Commission Agreement

This Sales Associate Commission Agreement (“Agreement”) is made and entered


into this ____ day of [MONTH], [YEAR] by and between [NAME OF COSMETICS
COMPANY], a corporation having its principal operation in [INSERT
COMPLETE COMPANY ADDRESS] which shall be referenced here as the
“Company” and [NAME OF SALES ASSOCIATE], of legal age, single, and with
postal address in [INSERT EMPLOYEE COMPLETE ADDRESS], who shall be
referenced here as the “Employee.”

WITNESSETH

WHEREAS, the Employee desires and agrees to perform sales associate


services to the Company;

WHEREAS, the Company, seeing the Employee’s skills and capabilities, agrees
to engage the Employee’s services;

IN AGREEABLE CONSIDERATION, the parties mutually agree to the following


terms and conditions:

1. SALES DUTIES AND RESPONSIBILITIES

Beginning on the ___ day of [MONTH], [YEAR] the Employee shall be under the
employ of the Company and shall be expected to contribute to and perform the
necessary sales activities which include the following:
● Scheduling appointments and physically meeting with the clients to
propose and present the different products being offered the Company;

● Preparing and adjusting the content of the sales presentations by


studying the different product offers and their technical descriptions;

● Providing professional demonstrations on the usage and applicability of


the Company products and services;

● Enhancing his/her knowledge on the new products and services that the
Company offers by attending training;

● Identifying and qualifying prospective customers through research and


networking;

● Maintaining professionalism and diplomacy in entertaining customers to


portray the level of professionalism that the Company exercises;
● Using marketing strategies to maximize sales effectiveness;

● Resolving customer concerns about the products and services of the


Company by investigating concerns and developing solutions;

● Monitoring competition by gathering the necessary and information on


pricing, products, and merchandising techniques;

● Preparing sales and marketing reports; and

● Keeping and maintaining customer account records, including contact


names and numbers for future references.
2. SALES ASSOCIATE POSITION AND EMPLOYMENT CLASSIFICATION

The Employee’s title shall be Sales Associate. He/she shall report directly to
[NAME OF SUPERVISOR]. The Employee is considered as an exempt employee
and shall not be subjected to a minimum wage or overtime regulations. The
Employee shall be expected to perform sales activities in the field for at least
50% of the working time or up to 75% of the working time, which the Company
considers as the significant ideal time to obtain success in sales.

3. COMMISSION CONTINGENCIES

In consideration of the terms and conditions of this Agreement, the Employee is


expected to:

● Meet the targeted level of sales to receive appropriate residual


commissions and shall submit all the necessary reports in a timely
manner;
● If the Company shall terminate the Employee, he/she shall duly receive
all the commissions of all completed sales up to the date of his/her
termination and other applicable prorated commissions for the month
that he/she was terminated;
● Forfeit any previously paid commissions if the Company does not duly
receive the customer’s payment (Forfeited commissions shall be deducted
to future commissions).

4. COMMISSION PAYMENTS

The Employee shall receive a base salary of [INSERT AMOUNT IN INR] per week
and shall receive the necessary commission payments based on the revenue
