Individualised Learner Record (ILR) Privacy Notice

This privacy notice is issued by the Education and Skills Funding Agency (ESFA) on behalf of the Secretary
of State for the Department of Education (DfE) to inform learners about the Individualised Learner Record
(ILR) and how their personal information is used in the ILR. Your personal information is used by the DfE to
exercise our functions under article 6(1)(e) of the UK GDPR and to meet our statutory responsibilities,
including under the Apprenticeships, Skills, Children and Learning Act 2009.

The ILR collects data about learners and learning undertaken. Publicly funded colleges, training organisations, local
authorities, and employers (FE providers) must collect and return the data to the ESFA each year under the terms of a funding
agreement, contract or grant agreement. It helps ensure that public money distributed through the ESFA is being spent in line
with government targets. It is also used for education, training, employment, and well being purposes, including research. We
retain ILR learner data for 3 years for operational purposes and 66 years for research purposes. For more information about

As a publicly-funded learning provider we are expected to provide data to underpin funding and commissioning decisions, as well as inform
the work of Ofsted/Office for Students (OfS) and other government agencies.
Data is used to calculate funding, monitor performance against a contract and measure the effectiveness of learning.
We are required to send data for all learners, including learners studying a commercial course not funded by the ESFA/GLA.

• we will provide information about your progress, attainment and attendance to your parent(s)/carer(s) while you are
enrolled on a programme of study and for up to one year after your actual end date
• we will share details with Local Authorities and youth support services as they have responsibilities in relation to the
education or training of 13-19 year olds under section 507B of the Education Act 1996
• if you are an apprentice, we will provide information about your progress, attainment and attendance to your employer
while you are enrolled on a programme of study and for one year after your actual end date

• we will provide information about your progress, attainment and attendance to the Office for Students, Students Loan
Company, sponsor and/or employer as appropriate while you are enrolled on a programme of study and for one year
after your actual end date

not use your data for any other purpose not connected to your programme of study and they will not contact you

• in the event of a cause for concern, accident or medical emergency we will contact the person you have provided as

information is not shared
