EDUCATION AND TRAINING


Law Enforcement (Powers and Responsibilities) Act 2002

When a police officer activates the body worn video (BWV), they must inform the persons they
are exercising their powers and responsibilities (LEPRA) to who they are, their rank, surname,
the station they work at or their specialist role. It goes as follows

Starting the conversation with, hi, hello, hey, hey mate, good morning, sir etc

“My name is Senior Constable Lane from the (AOP) Police.” For example - Bankstown police,
Ryde police, Wilcannia police, Nowra police, Sutherland police etc, (when you are Sydney City,
say from Day Street Police Station.

“I have just activated my body worn camera, and it’s recording our conversations and actions”
“I am wearing a body-worn video camera, and it’s recording our conversations and actions.

Any of these sentences are acceptable to use.

At this time you will then proceed with the reason why you have approached the POI.

“So I have stopped you today for the purpose of a Roadside Breath Test”
“I have stopped you today sir, because you proceeded through a red light, back there at
Parramatta Rd, etc”

In summary, it is said as follows; Rank / surname > Body Worn Video > Exercising powers

CAUTION
Law Enforcement (Powers and Responsibilities) Act 2002

When an arrest is made, and a POI is taken into custody a police officer MUST caution that
person. This is the official NSW Police Force caution taken from LEPRA (Law Enforcement
Powers and Responsibilities Act). It is as follows;

You have been arrested for (offence) eg; You are under arrest for Police Pursuit, you don’t have
to say or do anything if you don’t want to, anything you do say or do will be recorded as
evidence / used at a later day.

Ask the POI if they understand, do you understand? Yes / No If the POI says that they do not
understand, explain this again, be assertive, don’t be undermined.

RBT | RANDOM BREATH TEST | ROADSIDE BREATH TEST

All police officers conduct RBTs, with or without HWP training.

When submitting a driver of a motor vehicle to a RBT

“I’m going to submit you to a Roadside Breath Test, have you done one of those before?”
“I now require you to undergo a breath test etc”
Ask the driver if they have had anything to drink; “Have you had anything to drink today mate?
Etc”

(NOTE it is an offence to refuse a breath test. The charge is Fail or Refuse Breath Test

“Just count from one to ten into the device for me please sir”
“Blow into the tube until I say stop” “Keep going, keep going, keep going, etc” STOP”

Use the /e alco, and if the breath test script is working use /btest and follow the commands of
the alcolizer. Power button, up and down arrows etc to reset alcolizer. If not, please use /me or
/do for the driver to show the blood alcohol content level that the device reads.

For example; “What is the result?” /me 0.00, /me 0.09

(NOTE the alcohol limits are)

A mid range PCA offence is when a driver is found to have a BAC above 0.08 and less
than 0.15.

Low range PCA: 0.05-0.079


Mid range PCA: 0.08-0.149
High range PCA: 0.15+
(PCA stands for Prescribed Concentration of Alcohol

“OK, that came back all good”, if the POI is over the legal limit of 0.05, you must inform them
that they have blown over the legal limit, and ask them to accompany you back to the police
station for a secondary breath test. (NOTE it is also an offence to refuse this, the offence is Fail
or Refuse Breath Analysis). Please note that typically HWP deals with drink driving related jobs,
and as a courtesy, it is preferred if they are contacted / requested

Once a secondary breath test is conducted at the police station, the POI will then be charged
with the relevant offence/s or released if the result is negative.

URGENT DUTY DRIVING AND PURSUITS

When in pursuit of a vehicle, please use the following


In pursuit of ( describe vehicle, and rego in phonetics)

Say (for example) "In pursuit of white Ford falcon rego Charlie bravo, 27 Whiskey uniform etc”

Say Location, eg: “southbound on the M5 passing the off ramp to Bankstown etc. and provide postcode”
(IF needed)

Say traffic conditions and weather

“Traffic is light, weather is clear radio”

Say License Class and rank

“Silver class, Senior Constable”

Provide regular updates to radio in 30 second intervals or communicate with other cars to arrange stop
sticks, spikes etc.

Liaise with Highway cars etc, listen to instructions from radio, and terminate if requested or feel the need
to.

So as follows;

For example you have spotted a KLO4 vehicle traveling southbound on the freeway, from a job in a
nearby PAC you heard over radio,

Ryde 37 radio, “what was that Keep a lookout for”

“Ryde 37 it was a white ford falcon charlie bravo 27 whiskey uniform believed to have been stolen from
Top Ryde shopping centre earlier in relation to a shoplifting incident etc”

“Yeah radio, we’ve got that heading south on the M5, single male, caucasian appearance, just trying to
catch up with the vehicle now.”

“Ryde 37 radio in pursuit, southbound Victoria Road, just passing Gladesville hotel, traffic is light, weather
is clear, Constable rank, silver class license”.

“Radio any highway cars able to go up ahead to (location) with spikes etc?”
