ISA ELECTRONIC MEDIA

INDIVIDUAL LICENSE AGREEMENT

ISA IS PLEASED TO PROVIDE YOU WITH A LICENSE TO THE CONTENT OF THE ISA
COPYRIGHTED STANDARDS LIBRARY YOU ARE ACCESSING ON THE FURNISHED ELECTRONIC
MEDIA. ISA GRANTS ONLY A LICENSE TO THIS MATERIAL. YOU MAY ACCESS THE ISA
STANDARDS LIBRARY UNDER THIS LICENSE AS LONG AS YOU COMPLY WITH THE LICENSE
TERMS AND CONDITIONS SET FORTH BELOW. PLEASE READ THE LICENSE TERMS
CAREFULLY. IF YOU DO NOT AGREE WITH ANY OF THE TERMS, YOU MAY RETURN THE MEDIA
PACKAGE WITHIN TEN DAYS AND RECEIVE A FULL REFUND OF YOUR LICENSE FEE.

License Terms and Conditions

This is a license for one individual user. This is not a license for multiple users, a library, a network, or any
other means by which someone other than the licensed user may access the information. (If you want a
multi-user license, please contact ISA.)

License Granted

You may:

• Install and use the ISA Standards Library in its intended manner on any computer as long as only you
access and use the Standards Library after installation.

• Print on paper all or part of the ISA Standards Library, but only to the minimum extent necessary for
your reasonable personal use and reference.

You may not:

• Install the ISA Standards Library on a network (including an intranet or extranet) or other means
whereby others may access the Standards Library.

• Transfer or sublicense this license or loan the Standards Library or media to others.

• Modify the ISA Standards Library or the software needed to use it electronically in any manner.

• Print, or copy by any other means including photocopying, all or part of the ISA Standards Library for
other than your personal use or reference.

• Distribute or provide copies of any part of the ISA Standards Library, either in print or electronically, to
others.

Your license to use this ISA Standards Library will end if you violate the license or you elect to terminate it
by returning all copies to ISA or destroying all copies that you may have.

Update Policy

ISA may offer updated or enhanced versions of the ISA Standards Library. If you receive an update, your
license to this edition expires and you must destroy all copies of the prior version.

Warranty

The ISA Standards Library on electronic media is provided “as is” without warranty of any kind, expressed
or implied, including but not limited to any warranties of merchantability or fitness for a particular
purpose. ISA does not warrant that your use of the electronic media will be error-free or uninterrupted or
that it will meet any specific requirement you may have. It is solely your responsibility to verify the applica-
bility of the information for your intended use.
Limitation on Liability and Remedy

ISA’s entire liability, and your exclusive remedy, is limited to replacement of the ISA Standards Library or a
refund of the license fee paid.

ISA will not be liable to you for any special, incidental, consequential, or exemplary damages, including
damages for lost time, lost profits, and computer problems, even if ISA has been informed of the possibility
of such damages. In no case will ISA’s liability exceed three times the license fee paid, even if the exclu-
sive remedy is deemed inadequate.

General

This license will be governed by the laws of the State of North Carolina as if wholly performed and exe-
cuted in that state.

This is the entire agreement of the parties and supersedes all prior communications between the parties.
This license may not be modified except in writing signed by an authorized representative of ISA.

You acknowledge that you have read this license, understand it, and agree to be bound by it.

Notice

ISA adheres to the policy of the American National Standards Institute with regard to patents in standards.
If ISA is informed of an existing patent that is required for use of the standard, it will require the owner of
the patent to either grant a royalty-free license for use of the patent by users complying with the standard
or a license on reasonable terms and conditions that are free from unfair discrimination.

Even if ISA is unaware of any patent covering a standard, the user is cautioned that implementation of the
standard may require use of techniques, processes, or materials covered by patent rights. ISA takes no
position on the existence or validity of any patent rights that may be involved in implementing the standard.
ISA is not responsible for identifying all patents that may require a license before implementation of the
standard or for investigating the validity or scope of any patents brought to its attention. The user should
carefully investigate relevant patents before using the standard for the user's intended application.

However, ISA asks that anyone reviewing any ISA standard who is aware of any patents that may impact
implementation of the standard notify the ISA Standards and Practices Department of the patent and its
owner.

Additionally, the use of standards may involve hazardous materials, operations or equipment. Standards
cannot anticipate all possible applications or address all possible safety issues associated with use in haz-
ardous conditions. The user of ISA standards must exercise sound professional judgment concerning its
use and applicability under the user's particular circumstances. The user must also consider the applica-
bility of any governmental regulatory limitations and established safety and health practices before imple-
menting any standard.
