This “Qingdao Port Constitution”, formulated by Port and Shipping Authority of
Qingdao in accordance with the provisions of the “Port Law of the People’s Republic
of China”, informing and describing the general situation, establishment scheme,
management and serving ability of Qingdao Port and announcing the specific
measures of Qingdao Port to implement the laws, rules and regulations on port
administration of China and other relevant provisions of the competent authorities of
transportation and communications under the State Council, is hereby promulgated.

Chapter I Port Location and Areas

Article 1 Port Location

Qingdao Port lies at the southeastern of Shandong Peninsula of China. Its


geographical coordinate is 120°19′05″E, 36°05′20″N. The existing berths lie mostly
in Port Areas of Old Port, Qianwan Port, Huangdao Oil Port. The planning Port Areas
consist of Sifang Port, Aoshanwan Port, Dongjiakou Port, Haixiwan Port.

Article 2 Existing Water Areas

1. Old Port
An area bounded by the lines joining the following four points.
120°19′03″E,36°06′42″N; 120°18′15″E,36°07′12″N;
120°16′30″E,36°04′18″N; 120°18′00″E,36°04′20″N.

2. Qianwan Port
An area bounded by the lines joining the following three points.
120°13′41″E,36°02′19″N; 120°15′29″E,36°02′10″N;
120°16′57″E,36°00′48″N.
3. Huangdao Oil Port
An area bounded by the lines joining the following eight points.
120°08′01″E,36°06′17″N; 120°08′55″E,36°07′24″N;
120°12′38″E,36°05′24″N; 120°14′03″E,36°05′01″N;
120°15′07″E,36°03′43″N; 120°15′07″E,36°02′23″N;
120°14′25″E,36°02′23″N; 120°13′49″E,36°02′55″N.

Article 3 Land Areas

1. Old Port
The limit is from Hangzhou branch Road in the north, along Changle River and
the west of Qingdao Railway Station to Puji Road, connected with Qinghai Road and
Xinjiang Road, reaching to the south shore of Xiaogangwan in the south.
2. Qianwan Port
The limit is from the north shore of Qianwan operation area in the north, across
Lianwan River southwestwardly to Jiangshan middle Road, reaching the edge of
Qingdao Free Trade Zone along Jiangshan middle Road, through Dajianshan to the
south of Xianlangzui.
3. Huangdao Oil Port
The east limit is from the road behind the Oil wharf II, extending northwardly to
the coast, and the north limit is from the road behind the Oil wharf I, extending
westwardly to the coast.
4.Sifang Port (Planning)
The north limit is the estuary of Licun River. The east limit is from the west of
Sewage Plant to the west of Jiaoji railway, reaching the estuary of Haibo River along
west of Qingdao Power Station.

5.Aoshan Bay Port (Planning)

This area is from Huangbu Shoal, along the bottom of the bay, reaching Nudao
teminal nearby. The limit is from Huangbu Shoal in the west, along Binhai Road, to
Xifeng Mountain nearby in the north, through the west of Wenxi Mountain’s and
Heshang Mountain, reaching the north of Nudao in the east opposite to the
Longkoudao.

6.Dongjiakou Port (Planning)


The limit is from western shore of Dongjiakou Peninsula, through Langyatai
Bay, to the eastern of Hujia Mountain along Binghai Road.

7.Haixi Port (Planning)


The limit is from Xianlangzui in the north, along the west of Lianjiang Road
southwardly, through residential area, reaching the north of Fishery Wharf along the
bottom of Grand Shipyard’s planning area.

Article 4 Port Navigation Channels

1.Exterior Channel of Qingdao Port


1.1.Fairway of Qingdao Port
It is from 35°56′24″N,120°46′42″E to 36°02′04″N,120°15′51″E towards
283°(103°). The length is 25.5 n mile, the width is between 1.5~2.7 n mile and the
depth is above 15.7 m .The quality of bottom is mud and sand.
1.2.No.1 Route
It is from 36°17′32″N,120°58′26″E to 35°58′12″N,120°36′54″E towards
222° ( 042° ) , joining the fairway of Qingdao Port. The length is 26.0 n mile, the
width is 1.8 n mile and the depth is above 13.0 m . The quality of bottom is mud and
sand.
1.3.No.1 Reserved Route
It is from 36°07′04″N,121°04′48″E to 35°58′12″N,120°36′54″E towards
248° ( 068° ) , joining the fairway of Qingdao Port.The length is 24.0 n mile, the
width is 2 n mile and the depth is above 26.0 m . The quality of bottom is mud and
broken rock.
1.4.No.2 Route

It is from 35°56′24″N 、 121°05′00″E to 35°56′24″N 、 120°46′42″E towards
270° ( 090° ) , joining the fairway of Qingdao Port. The length is 15.0 n mile, the
width is 3.2 n mile and the depth is above 28 m .The quality of bottom is mud and
broken rock.
1.5.No.3 Route
It is from 35°43′15″N,120°53′09″E to 35°56′24″N,120°46′42″E towards
338°(158°), joining the fairway of Qingdao Port. The length is 14 n mile, the width
is 2.8 n mile and the depth is above 28 m .The quality of bottom is mud and shell.
1.6.No.4 Route
It is from 35°45′00″N,120°06′30″E to 35°57′12″N,120°21′24″E towards
045°(225°), reaching 36°01′18″N,120°20′00″E towards 344°(164°), joining the
fairway of Qingdao Port. The length is 21.5 n mile, the width is 1.0 n mile and the
depth is above 16 m .The quality of bottom is mud.
1.7.Laoshan Tour Route
It is from 36°03′24″N,120°19′18″E to 36°03′12″N,120°18′48″E towards
144° ( 324° ) , to36°01′39″N, 120°20′18″E towards 078° ( 258° ) , to
36°02′42″N,120°26′40.8″E towards 094° ( 274° ) , to 36°02′10.8″N,120°35′40.8″E
towards 039°(219°), to 36°07′30″N,120°41′00″E and to 36°08′00″N,120°40′06″E
(Taiqinggong Wharf). The length is 22 n mile, the width is 200 meter, and the depth is
above 22 m .
2.Interior Channel of Qingdao Port
2.1.Dagang Channel
It is from 02′02″N,120°15′58″E towards016° ( 196° ) ,to
36°04′57″N,120°17′00″E course 074° ( 254° ) ,entering the Dagang. The length is
4.5 n mile, the width is 210 ~ 900 meter and the depth is above 10.5 m. The quality of
bottom is mud and sand.
2.2.Reserved Route
It is from 36°01′53″N,120°16′41″E towards300° ( 120° ) ,to
36°02′33″N,120°15′15″E towards 010°(190°),to 36°04′18″N,120°15′39″E towards
090°(270°),to 36°04′18″N,120°15′44″E joining Dagang Channel. The length is 4 n

mile. The depth is above 12 m. The quality of bottom is mud and sand.
1.3.Huangdao I Oil Wharf Route
(A)West Berth Route
It is from 36°02′04″N,120°15′51″E towards 326° ( 146° ) ,to
36°04′45″N,120°13′38″E towards 232°(052°),to 36°04′26″N,120°13′08″E towards
144°(324°), reaching the wharf. The length is 4.2 n mile. The depth is above 10 m.
The quality of bottom is mud and sand.
(B)East Berth Route
It is from 36°03′54″N,120°14′20″E towards 270° ( 090° ) ,to
36°03′54″N,120°14′00″E towards 292°(112°), reaching wharf. The length is 0.75 n
mile, the depth is above 10 m. The quality of bottom is sand and shell.
1.4. Huangdao II Oil wharf Route
It is from 36°02′04″N,120°15′51″E towards 310° ( 130° ) ,to
36°02′56″N,120°14′31″E. The length is 1.3 n mile. the depth is above 20 m. The
quality of bottom is mud and sand.
1.5.Qianwan Port Route
It is from 36°02′04″N,120°15′51″E towards 248° ( 068° ) ,to
36°01′27″N,120°14′00″E, entering the harbor. The length is 1.6 n mile.The depth is
above 15 m. The quality of bottom is mud and sand.
1.6.Ferry Route
It is from Qingdao Ferry Station 36°04′03″N,120°17′35″E towards
240° ( 060° ) , to 36°02′39″N,120°14′34″E towards 270° ( 090° ) , reaching
Huangdao Ferry Station. The length is 3.8 n mile.The depth is above 5 m. The quality
of bottom is mud and sand.

Article 5 Port Anchorages

1. Pilot Station:
A round area with the position of 36°02′00″N,120°18′16″E as its centre and a
distance of 3 cables as radius.
2.Inner Anchorage of Qingdao Port

An area bounded by the lines joining the following five points;
36°07’36”N,120°14’30”E; 36°07’36”N,120°16’40”E;
36°06’00”N,120°16’50”E; 36°04’18”N,120°16’30” E;
36°04’18”N,120°14’30”E.
3.Tanker Anchorage of Qingdao Port
An area bounded by the lines joining the following five points;
36°06’ 00”N,120°12’40”E; 36°07’36”N,120°13’13”E;
36°07’36”N,120°14’09”E; 36°05’04”N,120°14’08”E;
36°05’30”N,120°12’40”E.
4.Outer Anchorage No.1 of Qingdao Port
An area bounded by the lines joining the following four points;
36°00′46″N,120°20′41″E; 36°00′46″N,120°21′58″E;
36°00′12″N,120°20′51″E; 36°00′12″N,120°21′42″E.
5.Outer Anchorage No.2 of Qingdao Port
An area bounded by the lines joining the following four points;
35°57′30″N,120°21′54″E; 35°57′30″N,120°22′42″E;
35°58′54″N,120°21′24″E; 35°58′54″N,120°23′36″E.
6.Outer Anchorage No.3 of Qingdao Port
An area bounded by the lines joining the following four points;
35°57′30″N,120°24′30″E; 35°57′30″N,120°26′30″E;
35°58′54″N,120°25′18″E; 35°58′54″N,120°27′18″E.
7.Temporary Anchorage
A round area with the position of 36°04′42″N,120°14′15″E as its centre and a
distance of 500 meter as radius.

Chapter II Port Facilities

Article 6 Navigational Aids

Qingdao Port owns 145 public navigational aids, including 8 lighthouses, 26


light beacons, 2 leading lights, 2 beacons, 87 light-buoys, 3 light vessels, 2 foghorns,
1 RBN/DGPS station, 1 AIS base station, 1 AIS monitor center and 12 radar
responder beacons.
Qingdao Port owns 44 special navigational aids, including 4 leading lights, 17
light beacons,18 light-buoys and 5 buoys.

Article 7 Terminal Facilities and Machinery Equipments

Qingdao Port owns 78 productive berths in total, including 46 berths of 10,000


ton capacity and above. The total length of all productive berths is 15683m. The
maximum designed mooring capacity is 200,000 ton.
Main special berths and equipments are as follows.
1.1. Exclusive Container Berths and Equipments
Qingdao Port owns 14 exclusive container berths, all of which are 10,000 ton
capacity and above. The maximum designed mooring capacity is 100,000 ton.
Qingdao Port owns 44 portainers. The maximum producing efficiency is 70 teu/hour.
1.2. Exclusive Ore Berths and Equipments
Qingdao Port owns 2 exclusive container berths, all of which are 10,000 ton
capacity and above. The maximum designed mooring capacity is 200,000 ton.
Qingdao Port owns 3 ship unloaders. The maximum producing efficiency is 2500
ton/hour.
1.3. Exclusive Coal Berths and Equipments
Qingdao Port owns 2 exclusive container berths, all of which are 10,000 ton
capacity and above. The maximum designed mooring capacity is 50,000 ton. Qingdao
Port owns 2 ship loaders. The maximum producing efficiency is 4500 ton/hour.
1.4. Exclusive Oil Berths and Equipments
Qingdao Port owns 3 exclusive container berths, all of which are 10,000 ton

capacity and above. The maximum designed mooring capacity is 200,000 ton.
Qingdao Port owns 13 loading arms. The maximum producing efficiency is 4000
ton/hour.

Article 8 Port Warehouses and Stock Yards

Qingdao Port owns 20 warehouses with a total capacity of 123,000 m 2 or


254,000 ton. Qingdao Port owns 37 special tanks including 8 fuel tanks with the
capacity of 208,000 m3 or 174,000 ton, 18 rice tanks with a capacity of 270,000 m 3 or
206,000 ton, 4 alkali tanks with the capacity of 14,000 m3 or 12,000 ton, 3 vitriol
tanks with the capacity of 9,000 m3 or 15,000 ton, 1 cement tanks with the capacity of
4,000 m3 or 15,000 ton.
Qingdao Port owns Stock Yards with the capacity of 5,800,000 m2 or 20,700,000
ton including container yard with the capacity of 2,950,000 m2 or 630,000 TEU, coal
yard with the capacity of 226,000 m2 or 1,156,000 ton, ore yard with the capacity of
955,000 m2 or 973,000 ton.

Article 9 Port Gathering and Distribution System

1. Railway
The existing railway network in Qingdao consists of Jiaoji line, Lanyan line,
Jiaohuang line, Jiaoxin line. The total length is about 230,000 km.
Jiaohuang line is the only railway routeway of Qianwan Port, its capacity is
18,000,000 ton/year. The railroad system of Old Port is relative perfect. Sifang Port
owns 2 railway stations rated as grade III including Sifang and Shalingzhuang, as
transferring stations handling passenger and cargo transportation.
2. Highway
Among the existing highways in Qingdao, there are 7 freeways,i.e. Tongshan,
Qingyin, Weilai, Jiqing, Surrounding Jiaozhouwan, Qianwan and Weihai-Wuhai, two
national highways, i.e. Yantai-Shanghai and Qingdao-Shijiazhuang (Anshan Road –
Liuting). The total length of highways in Qingdao is 6,655,000 km, including freeway
(524.5 km in length), Grade I highway (709.5 km in length) and Grade II highway

(1808 km in length).
3. Pipeline
Petroleum pipelines in Qingdao Port are connected with the Huabei ductwork via
Donghuang I line, Donghuang II line and Luning line.There are 15 pipelines in the
hinterland of Qingdao, which form the most developed ductwork among the port
hinterlands of China. Oil transferred by those pipelines can reach many petrochemical
companies such as Victory Oil Field, Qilu Petroleum & Chemical Company, Jinan
Refinery, Cangzhou Refinery, Shijiazhuang Refinery, Luoyang Petroleum & Chemical
Company and so on.
4. Airport
Qingdao Liuting International Airport is a domestic trunk airline airport of
grades 4D. The length of its runway is 3,400 m and its berthing apron takes up
250,000 m2 with 32 gate positions including 5 grading E. The departure Hall
occupying an area of 64,000 m2 can satisfy an annual passenger throughput of 6
million person-times and 3,000 person-times per hour in peak hours. The Freight
Station takes up 11,000 m2 with an area of 10,000 m2 for aerotransport berthing apron.
Presently there are 85 routes in operation, 73 of which are domestic and the rest
are international or Special Administrative Region routes. They are run by 17
domestic and international aviation companies, and can hold direct flights to 3
countries,2 Special Administrative Regions and 48 domestic cities including 20
international cities and 2 region cities. The flight density reaches 1,380 times per
week.

Chapter III Port Administrative Departments and Other Organs

Article 10 Port Administrative Departments

Port and Shipping Authority of Qingdao is the Qingdao Port Administrative


Departments in charge of the supervision of harbor, airport and shipping market
affairs. It is responsible for enforcement of laws and codes regarding harbor, airport
and shipping of the State.
Departments under Port and Shipping Authority of Qingdao are: General
Office, Port Safety Division, Airport Division, Construction and Management
Division, Marine Tour Management Division, Port Public Basic Establishment
Construction and Maintenance Center, Port and Shipping Division, Qingdao Pilot
Station.

Article 11 Maritime Administrative Authorities

Qingdao Maritime Safety Administration (hereinafter referred to as Qingdao


MSA) is the national maritime safety administrative authority responsible for the
water areas of Qingdao. It supervises waterborne safety of Qingdao, pollution
prevention and crew management, etc.
Under the Qingdao MSA are: Dagang Maritime Division, Qianwan Maritime
Division, Huangdao Maritime Division, Jiaonan Maritime Division, Jimo Maritime
Division, VTS Center, Government Affair Center, etc.

Article 12 Other Supervisory and Administrative Organs

1. Qingdao Customs Office


Qingdao Customs office is the organization set up at Qingdao Port by the State
responsible for the supervision and control over all arrivals in and departures from the
customs territory. In accordance with the “Customs Law of the People’s Republic of
China” and other related laws and administrative regulations, it exercises control over
the means of transport, goods, passengers’ luggage, postal items and other articles
entering or leaving the customs territory through Qingdao Port, collects Customs
duties and other taxes and fees, prevents and suppresses smuggling, compiles customs

statistics and handles other customs operations.
Under the Qingdao Customs are: Huangdao Customs, Liuting Airport Customs,
Dagang Customs.
2. Entry-Exit Inspection and Quarantine Bureau
Entry-Exit Inspection and Quarantine Bureau is responsible for the entry-exit
sanitation and propagation quarantine, export and import goods inspection, appraisal,
authentication, and such supervision or management works.
Under it, there are: Qingdao Substation, Huangdao Substation, Airport Office.
3. Entry-Exit Border Control Station
In accordance with the related laws and administrative regulations, Entry-Exit
Border Control Station is responsible for border control of people and their luggage,
traffic conveyances and cargoes carried entering and leaving the border at the place
appointed by Qingdao Port or other management authorities.
Under this Qingdao Entry-Exit Border Control General Station are: Qingdao
Border Control Station, Huangdao Border Control Station, Airport Border Control
Station.

Chapter IV Entry and Exit of Ships

Article 13 Report of the Entry and Exit of Ships

In accordance with “Ship Report System of Qingdao Port”, ships sailing,


anchoring, operating within the VTS area, (hereinafter referred to as VTS area) of
Qingdao MSA, shall report to Qingdao VTS Center on VHF channel 08.
1. Reporting contents
1.1. Ship’s name, call sign, IMO NO. (if necessary);
1.2. Position (coordinates, or position relative to landmark);
1.3. Port of departure, port of destination;
1.4. Limitation (the towing length and name of the towed);
1.5. Overall length, gross tonnage;
1.6. Other information required by the VTS Center.
2. Reporting position
2.1. Ships passing through the line joining Dagong Dao Island and Xiaogong Dao
Island;
2.2. Ships entering (or leaving) the port when Zhucha Dao Island is abeam;
2.3. Ships entering (or leaving) the port when Tuandao Lighthouse is abeam;
2.4. Before leaving the berth;
2.5. After berthing the wharf;
2.6. Before heaving up anchor at anchorage;
2.7. After anchoring at anchorage.
3. Other reporting requirements
3.1.Ships involved in accident, failure of main navigation operation equipments, etc.
within the VTS area shall immediately report the information of accident such as:
type, time, place, extent of damage, requirements for rescuing as well as other
information required by the competent authority;
3.2. The report shall be made by the pilot on board within the VTS area;
3.3. Ships shall apply to the competent authority for approval when they need to enter
the port owing to such reasons as seeking shelter against stress of weather, failure of
main navigation operation equipments, marine traffic accident and emergency case of
disease or injury of persons on board.

Article 14 Application of Entering and Exiting of Ships Carrying Dangerous
Goods

1. Ships carrying dangerous goods shall, 24 hours prior to their arrival at and
departure from the port, apply to Qingdao MSA about the names, physical and
chemical characters, packing of dangerous goods and arriving time, leaving time for
entry into, exit from or transit in the port. Ships can enter and leave the port only
when the permission has been obtained from Qingdao MSA. International ships shall
report the stated time according to the sixth article of “Inspection Regulations of the
People’s Republic of China for International Ships Entering and Exiting Port” .
2. Ships of fixed schedule and fixed categories of goods should make applications
to Qingdao MSA in accordance with related regulations and the applications of a
period is no more than one month.
3. Nuclear-powered ships and ships carrying radioactive substances shall submit
written applications to Qingdao MSA and shall be subject to special inspection and
supervision.

Article 15 Escorting for Entering and Exiting of Ships Carrying Dangerous


Goods

The following ships and facilities entering and exiting in Qingdao water areas
should apply to the Marine department for escorting:
1. Ships carrying explosives or radioactive substances;
2. Liquefied petroleum gas ships;
3. Bulk ships carrying inflammable liquid that closed cup flash point is below 23
° C;
4. Bulk ships carrying toxic volatile liquid;
5. Bulk Ships carrying the toxic pollution and hazardous substances;
6. Other ships which may affect the safety of marine traffic or the carrying cargo
could seriously pollute the marine environment.

Article 16 Ships Visas (Procedures for Entering and Leaving the Port)

Ships on international voyages entering and exiting this port, according to the

relevant regulations shall process the import and export clearance procedures to the
supervision and management departments.
Ships of Chinese nationality sailing on domestic routes process ship visas at
Qingdao MSA or at the nearest visa point set up by MSA, for entering or leaving the
sea port areas of the port, or sailing or operation on the said water areas. This article
does not apply to the ships and boats for military, public security and sports purposes.
Visas for the ships which still stay in the port for more than 36 hours or the bid
conditions which has some changes shall be processed once again.
Ships loading dangerous cargo and oil tankers should be immediately for the
visas when arriving in and before departing from the port.

Article 17 Pilotage

1. Piloting Objects
Ships sailing, berthing, unberthing, shifting berth (except of parallel shifting
between two berths along shore), berthing or unberthing out of the anchorage in
pilotage area, the loading and unloading station shall apply for pilotage.
1.1 Foreign nationality ships.
1.2 In order to ensure the safety of shipping navigation and port facilities out of
the pilotage area, the Chinese nationality ships authorized by Ministry of
Communications of the People’s Republic of China shall apply for pilotage.
1.3 Other Chinese ships shall apply for pilotage according to relevant laws and
regulations.
2. Piloting Area
Port areas and nearby.
3. Application for Pilotage
All ships applying for pilotage in due form shall do so to Qingdao MSA through
their agencies or shipping companies.
4. Documents for Pilotage Application
Ships or their agencies applying for pilotage shall provide the following
particulars of the ship will be piloted:

4.1 Name of the shipping company, name and nationality of the ship and ship’s
call sign;
4.2 Length overall, width, the maximum draft, the maximum height above water,
deadweight tonnage, gross tonnage, net tonnage, types and powers of the main engine
and thrust propeller and speed of the ship;
4.3 Categories and quantities of cargo on board;
4.4 Estimated time and place of arrival, departure or berth shifting;
4.5 Other matters that need clarification.
5. Boarding location for Pilot
At the Pilot Station. For a ship fully loaded her depth is more than 17 meters, the
boarding location is F-point.
6. Refusal, Suspension or Termination of Piloting
In case of one of the following conditions, the pilot has the right to refuse,
suspend or terminate piloting and shall promptly report to Qingdao MSA:
6.1 Heavy weather and sea conditions;
6.2 The ship being piloted is found to be unseaworthy;
6.3 The water depth is not enough;
6.4 Other conditions not suitable for piloting.

Article 18 Ships navigating and berthing in the Port

Ships navigating and berthing in port water areas shall comply with the following
requirements:
1. Ships navigating in port water areas should use the safe speed.
2. Foreign ships entering and exiting this port or Lingshan Shipyard must comply
with navigation routes in accordance with the regulations.
3. Ships navigating in the water areas within the line between Tuandaozui and
Jiaozishizui should comply with the following provisions:
3.1. If Hydroplanes exercising, ships should navigate on reserved route when
entering and exiting port;
3.2. Ships should navigate in the speed that will not be a danger to other ships and
the safety of the facilities;

3.3. Ships larger than 500 tonnage take over others in the channel are prohibited;
3.4. When tugboat engaged in towing operations, its total length should not
exceed 300 meters from the tugboat tail to the towed ship or other towed objects tail.
Do not release or free towing cable in the channel.
4. When ships that loading explosives, bulk flammable liquids whose flash point

below 23 C (closed cup), bulk liquefied petroleum gas or other special dangerous
types of goods entering and leaving the VTS area, VTS center will impose special
care.
5. The subsidiary raft boats, booms and suspenders should not extend the ramp
and outboard when ships navigating and berthing. All the ships receiving permission
to enter VTS management area for escaping typhoon, berthing and evacuating must
strictly obey the unified command of VTS Center.
6. For ship or facility that draft is more than 15 meters or more than 65 meters
above the water, ships or their agents should apply for using the channel to the VTS
Center before 3 days, then ships should navigate along the designated channel and
receive special care from VTS center.
7. Ships must anchor in the anchorage and the pilot station in accordance with he
instructions given by the VTS Center. In addition to accreditation, it is not permitted
to anchor in the water areas outside of the anchorage and the pilot station.

Article 19 Quarantine of Ships Arriving in and Departing from Territory

Ships engaged in international voyages shall, according to laws and codes of


China, complete quarantine formalities with Qingdao Entry-Exit Inspection and
Quarantine Bureau for entering and leaving Qingdao Port.
1. Modes of Quarantine
Anchorage quarantine, berth quarantine, free pratique by Telecommunication,
quarantine along with the voyage, provisional quarantine.
1.1. Anchorage quarantine
Any of the following ships shall complete anchorage quarantine formalities with
Qingdao Entry-Exit Inspection and Quarantine Bureau.

1.1.1. Ships from pestilence area;
1.1.2. Ships from areas of animal and plant epidemic or ships are compulsory for
inspection and quarantine according to relevant rules of the State;
1.1.3. Ships carrying any quarantinable epidemic victim or ones to be suspected or
corpse owing to an unidentified cause other than accidental harm;
1.1.4. Ships carrying live animals;
1.1.5. Ships with rodent animal died owing to an unidentified cause;
1.1.6. Disabled ships
1.1.7. Ships without valid certification of deratting / deratting exemption;
1.1.8. Ships applying for anchorage quarantine;
1.1.9. Ships required by quarantine authority
1.2. Berth quarantine
Ships without sanitary certificates and without any condition of anchorage
quarantine or can’t be exercised anchorage quarantine owing to such reasons as
weather, tide, shall apply for anchorage quarantine via the ship or the agent.
1.3. Free pratique by Telecommunication
For ships with sanitary certificates and without any condition of berth quarantine,
the ships or the agents may apply to the quarantine offices for berth quarantine.
1.4. Quarantine along with the voyage
1.4.1. The quarantine offices shall exercise quarantine along with the voyage on
tourist ships, military ships, ships with important person, etc.
1.4.2. Ships in special circumstance such as with sick persons needing salvation,
special cargo needing handling, needing repairing, etc. may apply for quarantine
along with the voyage via ships or the agents.
1.5. Provisional quarantine
Ships carrying any quarantinable epidemic victim or ones to be suspected or
person died owing to an unidentified cause other than accidental harm, shall
immediately report to the quarantine offices for provisional quarantine.
2. Application Time Limit
2.1. Arriving in the Territory: The ship or her agent shall, before 24 hours of ETA at

port (or if the voyage is less than 24 hours, at the time of departure from the previous
port), complete an “Quarantine Application Form for Port Entry of International
Voyage Ships” and apply for quarantine to the quarantine office. If the situations
change, the ship or her agent shall apply to the quarantine office for correction.
2.2. Departing from the Territory: The ship or her agent shall, within 4 hours before
departure from port, apply to the quarantine office for completing all necessary
formalities. After completing all necessary formalities, if the situations change or the
ship fails to leave the port within 24 hours, the ship or the agent shall complete all
necessary formalities anew.
2.3. If the time period of berth of a ship is less than 24 hours, the ship or her agent
may, with approval of the quarantine office, go through the exit formalities at the
same time when going through the entry formalities.
3 Application Statement
3.1.The ship’s name, nationality,port and day of departure, calling port, port and day
of destination, crew list, passenger list, deratting / deratting exemption certificate,
health certificate, cargo list, ballasting water list, ship dunnage list, food warehouse
list, etc.
3.2. Arriving in the Territory: The ship or its agent shall submit all necessary
information as follows.
Navigation health declaration, general declaration form, cargo list, crew list,
passenger list, water list, food list, Quarantine Application Form for International
Voyage Ships, ballasting water list and cargo list or Application Form of
Container,other forms required by the quarantine office such as deratting / deratting
exemption certificate, health certificate, vaccination certificate, health certificate,
navigational log, etc.
3.3Departing from the Territory: The ship or her agent shall submit all necessary
information as follows.
Navigation health declaration, general declaration form, cargo list, crew list,
passenger list, Application Form of Container, water list, food list, etc.
Article 20 Entry-Exit Border Inspection

Ship of exiting and entering must accept frontier inspection when arriving in or
leaving from the port. Ship owner or the transportation department should report to
the Entry-Exit Border Control Station in advance about the time and the place of ship
for arriving in or leaving from the port, staff and cargo carrying on the ship. The
captain or the agent should report a list of employees and visitors to the Entry-Exit
Border Control Station when ships arriving in or leaving from the port. Ship owner or
its agent should be deployed to assist the inspection officials to carry out inspections.
Ships of exiting and entering must navigate on the routes in accordance with the
regulations in China. Foreign ships should not park at non-opening up ports without
permission. Before exiting of ships that have been taken the exiting inspection and the
entering inspection for entering ships, ships should not load or unload cargo or staff
without permission of the Entry-Exit Border Control Station.
Chinese ships in need of leaning against foreign ships should apply to the Entry-
Exit Border Control Station for checking-in on procedures by the captain or the
agents. Do not make bold to lean against without correlative procedures.
The Entry-Exit Border Control Station has the right to ward for ships of exiting
and entering:
1. Before exiting and entering of foreign ships when arriving in or leaving from
the port and Chinese passenger ship that have been taken the exiting and entering
inspection. During inspection.
2. During navigating in river of China for foreign ships.
3. Other conditions that the Entry-Exit Border Control Station think it is
necessary to ward. Ship owners shall provide necessary office and living conditions
for the inspection officials. Ships and staff be in guardianship should be subject to the
checks. Ship owners should take management by themselves for the ships that have
not been taken guardianship measures to ensure their ships and staff comply with
“Regulations of the People’s Republic of China on Exit and Entry Frontier
Inspection”.
Documents and data should be submitted, including: “Total Declaration”
(Situations such as carrying guns or ammunition and people who are not allowed to

entry should be given clear indication), "Crew List", "Passengers List", "Crew Goods
Declaration", Crew Landing Declaration, Crew Documents, “Declaration of People
Carrying Guns or Ammunition” and “Declaration of Transportation Facility with
Guns or Ammunition” for ships carrying guns or ammunition.
Chinese nationality ships and convenience flag ships full of Chinese nationality
crew shall also provide “Exiting Inspection Report for International Ship Navigation
of the People’s Republic of China” when entering the port. Foreign ships entering the
port shall also provide "Frontier Packing" given by the Entry-Exit Border Control
Station of last port.

Chapter V Port Business Operations

Article 21 Admittance for Port Business Operations

For port operation activities in the port, including the operations of terminals and
other port facilities, port passenger shipping services and cargo loading, unloading,
lightering, warehousing and towing, the operators shall apply to Port and Shipping
Authority of Qingdao in written form for port operation licenses and register with the
administration for industry and commerce according to law.

Article 22 Shoreline Using

1. In the planning area, the construction of the port facilities for using of port
shoreline projects should conduct for the feasibility study and solicit opinions of the
layout, environmental protection, port and ship management, land management, sea
area management and maritime management departments in Qingdao City in advance.
2. Port and Shipping Authority of Qingdao shall take charge in organizing the use
of shoreline assessment in 20 days to make the decision after receipt of the using
application of port deep water shoreline (referred to the appropriate types of building
10,000-ton berths and above) for the construction of the port facilities in the planning
region, and then report to the State Council department in charge of traffic for
approval.
3. Port and Shipping Authority of Qingdao shall take charge in organizing the use
of shoreline assessment in 20 days to make the decision after receipt of the using
application of non port deep water shoreline for the construction of the port facilities
in the planning region.

Article 23 Port Cargo Loading and Unloading

1. Port operators shall make contracts with the operation contractors for
operations in the port, such as the waterborne cargo loading, unloading, lightering,
warehousing, storage and container stuffing and unstuffing in the port. The contracts
can be in written, oral or other forms.
2. The operation contractors shall timely complete port, customs, inspection,

quarantine, public safety and other procedures necessary for cargo transportation and
operation, and submit the documents proving the completion of various procedures to
the port operators.
3. For cargoes that have special stowage regulations, the operation contractors
shall establish special modes and conditions for cargo stowage with the port
operators.
4. The name, number of packages, weight, measures, packaging mode and
identification mark provided by the operation contractors to the port operator shall be
in conformity with those specified in the contract. For the operation of bulky and
over-sized cargo, operation contractors shall make statement on the total number of
packages, weight and measurements (length, width and height) of the total cargo and
each piece of cargo. In case the operation contractors fail to deliver the cargo and
make statement according to this article, they shall bear the responsibility of
compensation for the economic losses incurred to the port operators.

Article 24 Loading and Unloading of Dangerous Goods

1. Firms engaged in dangerous goods operation must be qualified for port


dangerous goods operation and apply to Port and Shipping Authority of Qingdao for
port dangerous goods operation licenses.
2. Firms engaged in dangerous goods operation shall conduct dangerous goods
operation activities within the limits for dangerous goods port operation specified in
the dangerous goods port operation license.
3. Operation contractor should provide correct information on the names, Chinese
or UN codes, applicable packaging, toxicity, emergency measures of the dangerous
goods to the enterprises engaged in the dangerous goods port operation and shall
guarantee that all the information is correct and complete. Operation contractors shall
not pack any dangerous goods in the trusted ordinary cargo, nor shall they withhold
information on dangerous goods or falsely declare them to be ordinary cargo.
4. Firms engaged in dangerous goods operation shall, 24 hours prior to the
commencement of dangerous goods loading, unloading, transfer to or from barges,

warehousing, storage, packaging or container stuff and unstuffing, report to Port and
Shipping Authority of Qingdao on the particulars of the contractor and other matters,
such as the names, quantities, physical and chemical properties, operating place and
time and safety precautions of the dangerous goods. Port and Shipping Authority of
Qingdao shall, 24 hours upon receipt of the report, make decision on whether or not
approving the operation and notify the reporter. Without consents, no dangerous
goods operations shall be allowed in the port.

Article 25 Port Tally Business

1. For port tally business, operators shall apply to and obtain license from the
Ministry of Communications of the People’s Republic of China in accordance with
relevant regulations.
2. Operators of port tally business shall deal with the business fairly and
accurately and shall be prohibited from concurrent operations of cargo loading,
unloading and warehousing.

Article 26 Towing Operations

1. For towing operations, the operators shall apply to Port and Shipping Authority
of Qingdao in writing for port operation license and register with the administration
for industry and commerce according to law.
2. Tug boats engaged in towing business shall possess valid certificates and
documents and comply with the relevant marine traffic regulations of Qingdao.

Article 27 Port Passenger Shipping

1. For the operation of port passenger shipping facilities, the operators shall apply
to Port and Shipping Authority of Qingdao in writing for port operation license and
register with the administration for industry and commerce according to law.
2. Port operators shall adopt effective measures to provide courteous and
considerate services, good waiting lounge for passengers.

Article 28 Cargo Disinfection and Ship Fumigation

1. According to “Specific Rules for Enforcing the Frontier Health and
Quarantine Law of the People’s Republic of China”, when containers, cargoes,
deposed or old goods, etc of entering and leaving territory arriving in or leaving this
port , the carrier, consignor or agent shall apply to the inspection and quarantine
institution and accept sanitation quarantine.
2. Ships carrying propagation entering and leaving the territory, propagation
products and other quarantined cargoes; Ships infected by nocuousness life-form that
carrying propagation entering and leaving the territory, propagation products and
other quarantined cargoes; The whole ships infected by epidemic disease, that are
supposed to reach certain grave degree in the biology degree of medical media and are
difficult to eradicate completely; Ships carrying legal quarantine or old goods come
from epidemic disease areas, all aforementioned ships shall apply for fumigation by
ship-owner or ship when arriving in or leaving from this port, then ship fumigation
shall be carried on .

Article 29 Fair Competition in the Port

1. Our country encourage domestic and foreign economic organizations and


individuals to invest in building and operating the port business, protecting the legal
rights and interests of investors.
2. Port operators engaged in the port business, should comply with the laws and
regulations and fulfill its contractual obligations to provide fair and good services.
3. Port operators should abide by relevant regulations of port operating costs, port
fees promulgated by the state and the price in accordance with the agreement between
port operators and clients under the needs of the market, promulgate operating service
charges and fees using the port operators offer promulgated by the state.
4. Port operators can not resort to improper means to squeeze out competitors,
restrict or impede fair competition. Discrimination for operating in the same
conditions of service and forcing others to accept its offer of port services by any
means are strictly prohibited.

Chapter VI Port Services

Article 30 Water Traffic Services

Within the water areas administered by Qingdao VTS Center, VTS Center can
provide marine traffic safety information on requests, meteorological data on request,
assistance in navigation on request, joint action support on request, organization of the
traffic and some other water traffic services through VHF system.
Qingdao VTS center working channels are 08 and 16. Ships or staff in distress
can dial 12,395 which is the special police hotline to call Qingdao Searching and
Rescuing Center for help.

Article 31 Ship Supply Services

The professional ship supply service enterprises in Qingdao Port, which have
joined International Ship Suppliers Association, can 24 hours a day and under all
weather conditions, supply the incoming and outgoing Chinese and foreign ships with
fuel, lubricants, fresh water, staple food, groceries, cigarettes, wines, drinks, ship
stores, plank, ship accessories. They can also purchase various kinds of commodities
for the ships’ crew.

Article 32 Shipping Inspection Services

China Classification Society Qingdao Branch and other special shipping


inspection institutions can provide entering classification shipping inspection, non-
entering classification shipping inspection, shipping production inspection, ocean
engineering inspection, chart examination inspection, equity inspection, etc. Shipping
Verifying Services mandated by the Chinese government and foreign (regional)
government agencies may be acted as statutory inspections.
1. Current shipping inspection agencies in Qingdao:
China Classification Society Qingdao Branch and Shipping Inspection Bureau of
Qingdao in Shandong Province.
2. Foreign shipping inspection agencies office in Qingdao, including American,

Article 33 Ship Repairing and Building Services

Ship repairing and building services are available in the port. There are 16
shipways, including 1 shipways being in construction and 7 ship docks including 3
docks being in construction.

Article 34 Ship Towing Services

Ship towing enterprises provide large and medium-sized Chinese and foreign
ships into and out of Qingdao Port with services such as berthing, unberthing,
convoying, rescue, lifting and assembling of oversize long and heavy cargo with
floating cranes, leasing, lighterage, towing, mooring and unmooring.
Merchants Weijie (Qingdao) Ltd., has two 4,000 horsepower / vessels hugs, one
of which is also a fire on board ship mainly used for towing and pushing operational
services within the sea area near the port.

Article 35 Rescue at Sea

Rescue of life at sea in the sea port areas is the function performed by Beihai
Rescue Bureau of Ministry of Communications of the People’s Republic of China,
which includes the rescue of life on the Chinese and foreign ships, maritime
installations and aircrafts in distress, the maritime fire-fighting with the rescue of life
as the purpose, the rescue of ships, water installations and the properties thereon with
the rescue of life as the direct purpose, the accomplishment of the special disaster
relief rescue obligations as stipulated in the relevant international conventions and
bilateral maritime agreements on behalf of the Chinese government.

Article 36 Salvage Services

The professional unit for salvage of shipwrecks (sunken objects) at sea (on water)
and rescue tasks for emergency cases and serious accidents at sea (including
environmental accidents) is Yantai Salvage Bureau of the Ministry of
Communications of the People’s Republic of China. It has the functions of taking on
special political, martial (combat readiness) and disaster-rescuing salvage assignments
appointed by the State; carrying out related international pacts; salvage of shipwrecks

or sunken objects, emergency aid to sunken ships residual oil and shipwrecks
overflow oil, clearing barrier of public water areas and port sea-route, salvation and
salvage for ships rescuing of not life at sea , facilities and possessions, fire protection
at sea, emergency aid to towing and lighterage; undertaking other assignments
assigned by the Ministry of Communications of the People’s Republic of China.

Article 37 Oily Water Treatment Facilities

Qingdao marine oil spillage treatment units (hazardous chemicals) emergency


response center treats oily water from ships, chemical water and domestic sewage of
port land areas.

Chapter VII Port Safety and Environmental Protection

Article 38 Ships and Port Facility Security

For port facilities serving passenger ships on international voyages (including


high-speed passenger ships), cargo ships of 500-ton class or above (including high-
speed cargo ships) and mobile offshore drilling platforms, the “Port Facility Security
Code” and “Ship Security Code” shall apply.

Article 39 Port emergency rescue

1. Preparative emergency schemes for dangerous cargo accidents that may


endanger society public profits, preparative schemes of passengers urgency
evacuation and succor for momentous manufacture safety accidents and for
preventing natural disasters are established by Port and Shipping Authority of
Qingdao. Establishing and improving port emergency rescue system for the port
production fateful accidents.
2. Port companies and relevant operators shall legally establish their own
emergency schemes for dangerous cargo accidents and preparative schemes of
passengers emergency evacuation. It also shall succor for momentous manufacture
safety accidents and for preventing natural disasters. Shipping companies and port
operators must cooperate actively in the process of carrying into execution.
3. Port companies and relevant operators shall put the emergency schemes on
records to Port and Shipping Authority of Qingdao, production safety administrations,
environmental protection departments and marine administrations.

Article 40 Maintenance of Navigation Channels and Navigation Aids

1. Maintenance of Navigation Channels


1.1 The navigation channels, channel facilities and other navigation-related
facilities are protected by the State. No units or individuals shall illegally occupy or
sabotage them.
1.2 No sand, blocks and disposals should be dumped into the channels except for
necessary sand and jackstones required for dredging and maintaining the channels.

The sand and jackstones for dredging and maintaining must be dumped at appointed
sites according to regulations of relevant institutions.
1.3 Were there any ships, facilities or other objects that may hinder shipping
safety sunk in the water areas of the channels, the owners or operators should report to
maritime administrative authorities and channel administrative authority promptly.
Indicating marks should be set in line with rules or regulations. The owners or
operators may entrust the channel administrative authority to manage the sunk
objects, and should salvage or clean up them in due time.
2. Maintenance of Navigation Aids
2.1 Any units or individuals shall have the right to protect navigation aids, any
actions which are detrimental to the safety or the efficiency of navigation aids shall be
prohibited.
2.2 Any units or individuals shall immediately report to the superintendent
departments for navigation aids, upon discovering any incidence of damage,
malfunction, movement, or drifting of navigation aids.
2.3 In case the relocation or dismantlement of navigation aids is necessary for the
sake of construction operations, such action shall be approved by the superintendent
departments for navigation aids and substitute measures shall be taken before the
relocation or dismantlement being conducted. The expenses for the relocation or
dismantlement shall be borne by the party carrying out the construction.
2.4 Ships shall maintain a certain distance from navigation aids during navigating
and should not strike navigation aids. In case navigation aids are struck by ships, the
incidents shall be immediately reported to the superintendent departments for
navigation aids.

Article 41 Port Safety and Environmental Protection

1. Assessment on the environmental impacts of the construction of port projects


shall be undertaken according to the laws. The safety facilities and environmental
protection facilities of the port construction projects shall be designed, built and put
into use synchronously with the main body of the project.

2. Sanitary Disposal sites of the port should be in line with the state's overall
planning and environmental requirements.
3. Port operators shall, according to the relevant laws and regulations on
environmental protection, adapt effective measures to prevent and control the
pollution and endanger to the environment.

Article 42 Control of the Discharge of Ship Pollutants

1. Ships are not allowed to discharge any residual oil, oily waste, cargo residues,
shipping garbage, as well as any toxic and hazardous substances over standards stated
by laws and regulations.
2. Ship's ballast water, washing water, Bilge water and sewage should be received
and processed by the pollutants receiving unit with the corresponding receiving
capacity, arbitrarily emissions are inhibitive. Essential to the discharge of ballast
water, washing water and bilge water should comply with national pollutant discharge
requirements and standards, reported to Qingdao MSA for approval in the 24 hours
before emissions; Sewage discharge should be reported to Qingdao MSA in advance.
3. Ship operators should do the day-to-day garbage collection, separation and
storage and the pollutants shall be termly received treatment by the receiving and
processing units. If toxic waste containing hazardous substances or other harmful
substances, ship operators shall provide the name of the substance, nature, quantity
and other information to the receiving and processing units.

Article 43 Anti-Pollution Control of the Ships and Related Operations

The following activities should be reported in accordance with relevant


regulations of Qingdao MSA prior to approval or approval:
1. Using incineration furnace, washing and clearing module, flooding gas,
emissions of ballast water and residual oil in the port water areas;
2. Murder spade outboard and painting operations;
3. Shipping, port facilities using chemical degreasing agents;

dismantling and other construction work, pollution prevention facilities and
equipments should be available. Taking effective, safety and anti-pollution measures
to prevent oil, oily mixtures, or other pollutants in the sea.

Article 44 Handling of the Ship Pollution Accidents

In case of ship pollution accident(s) caused by oil, oil mixtures and other
pollutants, or caused by poisonous, polluted goods falling into the sea, the ship(s) in
question should promptly report to Qingdao MSA and take measures to control,
alleviate, or eliminate the detriment. Notification should also be given to the units that
may be affected by the accident(s). The ship(s) in question should accept
investigation. Upon receipt of the report of water area pollution caused by ship, the
maritime administrative authorities shall promptly organize emergency rescue
according to the nature, degree of pollution and rescue requirements of the
accident(s). The ship(s) and units involved have the duty to participate in the
emergency rescue and should obey orders of the maritime administrative authorities.
To the pollution caused or may cause significant damage to the marine environment,
Qingdao MSA has the power to take compulsory measures to prevent or reduce the
pollution damage.

Article 45 Port Safety and Environmental Protection

1. Aquaculture and planting activities are banned in the port water area.
2. Port operators shall, according to the relevant laws and regulations on
environmental protection, adapt effective measures to prevent and control the
pollution and endanger to the environment.
3. Assessment on the environmental impacts of the construction of port projects
shall be undertaken according to the laws. The safety facilities and environmental
protection facilities of the port construction projects shall be designed, built and put

into use synchronously with the main body of the project.

Article 46 Guarantee of Port Smooth Traffic

1. In case of congestion in the port due to hold-up of passengers and


accumulation of cargoes, Port and Shipping Authority of Qingdao shall adopt
effective measures to regulate the flow of passengers and cargoes according to law.
When deeming it necessary, Qingdao Municipal People’s Government may directly
adopt measures.

Article 47 Remarks

Port and Shipping Authority of Qingdao takes charge in the compiling of this
Constitution, Qingdao MSA, Qingdao Customs, Qingdao Entry-Exit Inspection and
Quarantine Bureau, Qingdao Entry-Exit Border Control Station, Qingdao Port
(Group) Co., and other units are involved in the preparation.
The statistical deadline of this Constitution is December 31st, 2006, the port
water areas, land areas, sea-routes, anchorages and port facilities involved in this
Constitution root in main port data of Qingdao Port. Changes to relevant contents
henceforward will be released in the form of loose-leaf.

Article 48 Constitution Explanation

This Constitution shall be explained by Port and Shipping Authority of Qingdao,


the functions of other administrative departments will be explained by the relevant
administrations.

Article 49 Put on Records

This Constitution shall be put on records to the Ministry of the People's Republic
of China.

Article 50 Date of Promulgation

This Constitution shall be promulgated on January 1st, 2007.
