SAFETY RULES JETTY FOR LIQUID

BULK - PUERTO GALVÁN

These Rules will be applied in the entire area of the Puerto Galván Jetty for
Liquid Bulk. The area between the fork and the operating platform - berths 1
and 2 - with a ship connected to loading arm or loading hose or product transfer
is declared SAFETY AREA. The documents to be submitted in each case,
stated herein, should always be written in the national language.

ACCESS CONTROL:

Every person or company accessing the area should do it in order to perform a


job or commercial activity in the Port Facilities located in the jetty for liquid bulk,
or on board of the ships moored therein. The activity should be directly related
to the ship or to the activity performed in the facilities.

1) IDENTIFICATION TO ACCESS:

1.1 To access or exit the loading platform area, the means exclusively
authorized for that purpose should be used and it is expressly forbidden to
use any other alternative means.

1.2 Access and/or exit of any person working or circulating in the area will be
recorded by submission and verification of data according to item 1.3. The
safety gate employee will check the data in a Computer System and will
authorize the access.

1.3 The companies accessing the jetty should previously submit to the
Licensee a personnel list with the following data:

• Full name
• Position
• Address
• ID number

This information will be loaded into the Computer System for verification upon
access.

1.4 Visits, not involved in the activities, which should access the operations area
for diverse reasons, should request an Access permit to ENERGEN S.A.,
which will issue a temporary authorization and will inform the visits about
the safety rules to be observed in the area.

The Access Permit will be issued once all documents requested by


ENERGEN S.A: have been submitted.

1.5 Transport vehicles coming to the site to pick or leave people involved in the
operations (land or ship personnel) should observe the rules stated in
Annex II JETTY FOR LIQUID BULK ACCESS RULES FOR VEHICLES
AND PEOPLE attached hereto

2 CONTRACTOR COMPANIES´ ACCESS:

2.1 - Any company performing jobs or tasks for third parties, on behalf of the
Consorcio de Gestión del Puerto de Bahía Blanca (CGPBB) or of ENERGEN
S.A., or any other company inside it, must comply, on a mandatory basis, with
the provisions in ANNEX I: ENTRANCE PROCEDURE FOR CONTRACTOR
COMPANIES AND THEIR PERSONNEL.

3 RIGHT TO ACCESS AND STAY:

3.1 - Access or stay will be prohibited to any person showing signs of alcohol
intoxication or of any other type or for any other reason considered risky for the
Terminal. Also, the illegal use or possession of drugs and the consumption of
alcohol is forbidden in the entire site of the Jetty for Liquid Bulk.

4 ACCESS OF VEHICLES, MEANS OF TRANSPORT AND MACHINES:

4.1 - When necessary to access a vehicle, piece of equipment or machine to


perform a job, the work contracting company should request the corresponding
access permit to the Safety and Environment Department of ENERGEN S.A.,
through a note, meeting the requirements in ANNEX I: ENTRANCE
PROCEDURE FOR CONTRACTOR COMPANIES AND THEIR PERSONNEL.

4.2 - Vehicle access to Safety Areas is forbidden when there are ships
connected, when product is being moved and when the trays are not empty.
These situations will be signaled with the installation of the corresponding
warning barriers, which will only be removed by ENERGEN S.A. staff.

Vehicle access to the safety area with non-connected moored vessel will only
be authorized for the delivery or picking of cargo, spare parts, supplies,
lubricants, etc., provided that the weight and size of the goods would make it
impossible to move them manually.

4.3 - Circulation speed in the area, for all vehicles, should not exceed 20 Km/h.
Also, the number of passengers should not exceed the vehicle design capacity.

4.4 - Vehicles should be parked in the areas marked for this purpose, facing the
exit, with their keys on and the doors unlocked.

4.5 - Trucks and pickups should not carry people in their beds, and all their
cargo should be transported perfectly fastened to avoid falls.

4.6 - The access of vehicles weighing more than 4.5 Tons by shaft, with a
minimum 2.5 m distance between shafts is forbidden. For every vehicle
exceeding these specifications, please ask Safety, Health and Environment
Department of ENERGEN S.A. about access feasibility and submit a vehicle
scheme stating load by shaft. (ANNEX III: MAXIMUM ALLOWABLE LOAD TO
CIRCULATE ALONG THE VIADUCT IN THE TERMINAL)

4.7 - Once the transport service between the Access Control of the Port Facility
and the vessel(s) moored in the dock has been implemented and guaranteed,
the entrance of private vehicles and the pedestrian passage of persons
not belonging to the Licensee inside the Port Facility will be strictly

5 MOBILE PHONES AND COMMUNICATION EQUIPMENT:

5.1 - Whenever there is a ship operating, products are being moved or the trays
are not empty, it is forbidden to use mobile phones, torchlights, cameras, video
cameras, communication equipment and their power sources and battery
chargers that do not have explosion proof features.

In ANNEX III-CLASSIFICATION GUIDE OF INTRINSICALLY SAFE EQUIPMENT, the


technical characteristics of the equipment to be used are stated.

6 NON SMOKING OR NON TRANSPORTING OPEN FLAME ELEMENTS:

6.1 - It is strictly forbidden to smoke, ignite fire or transport open flame elements
in the entire area of the Jetty for Liquid Bulk

7 PERSONAL PROTECTION EQUIPMENT:

Every person entering the jetty for liquid bulk should wear at least the following
personal protection elements according to the tasks to be performed and the
areas to be entered:

 HARD HAT
 EYE PROTECTION
 SAFETY SHOES

If the person must perform repairs or tasks on the jetty:

 GLOVES ACCORDING TO THE ELEMENTS TO BE HANDLED


 SPECIAL EQUIPMENT AND CLOTHES ACCORDING TO THE TASK
TO BE PERFORMED

To work in mooring areas or off the railings, the following should be added to
the above mentioned:

 LIFE VEST (Approved according to IRAM standards– SOLAS - PNA)

8 INSURANCE REGIME:

Contractors and service companies entering the Jetty for liquid bulk should
hand in to the Licensee a copy of all insurances as detailed in ANNEX I:
ENTRANCE PROCEDURE FOR CONTRACTOR COMPANIES AND THEIR
PERSONNEL.

9 ACCESS OF PEOPLE TO SHIPS:

9.1 – All people should use only safe accesses between ship and land, using
gangplanks duly approved by Prefectura Naval Argentina), according to the
standards, laws and rules in force. These landing docks should have an
effective safety net where access is unsafe.

9.2 - Close to the gangplanks there should be life buoys with ropes. Also, close
to the land access point, there should be appropriate lifesaving equipment.

9.3 - Access ways should be located as close as possible to the crew lodgings
and as far as possible from manifolds or loading arms, with direct exit to the
viaduct.

9.4 - The planks should be made of non-ferrous and non-combustible material


and should have appropriate protection elements on all their protruding ends, as
well as electrical insulation between the ship and their rolling part, so that no
sparks are generated by friction with the jetty or the material over which it slides.

9.5 - During dark hours, access to the ship should be well and safely
illuminated.

9.6 - The access of people under 18 years old to the Jetty for liquid bulk is
strictly forbidden, except that they embark or disembark, in which case they
should be accompanied by an adult.

FOR SHIP MANEUVERS IN THE TERMINAL AREA:

10 MOORING CONDITIONS:

10.1- The ship must be moored safely during its entire stay at the Terminal,
with all mooring ropes in good conditions, without knots or additions and with
strength appropriate for the size of the vessel.

10.2- The mooring lines should always be tense and the ship in the position
stated by the Terminal operator. Product transfers will be suspended if this
condition is not observed..

10.3- If the ship has constant tension winches, these should be braked
manually and should not be left in “automatic” condition.

10.4- The lines should be properly coiled in their spools, pulling against the
brake application fix point, which should be fully applied.

10.5- Steel cables cannot be used for mooring ships.

11 ABILITY OF THE VESSEL TO MOVE BY ITS OWN MEANS:

11.1 - While a tanker, chemical or gas ship is moored at the jetty for liquid bulk,
its boilers, main machinery, steering equipment and other essential pieces of
equipment for maneuvering it, should be ready to allow moving the ship away
from the jetty in the short term.

11.2 - Any repair or other jobs that may immobilize the ship will be made only
with the previous authorization of ENERGEN S.A., the CGPBB and Prefectura
Naval Argentina, together with the additional safety measures to be observed
both by the ship and the repair company, which should be reported previously to
the Licensee.

12 PIPES CONVERGING IN THE DOCK:

The product transport pipes converging in the dock should be grounded


effectively in the section immediately before the isolating flange in the jetty or
before the section of non-conductive loading hose that links the main pipeline
and the existing connection flange in the ship.

13 LINE PRESSURE:

The maximum pressure allowed at the line end will be the pressure supported
by the design of the loading system, loading arm or big hoses used.

14 CONNECTING FLANGES:

Connecting flanges will be bolted as required and if not bolted they should meet
the maximum mechanical tightness safety requirements to avoid product leaks..

15 LEAKAGE COLLECTING TRAY:

For liquid transfer, a leak collecting tray will be installed under each connecting
flange, to prevent the product or substance reaching the water, deck or jetty.
For the same purpose, all loading deck scuppers of the ship will be covered.

Once the loading/unloading operation is finished, the arms or hoses will be


cleaned, and the remaining product will be emptied into the collection trays, and
then disposed of in a slop tank that the licensee of the jetty will have for this
purpose. Subsequently, the corresponding final disposal of the waste will be
carried out, and the certificate of final disposal will be managed, which will
remain in the offices of the licensee of the jetty for liquid bulk, and a copy will be
given to the CGPBB.

16 INSTALLATION OF LOADING HOSES:

16.1 - Loading hoses will be used when it is not possible to connect the loading
arms. These will be installed so that they have no sharp bends or sudden
changes of direction. They should be laid over sharp edges. If an area with
these characteristics should be inevitably crossed, appropriate protections
should be used.

16.2 - All hoses used for product transfer operation should be in good
conditions and certified for the stated work pressure. This certification should be
made by a competent professional and signed by the corresponding
professional association and will be valid for one year. A copy of this
certification must be submitted to ENERGEN S.A.'s Safety, Health and
Environment Department.

16.3 - Whenever loading and/or unloading with the aid of big hoses, the
provisions in ANNEX V – OPERATIONS WITH HOSES FOR PRODUCT
TRANSFER IN BERTHS 1 AND 2 OF THE JETTY FOR LIQUID BULK should
be strictly observed

17 OPERATING RANGE OF LOADING ARMS:

17.1 - Each loading arm facility has operation limits inherent to its design, so
the ships should be positioned respecting the parameters in ANNEX VI:
RANGE LIMITS OF LOADING ARMS INSTALLED IN BERTHS JETTY FOR
LIQUID BULK.

17.2 - The Operational Manager of each loading arm or hose must give the
correct position to the ship when mooring, and must have for this purpose an
appropriate means of communication that allows a fluid communication with the
vessel.

18 FUEL LOADING FOR ON BOARD CONSUMPTION OPERATIONS:

18.1 - Fuel loading for consumption on board at the Terminal could be made
through the jetty lines and in those ships with the intake in the loading manifold

18.2 - Fuel loading for consumption on board from ship to ship will be made
complying fully with the provisions in Resolution Number 10-CGPBB/01 issued
by the Consorcio de Gestión del Puerto de Bahía Blanca (Annex VIII) and in
Addition “CHARLIE" to Annex II of BBLA Decision, CA6 Number 20/96 of
Prefectura Bahía Blanca, included in ANNEX X.

18.3 - Loading through trucks will be made only if there is no chance of supply
through a line in the jetty or ship at the parallel berth. In this case, product
transfer will be made complying with the provisions in Addition "BRAVO” to
Annex II of BBLA Decision, CA6 Number 20/96 of Prefectura Bahía Blanca,
included in ANNEX XI.

18.4 - Ship´s command and crew will control at every moment the tubes, arms,
hoses and any other device used for loading.

18.5 - The ship and the terminal should always have personnel available to
perform transfer operations, respond in an emergency and make the ship set
sail immediately by its own propulsion, command and maneuver means
available.

19 LOADING AND UNLOADING RATE REDUCTION:

The ship or terminal can request the reduction of the loading and/or unloading
rate if they consider it necessary to prevent a risk.

20 SIGNALING WITH VESSEL IN OPERATION:

When starting and performing operations, the tanker, chemical or gas ships
operating the jetty for liquid bulk will fly the BRAVO flag during daytime and the
rest of the day they will have a red all-round light with the safety conditions
corresponding to the risk.

21 ADVERSE WEATHER AND/OR TIDAL CONDITIONS

In the case of big water movements in the operating area, due to bad weather
conditions or maneuvers of a nearby ship, product pumping should be stopped
and the safety status of the operation analyzed. The same procedure will be
followed in case of any accident or explosion in the operating jetty or in its
safety area, in nearby ships, in case of heavy electrical storms or spill of any
product.

Wind conditions to be considered for safe operation:

 NW (310°) to E (090°), sustained, equal or higher than 13.8 m/sec (50


Km/h) winds and with winds of 16 m/sec from the rest of the quadrants,
product pumping must be stopped and the safety conditions of mooring
and operation analyzed to estimate continuity This action shall be
coordinated between the loading master and the arm operator.
 Departure at the discretion of the loading master.

Notwithstanding the above, the Licensee, the arm operator or the loading
master in coordination, may suspend the operation, in order to safeguard the
integrity of the operation and the elements involved in it, or continue it if they
consider that the conditions prevailing in the area do not pose a risk to the
operation.

The Central Meteorological Office of the (VTS) CGPBB will be taken as a


reference and the inquiry will be made to the VTS on-call telephone: 0291
– 4571938.

22 FLAME ARRESTOR GAUZE IN OBSERVATION DOORS:

When an inspection door has to be kept open in any tank, the corresponding
flame arrestor gauze will be installed.

23 STATIC ELECTRICITY:

Considering that static electricity can be a significant source of ignition and that
it is generated during transfer, ballasting and/or tanker washing operations, the
corresponding prevention rules should be strictly observed.

Such as:

 Avoid splash filling or ballasting or through tank mouth.


 Do not use air blowing through pipelines to tanks that contain clean or
raw products.
 Observe maximum speeds before starting the loading.
 All tanks being loaded with static accumulating products should be below
20 % of the explosivity level (EL) before loading.
 The companies operating with loading arms should submit the
corresponding grounding verification records to the technical area
personnel of the Licensee every year.

24 RADIOELECTRICAL EQUIPMENT:

With the exception of very high frequency equipment, which is safe for this use,
the vessel's radio equipment may not be used and the vessel's radio station
must be closed.

25 EMERGENCY TOW WIRE:

Tankers, chemical or gas carriers shall have a towing cable ready to be used in
case of emergency or accident, hanging outside the bow and stern warping
chocks, during the whole operation and from the opposite side of the dock.

26 FIREFIGHTING SYSTEM:

IN VESSEL:

26.1 - Fire hoses in the flying bridge and main deck will be connected in their
inlets and the ship will have during the entire operation the firefighting system
ready to be used immediately, keeping the line pressure of P = 7 kg / cm2.

26.2 - Also, hose sections with their corresponding nozzles will be placed in
front and behind the loading manifold and the monitors will be looking to the
manifold.

IN DOCK:

26.3 - Existing fire-fighting systems in the Terminal must be available at all


times.

26.4 - The location of the international shore connection in each berth should be
available and clearly marked.

See Annex IX - FIRE PROCEDURE

27 WATER TIGHT DOORS IN THE MAIN DECK:

27.1 - The water tight doors of the entire ship superstructure should remain
closed during product loading or unloading, inertization or ventilation of tank and
ballast

27.2 - The ventilation or air conditioning system should be adjusted


conveniently not to allow the access of flammable gases to the superstructure.

27.3 - The skylights in the engine room, kitchen and boilers will be closed if
necessary.

28 TOOLS FOR CONNECTION AND/OR DISCONNECTION:

28.1 - All tools to be used on board or at loading/unloading decks (operation


areas) should be Anti-spark.

29 DAMAGE TO ENGINEERING STRUCTURES:

Any ship causing an incident on the engineering structures of the jetty shall be
responsible for the damages on port facilities, including manifolds and loading
arms. During mooring maneuvers and during the whole time they are in the
dock, they will accept the placement of supplementary or floating fenders, in the
case of vessels with a length of less than 120 meters or those whose hull's
prismatic part does not rest on the fixed fenders of the dolphins on both sides of
the operating platform. During their stay, they will use floating fenders to prevent
their hull from causing damage to the aforementioned platforms at any time.

The number of fenders to be used shall be determined by the master of the


vessel and/or his/her representative after having considered the mooring
position or the vessel's hull conditions. Service shall be requested sufficiently in
advance of the berthing, and the master shall be responsible for any damage
that may occur due to insufficient quantity required or to lack of foresight to
place the order in time.

30 PRESERVATION OF THE ENVIRONMENT:

30.1 - It is strictly forbidden to pour into the estuary any toxic and/or chemical
substance, hydrocarbons, waste, elements, materials, etc. that may
contaminate the environment.

30.2 - Companies loading and/or unloading liquid fuels or chemicals should


submit to the Consorcio de Gestión del Puerto de Bahía Blanca the certificate
issued by the Prefectura Naval Argentina, stating compliance with Ordinance

30.3 - All Spill Control companies should comply with the guidelines stated in sections
2 and 8 of these Rules, plus those required by the Consorcio de Gestión del Puerto de
Bahía Blanca and ENERGEN S.A. for specific spill control tasks.

30.4 - If for any circumstance, maneuver, emergency or accident, a


contaminating situation occurs, whoever is in charge of the operation or
whoever detects it, will immediately notify the guard located at the viaduct
access, in order to activate the National Contingency Plan.

31 - WASTES

31.1 - The concessionaire shall provide waste containers, which shall comply
with the rules in force. These will be located outside the operating platforms in
the authorized sites.

31.2 - The household waste generated on board National Flag ships


exclusively, will be unloaded in the authorized containers, will be in wrappers
suitable for the proposed purpose, and these must prevent their breakage or
spread on the jetty. Annex XII: WASTE MANAGEMENT.

International Flag Vessels: they must manage their waste through the shipping
agent, adapting to the SENASA 714/2010 decision and/or the one in force.

31.3 - The Licensee will be in charge of managing the removal and final
disposal of the product, as well as issuing, if requested, the corresponding
certificate of final disposal.

31.4 To remove other types of waste from the ship, authorization must be
obtained from ENERGEN S.A. and the Prefectura Naval Argentina; in the latter
case, if applicable.

31.5 - Contractor companies performing tasks in the Liquid Bulk Terminal shall
comply with Waste Management, as established in ANNEX I: ENTRANCE
PROCEDURE FOR CONTRACTOR COMPANIES AND THEIR PERSONNEL,
Section 4.

32 ACCIDENT PREVENTION ACTIONS:

32.1 - The area should be walked around in order to check pipes, valves,
loading arms and the state of the docks, making sure that there are no product
leaks. It should also be verified that the access and work areas are free of
elements or obstacles that could interfere with the operation of the vessels or
jeopardize the safety of the operations.

32.2 - The docks will be clean and the leakage collection trays will be
completely empty.

32.3 - It shall be verified that no polluting products are poured into the waters
from ships, naval devices, pipes or other systems or equipment.

32.4 - Vessels or boats that are operating, in addition to complying with the
safety measures established in the laws in force, must respect those contained
in these Safety Rules.

32.5 - Neither hot nor cold works shall be performed unless previously
authorized by the corresponding party. Authorization for hot work in the jetty
shall be granted by the Liquid Bulk Jetty Licensee, while authorization for hot
work on the ship shall be granted by the Prefectura Naval Argentina. The
Licensee shall inform the Consorcio de Gestión del Puerto de Bahía Blanca,
whenever requested, about the authorization granted and the corresponding
additional safety measures. The contractor company that carries out a work
(cold/hot) must inform Prefectura Naval Argentina about it before it starts.

32.6 - If the works mentioned in the previous point are carried out, the licensee
of the jetty will verify that they are carried out in compliance with the safety
regulations in force.

32.7 -- Lighting systems, alarm systems, the fire service network and any other
equipment relevant to safety in the work area shall be kept in good working
order.

32.8 - When working on suspended scaffolding, or when ENERGEN S.A.


considers it necessary due to the characteristics of the task to be carried out, a
motorized rescue support boat with two people on board, a helmsman and a
person who will have the task of carrying out the rescue, shall be provided.

32.9 If a boat is required, it must meet the technical requirements that


ENERGEN S.A. considers necessary,

and it should also be duly authorized by the Maritime Authority as well as its
helmsman.

32.10 Prior to the start of work with the support vessel, the contractor must
submit, if appropriate, the Security Program, the Safe Work Plan, Safe Task
Procedure, etc., Personnel roster with a copy of their Boarding Pass and
documentation required in ANNEX I: ENTRANCE PROCEDURE FOR
CONTRACTOR COMPANIES AND THEIR PERSONNEL.

32.11 Notwithstanding the above, the licensee may audit the vessel to be used
by the contractor whenever required.

32.12 Depending on the characteristics of the work to be performed by a


contractor company, the licensee may require the presence of an Occupational
Health and Safety professional while the task is being performed.

33 EMERGENCIES:

33.1 Vessel and dock crews should provide maximum assistance in case of
emergencies, following the orders of the corresponding supervision.

33.2 Personnel not committed to the emergency should immediately leave the
area.

33.3 In case of an emergency onboard, personnel on the dock should be


immediately informed, and they shall initiate the proper emergency procedure.

33.4 In case of fire or emergency at the Terminal, all transfer operations shall be
stopped, terminal personnel shall be prepared to uncouple arms or hoses and
ship’s personnel shall be prepared to set sail when so instructed. The ships
shall indicate an onboard emergency with action stations and radio notifications.

33.5 Compliance with Maritime Ordinance No. 1/93 of the Prefectura Naval
Argentina is implicit in these regulations:

Whenever a vessel is operated in the mode of loading/unloading products at the


mooring sites (Posta 1, Posta 2 or Posta 3) and the operation of the arms is not
under the responsibility of ENERGEN SA, the permit holders, users, licensees,
etc. must have the necessary personnel in accordance with their operating
procedures, who must remain in the area in order to guarantee the total safety
of the operation; they must also indicate to the licensee of the jetty for liquid bulk
the persons who will be there. ANNEX IX: FIRE PROCEDURE (item 4.9.2)

34 LOADING MASTER

The Loading Master should be duly authorized by PREFECTURA NAVAL

ANNEX I

ENTRANCE PROCEDURE FOR CONTRACTOR COMPANIES AND THEIR


PERSONNEL.

Any Company that must carry out work for itself or tasks on behalf of third
parties, or on behalf of and by order of the Consorcio de Gestión del Puerto de
Bahía Blanca (CGPBB), or ENERGEN S.A., or any other Company located
within it; must comply, on a mandatory basis, with the following procedure.

1. THE COMPANY GIVING THE JOB:

1.1. Communication to the licensee:

The company contracting the work shall inform ENERGEN S.A., via a Note, of

 The work to be performed and its characteristics.


 Location of job performance.
 Starting date.
 Duration.
 Company in charge of the work.

If the Contracting Company turns out to be the Consorcio de Gestión del Puerto
de Bahía Blanca, the Area requesting the Works or the Purchasing Area, as the
case may be, shall be responsible for issuing the communication indicated in
the previous paragraph.

If the contracting company is a ship-owner, the communication above


mentioned can be made directly by the company or through the Maritime Agent.

1.2. In the communication stated in 1.1, the data of the Company that will carry
out the works, its owner, address, phone, fax or e-mail and contact person must
be indicated; together with a photocopy of the registration and qualification
certificate, issued by the Prefectura Naval Argentina, and the corresponding Hot
Work Permit if the works are on board the moored vessel.

2. THE CONTRACTOR:

The Contractor shall deliver to the Licensee, prior to its entry, the
documentation in relation to the Personnel, Vehicles, Equipment and/or
Machinery stated below:

DOCUMENTS TO BE SUBMITTED:

The contractor company will have to deliver the documentation through C-


LABOREN, through which it will manage the documentation for the entrance to
the Port Facility, as any other requirement it may have.

EMPLOYEES:

✓ AT THE START (to be submitted only once, unless there are modifications
on the data issued):

• A note with the company letterhead, detailing the payroll of personnel who
shall carry out the tasks (full names, ID, category, home or work address, city,
marital status, nationality, start date, contract mode, working hours, average
salary, collective bargaining agreement, category, role, Labor Risk Insurance
Company (ART), service data, and union data if it is a union delegate.

• Photocopy of the ID.


• Worker’s identification number (CUIL) record.
• Early enrollment code (AFIP, Argentine Tax Authority).
• Copy of both life insurance and ART policies and their pertaining payment
record.
• Medical examinations/Certificate of fitness (as applicable): The contractor
shall present the Licensee with a copy of every employee’s medical
examination. When this is not possible, the Licensee shall be informed about
the situation to take necessary steps.

• Training courses. See the Licensee on their need and scope.

At the end of the contractual bond:

• Record of employee’s clearance. (AFIP)


• Final settlement receipt.
• Telegram, return receipt letter, or instrument stating the termination.
• Certification of services and payments (Argentine Social Security Administration (ANSES)).
• Work certificate (Section 80 of the Labor Contract Law).
• Record of payment of withholdings and contributions to social security
organizations.
• Record of employees’ clearance.
• For construction personnel: Union fees payment record and record of fund
book presentation shall be submitted.
• In case of termination with cause, all supporting documents justifying the
cause invoked in the termination shall be attached.
• Death of a worker. A death certificate issued by the competent authority
should be attached.
• Mutual agreement. Notary records and/or agreement submitted before the
labor administrative authority should be attached as per the provisions of the
above-mentioned law.
• Worker’s retirement. A notification letter should be sent at the beginning of
retirement proceedings following the terms of Section 252 of the Labor Contract
Law plus records of retirement.
• Affidavit stating the authenticity of the documentation and of the contents of
the annexed documentation, signed by the contractor by which the Legal
Representative of the company states under oath that all attached
documentation (indicate number of pages) corresponding to the monthly control
(indicate date) is a true copy of the original. Likewise, it should be stated under

• Medical examinations/Certificate of fitness (as applicable): The contractor
must submit to ENERGEN S.A. a copy of the medical examination of each
employee. When this is not possible, the Licensee shall be informed about the
situation to take necessary steps.
• Training courses. See the Licensee on their need and scope.
• Affidavit stating the authenticity of the documentation and of the contents of
the annexed documentation, signed by the contractor by which the Legal
Representative of the company states under oath that all attached
documentation (indicate number of pages) corresponding to the monthly control
(indicate date) is a true copy of the original. Likewise, it should be stated under
oath that the information contained in each document, annex, and affidavit is

✓ MONTHLY:

• Self-employed taxpayer monthly payment record, as applicable.

• Subcontracts In the case that a contractor company sub-contracts an
independent contractor to carry out tasks within the Flammable Terminal, they
must submit: • The last 10 correlative invoices of the invoice pad. Note on
company letterhead detailing the list of self-employed or single tax paying
personnel who will carry out the tasks (full names, ID, category, real and work
address, location, marital status, nationality, date of entry, contractual modality,
working hours, average payment, category, function, personal accident
insurance, data on the assignment of the service). • Affidavit stating the
authenticity of the documentation and of the contents of the annexed
documentation, signed by the contractor by which the Legal Representative of
the company states under oath that all attached documentation (indicate

average payment, category, role, Labor Risk Insurance, and service data).
• Photocopy of the passport.
• Work authorization for foreign residents.
• Accident insurance policy for $ 1,500,000 and for medical and pharmaceutical
expenses for $ 300,000 together with their payment or payment plan. Medical
examinations/Certificate of fitness (as applicable): The contractor must submit
to ENERGEN S.A. a copy of the medical examination of each employee. When
this is not possible, the Licensee shall be informed about the situation to take
necessary steps.
• Training courses. See the Licensee on their need and scope.
• Affidavit stating the authenticity of the documentation and of the contents of
the annexed documentation, signed by the contractor by which the Legal
Representative of the company states under oath that all attached

2.1. On vehicles, transport and machines:

2.1.1. When it is necessary to enter a vehicle, equipment or machine to carry


out the work, the contracting company must request the corresponding entry
authorization from ENERGEN S.A., by means of a note stating the vehicles,
equipment and/or machines to be entered, which work or task will be affected
and the time during which they must be entered.

2.1.2. The note shall contain; in relation to the vehicles, equipment and/or
machines to be entered, a detailed description of them with the following
identification numbers, in order to facilitate the control and verification of them
by the Guard personnel in each entry or exit movement.

2.1.3. They must also submit the documentation listed below:

2.1.3.1. Vehicles (Trucks/Vans):

 Driver's license of the vehicle corresponding to the category of the


vehicle he/she drives.
 Civil Liability Insurance policy, with its corresponding payment receipt.

2.1.3.2. Cranes:

 Certification by an authorized entity about the working capacity of the equipment.


 Civil Liability Insurance policy with its corresponding payment receipt.
 Technical Insurance policy, with its corresponding payment receipt.
 Hoisting Insurance Policy for an amount to be determined by ENERGEN
S.A., according to the work to be done with its corresponding payment
receipt.
 Authorization by the competent authority or organization of the
driver/operator for driving corresponding to the category of the
vehicle/machinery he/she drives/operates.

2.1.3.3. Bulldozers / Motor graders / Backhoes / Forklifts / Containers:

 Civil Liability Insurance policy with its corresponding payment receipt.


 Technical Insurance policy, with its corresponding payment receipt.
 Authorization by the competent authority or organization of the
driver/operator for driving corresponding to the category of the
vehicle/machinery he/she drives/operates.

All Personnel entering together with such transport, equipment and/or


machinery, whatever their function or task, shall be included in the
documentation provided under the terms of Point 2.

All documentation referring to "INSURANCE" must be accompanied by


"General and Specific Conditions, and Annexed Clauses that are part of the
contracted policy".

3. ON TERMS:

3.1. The documents stated in item 1 should be submitted by the interested


party, at least SEVENTY TWO (72) hours before the entry date.

3.2. The documents stated in item 2 should be submitted by the interested


party, at least SEVENTY TWO (72) hours before the entry date.

3.3. Once the documentation above has been received and approved, the
corresponding Entry Authorization will be issued, which once communicated to
the corresponding Entry Control will enable the interested party to enter and
carry out the activities duly communicated.

3.4. Each time the Company has to hire new personnel, it must submit the
documentation listed in point 2, with the corresponding Early Registration Form
forty-eight (48) working hours in advance of the date set for their entry.

3.5. If the company has to enter vehicles, transport and/or machinery that have
not been initially declared after the start of the work, it must complete the
required documentation within the specified time period before entering.

4. PROHIBITIONS:

4.1. No company, person, vehicle, transport and/or machine access will be


authorized without the corresponding Access Authorization issued by the
licensee; as per the terms stated in this standard.

5. SAFETY MEASURES:

5.1. During all the work period, the companies in charge should strictly observe
the safety standards that have been communicated particularly by the Licensee.

5.2. Notwithstanding the statements in the previous paragraph, the safety


standards in Act 19587, Decree 351 and 911 and their supplementary and
amending rules will be applicable.

ANNEX II

JETTY FOR LIQUID BULK - ACCESS RULES FOR PEOPLE 1- GENERAL

RULES

1.1. 1.1. Access authorizations will be issued exclusively by ENERGEN


S.A., which will be in charge of processing them.

1.2. Every person or company accessing the area should do it in order to


perform a job or commercial activity in the Port Facilities located in the jetty for
liquid bulk, or on board of the ships moored therein. The activity should be
directly related to the ship or to the activity performed in the facilities.

1.3. 1.3. Access authorization should be requested by the Ship-owner,


Maritime Agent and/or ship master when the people or companies coming in
should render a service to the ship or access it.

1.4. If the people or companies coming should perform tasks in the Jetty for
liquid bulk, the access request should be made by the company contracting
their services.

1.5. When the activity is to be performed at permit holder facilities, located in


the inner area of the jetty for liquid bulk, access request should be made by the
company or person responsible for the facilities where the jobs are to be
performed.

1.6. Access of people or companies will not be allowed if there is no previous


access request as stated in items 1.3.; 1.4. and 1.5.; and if requirements stated
in Annex I have not been accomplished.

1.7. Every person, before entering, should be identified and it will be checked
that there is an access authorization issued by the licensee.

1.8. Once the identity is checked and access is authorized, the person will be
allowed in and recorded, stating date and time of entry. When leaving the jetty
for liquid bulk, the date and time will be written down to close the corresponding
record.
1.9. The procedure stated above will be applicable to any person requesting
access, whether personnel of government organizations (PNA, Customs,
Migrations, etc.) the Consorcio de Gestión, Private companies (licensees, permit
holders, contractors, port service companies, etc.), trade unions, etc.

1.10. Emergency services staff (firemen, army and safety forces, ambulances
and any other duly designated) will be the only personnel exempted in terms of
identification when having to access upon an event that requires their
intervention.

2- PEOPLE ACCESS

Authorizations for people access will be issued according to the procedure


stated next and always meeting the provisions in Annex I herein:

2.1. The companies or vessels established or moored should request the


licensee the corresponding access authorization stating the reasons and time
they will be accessing.

2.2. The requests will be made by the company representative. In the case of
vessels, they will be made by the ship-owner, captain or maritime agent
involved.

2.3. For ship crews, the ship-owner, captain or maritime agent will keep the
people list updated during the stay, and communicate any addition or removal.
People who demand accessing a vessel will not be admitted if they are not in
the corresponding list or if there is no express authorization of the ship-owner,
captain or maritime agent of the vessel.

2.4. For the personnel of companies that has to work inside the permit
holders´ facilities or moored ships, the company will submit, in addition to the
items stated in Annex I, the list of people that will enter, they will keep it
updated, report any addition and removal, as well as the machines or means of
transport that will need to access to perform jobs ordered.

In the event that the person to be admitted is able to do so, having fulfilled
the requirements detailed above, the Access Security staff will give
him/her a numbered entrance card (VISIT), which must be worn at all times
and presented when requested. And the person will return the card when
leaving.

3 - NON AUTHORIZED PEOPLE

Every time a person comes to the Jetty access control and intends to get in
without authorization issued as stated herein, the access security personnel will
proceed as follows:

3.1. They will identify the person/s and will ask where they come from, where
they want to go and the reasons to do so.

3.2. They will inform ENERGEN S.A. (Access Area) immediately, who will give
the corresponding instructions.

3.3. Access will not be permitted until the corresponding authorization is


issued.

3.4. They will instruct people to clear the entrance area and wait until they are
authorized to enter.

4 - VEHICLE ACCESS

All transport vehicles(for people or cargo), machines or emergency services


vehicles can enter, circulate and/or park inside the terminal, if they do so while
performing a direct and/or indirect port activity and must in turn comply with the
admission requirements, as determined by these safety regulations.

They will have to respect the safety conditions established in the traffic
regulations and those of the jetty for liquid bulk like maximum speed, use of
flame arresters, safety belt of all its occupants, prohibition of use of cell phone
for the driver and any rules indicated to them.

4.1 - VEHICLE CONTROL

4.1. ACCESS

The personnel in the Access Control gates, before authorizing any access, will
have to inspect and control the vehicle, checking its documents and the vehicle
itself.

During the inspection and control process, the following items will be checked:

Regarding the vehicle and passengers documents, they will check that:

4.1.1. The driver and passengers, if any, are duly authorized to enter the Port
Area.

4.1.2. The driver has:

4.1.2.1. The vehicle identification card and that this card has his/her name.

4.1.2.2. The liability insurance and the corresponding premium proof of


payment.

4.1.2.3. The corresponding Verificación Técnica Vehicular (VTV, vehicle


technical verification) current certificate.

4.1.2.4. The corresponding technical certification of the compressed natural


gas, if applicable.

4.1.2.5. Valid driver´s license for the vehicle.

4.1.2.6. For passenger transport, cargo or other type of vehicles, the


authorization for the type and/or special service performed.

As regards the vehicle, the following will be checked:

4.1.3.1. That the vehicle is in perfect safety conditions, as provided in Act


11430 and supplementary rules (Traffic Code of the Province of Buenos Aires).

4.1.3.2. That both plates are in place and legible.

4.1.3.3. That the number of people in the vehicle does not exceed the
manufacturer´s provision.

4.1.3.4. That the vehicle and what it transports do not exceed maximum
required sizes and weights.

4.1.3.5. That the cargo being transported is well fastened to avoid any fall or
movement.

4.1.3.6. That the corresponding spark arrester is in place.

When required to inspect a vehicle, the drive should consider that the security
personnel will proceed as follows:

4.1.4.1. Using a mirror, they will check that no objects, packages, etc. are
transported in the lower part of the vehicle.

4.1.4.2. They will ask the driver to get out of the vehicle and open the trunk or cargo box.

4.1.4.3. They will inspect methodically searching for objects that do not belong
to the operation or vehicle involved.

4.1.4.4. They will ask the driver to open de vehicle doors and the glove
compartment.

4.1.4.5. They will proceed according to 4.1.4.3., checking carefully the inside of
the vehicle, under the seats, the sleeper cab (if applicable) and the glove
compartment

4.1.4.6. If anything suspicious or not belonging to the operation involved is


found, they will request the driver to take it out, make a statement of its use or
content and open it.

If the above documents are not handed in or the revision is not allowed, this will
be sufficient cause not to allow the vehicle in.

In the event that the vehicle is in a condition to do so, having fulfilled the
requirements detailed above, the gate staff will give the driver a numbered
entry card, which he/she must place in the vehicle in plain view at all
times. And he/she will return the card when leaving.

5. PARKING

5.2.1. Any vehicle that has been authorized to enter shall be parked in the area
permitted for that purpose, complying with the rules set out in point 4, sub-item
4.4.

5.2.2. Parking or stopping vehicles out of the specific area will not be allowed,
except for force majeure cases duly authorized by the Security personnel.

5.2.3. When vehicles parked or stopped out of the authorized area or that do
not observe the requirements in 4, section 4.4 are noticed, the security staff will
inform the driver accordingly and state in the Security Log the vehicle and driver
data, and will specify the violation.

The numbered vehicle entry card must be visible at all times when the
vehicle is parked.

5.2.4. In case of repeated non- observance of the rules set forth in this Annex,
by people entering with vehicles, the licensee will have the right to forbid their
access with vehicles, so that they will only we allowed to access on foot.

6. EXIT

6.1. When the vehicle leaves the jetty, the identity of the people going out will
be checked.

6.2. The vehicle will be controlled to check that no unauthorized elements are
being taken out.

6.3. Every time elements coming from facilities or ships are taken out, the
corresponding docket should be submitted, duly authorized and signed by the
person in charge; and its removal will be authorized after checking.

If the documents requested to the driver are not handed in or the vehicle
revision is not allowed, this will be sufficient cause no to allow the vehicle out
and to inform immediately the OPIP and PNA as applicable.

7 – Circulation inside the Port Facilities

The entrance of private vehicles and the pedestrian crossing of people not
belonging to the Concessionaire inside the PF is strictly forbidden.

7.1 Personnel from contractors, who carry out tasks on the dock or within the
Port Facility and who, as a result of transporting tools, cannot use the means of
transport to be supplied by ENERGEN S.A., may enter by means of the
contractor's vehicles. Both the personnel and the vehicle must be duly
authorized.

7.2 In the case of authorities, maritime agencies, crews, control companies,


pilots, and any other company affected by the operation of the ships, they must
use the transport vehicle that ENERGEN SA will provide for this purpose.

PROCEDURE TO CONNECT BIG HOSES

TRANSFER HOSES:

 Check for breaks, external deep cuts or damage in the metal mesh.
 Check the hydraulic test dates - Less than 1 year.
 When operating, check transpiration or minimum leaks

FOR CONNECTION:

 Once the ship is moored, in the appropriate position according to the


operating field on the right side of the manifold and the access ladder is
located, the grounding duct should be fixed to the ship and platform,
watching its continuity.

 Before coupling the big hoses into the ship deck manifold, the flanges
there should be checked. In case of any abnormal condition in the
coupling, the connection point should be taken to similar flanges by
means of an adapter spool.

 Once the coupling points in the ship deck are conditioned and the
operating range is verified, the big hose should be taken to the coupling
position with the ship or land boom.

 After the connection in land and to the ship deck manifold flange is made,
the corresponding valves will be opened.

 After checking all these maneuvers and the correct position of all the
valves that enable the ship lines, the authorization to start moving
product will be agreed with the Deck Officer and the land operations
responsible person.

DURING PRODUCT DISPLACEMENT:

 In the operation platform and throughout the entire loading and unloading
product process, an operator should check the proper operation of the
equipment, checking air tightness of connection flanges and the bending
curve of the hoses with the tide movements.

 During product loading and unloading, in the operation platform, the


operator should check any possible ship movement (adrift or lateral) and
any weather event that may compromise the operation scope. In this
case, the operator will communicate with the deck officer and the
operation chief of the company in charge of the product transfer and they
will proceed to interrupt the process.
 Product movement work pressures should be controlled permanently,
checking that they do not exceed the manufacturer´s maximum allowed
pressure. If this value is exceeded, pressure should be decreased
immediately, or movement should be interrupted.

LOADING COMPLETION - BIG HOSE DISCONNECTION:

 Before starting the maneuvers to remove the liquid from the hose, it is
necessary to inform the Deck Officer so that he/she can carry out his
operating procedures, and he must notify the loading master and the
plant.

 Hoist the disconnected end so that there are no pockets.

 In that position, open the ship valve. Once the liquid is unloaded, the
hose is taken out from the ship and all hose sections are taken to land.

COMMENTS:

Once the loading or unloading of the product to the ship is finished,


disconnected the hose or hoses, the time of use of the post in this operation is
considered finished.

The following additional operations should be carried out when using hexene
and octane transfer hoses:

FOR CONNECTION:

 Once the hoses are coupled between the platform and ship connection
points, the air tightness of the system should be checked by pressurizing
it with Nitrogen at P: 7 kg. / cm2.

FOR DISCONNECTION:

 Once the loading or unloading is finished, the liquid will be flushed with
nitrogen. After checking there is no product between these two points,
and after inertizing the system, the hose/s will be disconnected and they
will be taken to the platform with a crane or post on board and slings.

 Upon completion of the loading, hoisting and moving of hoses to the


platform using a crane or post on board is not allowed if a loading arm
used for transfer of other liquid product is connected".

OF THE CONSORCIO DE GESTIÓN DEL PUERTO DE BAHIA BLANCA

Port of Bahía Blanca, July 2, 2001.

RESOLUTION NUMBER 10 - CGPBB/01:

Having regard to item a) of Section 12 of Decree Number 769/93, ruling the Port Activity Act
Number 24093, which sets as purpose and function of the entities that manage, among others, the Port
of Bahía Blanca, any activity related to services rendered to ships operating in its jurisdiction and

WHEREAS

According to item i) of Section 7 of Chapter III of the bylaws approved by Provincial Act
Number 11414, the Consorcio de Gestión del Puerto has to coordinate the different services rendered,
among others, to ships.

According to the provisions in item n) of the same Section 7 above mentioned, the Consorcio
de Gestión has the function to provide the appropriate means by dictating the corresponding measures,
tending to optimize the efficiency of the port service in its area of operation, in order to reduce port
costs.

In general, the jetties in the jurisdiction of the Consorcio de Gestión del Puerto de Bahía
Blanca do not have fixed facilities for fueling ships, and this operation has to be made by mooring a
smaller ship and/or authorized naval vessel.

Also, supply of materials such as lubricants, spare parts, provisions and general items are
supplied using boats and naval vessels.

According to the provisions in Maritime Ordinance Number 8/98, in its Annex 18, the
companies that render the fueling system to ships using boats must meet the guidelines to prepare
emergency plans and should be approved by the Prefectura Naval Argentina.

With respect to the above mentioned port operations and activities, it is necessary to establish
a procedure for the performance of the task, respecting the safety and hygiene rules in force.

Therefore, as established in Act Number 329 in the Board Book of Records Number 5, of the
meeting held on day June 11, 2001,

BLANCA
HEREBY DECIDES TO:

SECTION 1: Authorize the supply of fuel, lubricants, spare parts, provisions and/or general supplies to
the ships that operate in the jetties and berths located in the jurisdiction of the Consorcio de Gestión del
Puerto de Bahía Blanca through operations from ships and/or naval vessels to other ships.

SECTION 2: The maritime agent and/or ship-owner and/or naval vessel that needs to perform the
operations included in Section 1 of this Decision, will inform the Consorcio in written, before the
operation, the name of the ship to be supplied, the identification of the supplier´s means of transport, the
product and the quantity, supplying company, execution estimated time, date, estimated time and
operation berth.

SECTION 3: The maritime agents should report in written to the companies in charge of implementing the
PLANACON (in each berth) the beginning of the fuel supply by boat.
A copy of this information should be retransmitted to the terminal communicating, also, the name of the
company that renders the service.

SECTION 4: The companies in charge of performing the tasks mentioned in Section 1 of this Resolution,
should be previously registered at the Consorcio de Gestión del Puerto de Bahía Blanca, and should
observe the corresponding requirements, and should also observe the safety and hygiene rules established
by the “Consorcio de Gestión”, the licensees of the Terminals and/or Prefectura Naval Argentina, in their
corresponding competence area.

SECTION 5: In the case of ships loading/unloading goods, when anticipated that the operations may
extend their stay in the Port, the ship-owner and/or maritime agent and/or ship captain, should request with
sufficient prior time, the authorization to the Licensee Terminal and the approval of the Consorcio. The
latter will decide to extend the term or to change the ship to another berth. The Terminal may object the
operation before the “Consorcio de Gestión”, in the cases and for the reasons that justify the action, and
the Consorcio will make the corresponding decisions.

SECTION 6: The Consorcio will be in charge of analyzing and defining any restriction or modification of any
type that, due to the nature of the operations, may affect any of the jetties and/or berths in its jurisdiction.

SECTION 7: It is ordered that it be recorded & published in the Boletín Oficial of the Province of Buenos
Aires, Be it thus notified to the Sea Center of Bahía Blanca, Port Terminals and Prefectura Naval Argentina
and closed.

FIRE PROCEDURE:

1. Purpose:

Highlight the steps and evacuation strategy to be followed by personnel


directly affected by this fire role, easing performance and detailing the
different alternatives that may occur due to the emergency.

2. Scope:

3. Responsibilities of emergency operations:

Each company shall activate and implement its actions according to their
respective Emergency Procedures, taking up the corresponding steps to
ensure the emergency response, which should include the immediate
notification to the Pumps Room to trigger the activation of the fire service
and the corresponding notification to PNA for its intervention.

Each mentioned Company should add this role to its Emergency


Procedures.

The emergency procedure of each company must be available and must


be sent to the licensee of the jetty for liquid bulk to be attached to these
safety rules.
It should be revised annually or when an event arises that tests it.
The licensee must coordinate with all the companies to carry out drills to
test the proper functioning of the system.

4. Development:

4.1. Incipient stage of the fire: In case of an incipient fire, it is crucial to


prevent it from turning into a large fire. Therefore, it is paramount to
attack it immediately, either to extinguish it or at least to prevent it from
spreading to other facilities while waiting for external resources.
Therefore, the first step is to try and put the incipient fire off with the
extinguishing methods available at the site.

The first actions to take are:

 Press the command button that acts the fixed fire network.
 Report the alarm to the Firefighting Pumps Room.
 Report the alarm to the Prefectura Naval Argentina (PNA).

The Fire Fighting Room Operator shall initiate the necessary internal
procedure to maintain and ensure the proper functioning of the System.

4.2. Means of communication with the Firefighting Pumps Room:

4.3. Manual firefighting equipment:

Minimum manual and rolling protection equipment shall be provided.

They shall be extended according to the specific risks of each product,


defined by each Licensee operating this product and being responsible
for the necessary mobile fire extinction (minimum manual and rolling
equipment).

The following are considered minimum manual and rolling equipment:

 1 extinguishing cart, 70 kg dry chemical dust.


 2 portable extinguishers 10 kg dry chemical dust each.
 1 5-minute self-contained breathing apparatus.

4.4. Monitor Network Positioning and Communications Rehearsal:

Prior to the beginning of ship loading/unloading operations, the following


must be done:

 Position network monitors.


 Inform the Firefighting Pumps Room operator of the beginning
of operations through the communication means selected
according to section 4.2.
 Inform the ENERGEN S.A. about the beginning of operations.

4.5. Roles and functions in Emergencies:

4.5.1. The Licensee operating at the time of an incident:

4.5.1.1. Should start the electric pump/alarm (or otherwise the electric
pump or motor pump via communication with the operator located at the
Firefighting Pumps Room) who starts the electric pump in the Fire
Fighting Room.

4.5.1.2. Once the fixed firefighting network installed at the jetty for Liquid
Bulk is pressurized, the Emergency Response shall be started according
to its Emergency Procedure.

4.5.1.3. Through the operational channel informed in a timely manner


prior to the operation, communicate to the ship the incident / crisis.

4.5.1.4. Order the interruption of the ship-shore or shore-ship product


transfer, performing the corresponding line blocking operations in the
points close to the emergency as per the Operative Procedures.

4.5.1.5. Inform the Prefectura Naval Argentina of the accident/crisis.

4.5.1.6. Keep the Firefighting Pumps Room informed, providing news of


the accident/crisis and the type of emergency via the communications
systems stated in 4.2 or requesting the startup or shutdown of the
firefighting pumps.

4.5.1.7. Keep the Jetty for Liquid Bulk Watch informed of the evolution of
the accident/crisis.

4.5.2. Licensee’s Access Watch:

4.5.2.1. Open both crossing gates to enable access to the Terminal


main viaduct.

4.5.2.2. Do not allow the entry of individuals not directly involved in the
resolution of the accident/crisis.

4.5.2.3. Allow entry of external responders and vehicles.

4.5.2.4. Have the Jetty Watch facilities set up as a meeting point.

4.5.2.5. Have an information log as to the number of people (name and


surname, company to which they belong) at the Liquid Bulk Jetty.

4.5.2.6. After the evacuation, people should be counted versus the log to
identify the individuals inside the Terminal.

4.6. Evacuation:

Each permit holder will apply its Evacuation Procedures, taking


responsibility for the means used and the control of its personnel.

4.7. Emergency Procedures:

Natural and/or legal persons who hold use permits in the Jetty for Liquid
Bulk should hand in to ENERGEN S.A their emergency plans as a prior
condition for the operation, which shall include at least:

 Personal data of the person/persons responsible for the


emergency action of the company.
 Safe communication means (cellphones, VHF, o other) to use in
the emergency, with numbers or frequencies to establish contacts.
 Procedures to implement in the emergency to consider emerging
risks based on the characteristics of handled products.

This information should be continuously updated. Any change in the


contacts and/or procedures should be immediately informed to
ENERGEN S.A. by a reliable notification.

4.8. Adaptation to these Regulations of the Valid Permits in Use:

The Permit holders listed in point 4.7. above shall comply with the
provisions of this Regulation within
(30) calendar days from its approval.

4.9. Liabilities for Damages of the Licensee and companies with


permits:

4.9.1. The Licensee - when taking part in the operation - and its
pertaining Permit Holder shall be joint and severally liable for damages
that are ascribable to mentioned operations.

4.9.2. When ENERGEN S.A. does not take part in the operation, the
Permit Holder and/or the Third Party to whom the operation was
entrusted shall be jointly and severally liable. Liability shall rest
exclusively with the Permit Holder when the operation is executed by the
Permit Holder itself.

4.9.3. Every company operating in the Liquid Bulk Jetty shall submit to
ENERGEN S.A. a risk analysis of its operations, identifying the accidents
that may take place (fire, spill, leak, etc.) the extent, and the actions to
take to mitigate their occurrence, identifying the necessary equipment for
the response.

The companies should include the safety sheets (MSDS) of the products
with which they operate.

The updates of the documentation shall be valid for one year. Any
changes made within this period must be reported within 30 days.

After said term expires, the company should update the documentation in
case there was a modification or present a note to the Licensee stating
that there was none.

ADDENDUM "CHARLIE" TO ANNEX II OF DECISION BBLA, CA6 Number


20/96 LOADING OF FUEL FOR CONSUMPTION ON BOARD SUPPLIED BY
ANOTHER SHIP WILL OBSERVE THE FOLLOWING ACCIDENT AND
CONTAMINATION PREVENTION STANDARDS

1) It will fill in the checklist established by Maritime Ordinance 1/93.


2) The area 30 meters wide around both vessels, in addition to the area of the
ships involved, will be considered "safety zone".
3) The operation will be performed only in port areas considered "fit and safe"
for this type of operations.
4) Smoking will be forbidden in the "safety area". Signs will be installed alerting
people of this condition, both in Spanish and in English and with a proper font
size.
5) During the loading operation there will be a permanent watch keeping of one
additional fireman, who will verify the observance of the corresponding safety
rules and regulations in force.
6) Every safety measure stated under Title 4 Chapter 8 Section 8 of the
REGINAVE will be observed.
7) Both ships will have their "firefighting system" ready to operate and their
pipelines pressurized, with two lines of hoses laid over the deck, one on the
stern side and the other on the bow side of the loading connection.
8) Both ships will be connected by electrical radio, and will inform the Coast
Station of Prefectura Bahía Blanca (L2N) the operation starting and ending
times.

9) The maritime agency involved should notify both ships´ command every
safety and contamination prevention measures in force, and the captains of the
ships involved will be responsible for any damage or environmental impact
resulting from the operations.
10) The ships should be appropriately signaled in order to alert about the risky
task in progress.
11) It is forbidden to perform spark generating tasks or “hot works” as stated in
the REGINAVE in the "safety zone" during the fuel loading operations.
12) Fuel transfer operations to gas tankers will be made exclusively with fixed
facilities or by truck, observing the international safety recommendations on the
topic.
13) During transfer operations, it is forbidden to load/unload the ship, except
when the ship supplying the fuel is on the bow of the cofferdam of the ship
pump room receiving the fuel. This safety measure will not be applicable when
the ship receiving the fuel is a general cargo ship with no hazardous goods.

Jetty for liquid bulk: With prior authorization of the Consorcio de Gestión del

WILL OBSERVE THE FOLLOWING ACCIDENT AND CONTAMINATION


PREVENTION STANDARDS
1) It will fill in the checklist established by Maritime Ordinance 1/93.
2) A "safety zone" will be identified in the jetty, along the length of the ship and
30 meters away from the ship.
3) No people outside the operation will be authorized to enter the “safety
zone".
4) It is forbidden to perform spark generating tasks or “hot works” as stated in
the REGINAVE in the "safety zone" during the fuel loading operations.
5) During the loading operation there will be a permanent watch keeping of one
fireman, who will verify the observance of the corresponding safety rules and
regulations in force.
6) Collection trays or containers for the same purpose will be placed at the
hoses joints, under the every flange where there is fuel circulating.
7) The maritime agency involved should notify the ship´s command and the fuel
supplying company every safety and contamination prevention measures in
force, and the Master or the person in charge of the truck will be responsible for
any damage or environmental impact resulting from the operations.
8) The ship will have its "firefighting system" ready to operate and its
pipelines pressurized, with two lines of hoses laid over the deck, one on the
stern side and the other on the bow side of the loading connection.
9) The fuel transport truck should be technically fit according to the provisions
of the Secretariat of Transport of the Nation, to they should submit evidence of
authorization and should have fire extinguishers appropriate for the risk.
10) Smoking will be forbidden in the "safety zone" and on board the ship, out
of the areas authorized for that purpose. Signs will be installed alerting people
of this safety measure, both in Spanish and in English and with a proper font
size. The number of signs will be one that ensures spreading the prohibition in
the entire "safety zone".
11) The ship should be appropriately signaled in order to alert about the risky
task in progress.
12) This Maritime Authority will stop the operations when it considers that the
minimum safety conditions for this type of operation are not observed.

ANNEX XII

WASTE MANAGEMENT:

In order to control the observance of the Waste Management Plan,


implemented by ENERGEN S.A., the companies will follow this procedure:

1. Any company that enters to carry out work, whether on land or on board ship,
and that as a result of its activity generates special waste that cannot be
deposited in the containers that ENERGEN SA has in the port facilities, must
have containers prepared for this purpose for the time the work requires.

They will have a cover. Otherwise, the work shall be stopped immediately
until the corresponding containers are available.

2. When entering the container, the carrier should show at Access Control a
docket stating the container content, in the form of sworn affidavit. The carrier
will access the Port Facility and upon leaving will hand in a copy of the Docket
signed by the person who received the container.

The Docket shall include the following information:

2.1. Name, address and telephone of the company rendering the service.
2.2. Number of authorization or Record issued by the PNA.

2.3. Data of the Transport (nameplate of the truck) and driver (Last name,
first name and identity card).
2.4. Container access date and number.
2.5. Name, address, telephone of the company, maritime agency or
ship-owner that requested the service.

2.6. Name of the facility, ship, site or work it is assigned to.


2.7. Signature and printed name of the person receiving the container.
2.8. All data in the Note will be considered affidavits (as applicable under
section 292 and following section of the Criminal Code).

2.9. The container number must be stamped or painted on all four sides
of the container, must be fully legible and must match the number
indicated on the Note.

3. Once the container has been entered, it shall be placed in the closest
position to the work area, ensuring that it does not hinder the free movement of
vehicles that must move around the site, those affected by the loading and/or
unloading of the vessel or other vessels berthed in the area, emergency
vehicles that may act in the event of an accident, and loading and/or unloading
operations carried out in the vicinity.

4. The necessary measures must be taken to prevent household waste from


being thrown in the same container as other waste that is not household waste.

5. At no time should quantities of waste be thrown that cause the container to


overflow or exceed its walls. Once its capacity is complete, the container must
be removed immediately.

6. The exit of the container will only be authorized if it is suitably covered, in


such a way that it guarantees that during its transfer to the place of final waste
disposal, no type of waste fall and/or blast to the public road will take place.

7. When taking away the container, security personnel at the Access control will
record this in the docket in their post, stating exit date and time on the back and
will require the transporter to sign, stating his/her name and ID type and number
and they will state in the docket the final destination of wastes, also as written
affidavit.

8. Monthly, the company that has hired the container or the company in charge
thereof, shall deliver a copy of the delivery/unloading receipt at the
corresponding final disposal site.

9. If this requirement is not observed, the Licensee will file, within a prudential
time, the corresponding complaints before the appropriate organizations.

SPECIFIC ENTRY CONDITIONS FOR CONTROL

COMPANIES AND COMPANIES OPERATING WITH


HAZARDOUS PRODUCTS

Any Company that must carry out work as a control company and/or operate
with hazardous goods, for itself or tasks on behalf of third parties, on behalf of
the Consorcio de Gestión del Puerto de Bahía Blanca, ENERGEN S.A., or any
other Company that is located within it, must also comply with the general
requirements established in these Rules, as appropriate, with the presentation
of the following documentation, which is obligatory:

CONTROL COMPANIES REQUIREMENTS:

1. Copy of the authorization by the Prefectura Naval Argentina as control


company.
2. Annual record of registration before the Consorcio de Gestión del Puerto de
Bahía Blanca.
3. Identification of the type of products to be controlled (solid bulk, liquid bulk,
hazardous products, etc.).
4. Payroll.
5. Safe Task Plan approved by ART and endorsed by the professional
association corresponding to the signature of the acting professional.
6. Identification of the person responsible for the health and safety of the company.
7. Copy of the registered license of the person responsible for the health and
safety of the company.
8. Identification of the company’s technical manager.

THE COMPANIES OPERATING WITH HAZARDOUS PRODUCTS


(HYDROCARBONS, CHEMICALS, etc.) SHOULD REPORT AND PROVE:

transportation (note signed by the company’s authorities).
11. Description of the transport means to be used.
12. Authorization by the Bahía Blanca Municipality in case of sending the

company where it expresses what type of merchandise is the one that is able to
handle the mentioned personnel. Document issued by the company stating the
capacity or the authorization for said personnel to perform the specific activity.
