castro. Colipano testified that she was made
to sit on an empty beer case at the edge of the rear entrrtance/exit of the
jeepney with her sleeping child on her lap. Unfortunately, accident happened
and it heavily injured Colipano's leg and was eventually amputated. Colipano
filed a complaint for breach of contract of carriage and damages against
Sanico. No criminal case was filed against Sanico and Castro. RTC ruled in
favor of Colipano and held Sanico and Castro solidarily liable for damages.
The case was appealed before CA and it affirmed the ruling of the lower court
and only modified the amount of damages.
ISSUE Whether or not Castro and Sanico should be solidarily liable for Breach of
Contract of Carriages
