I. PROCEDURAL HISTORY:
The arbitration was initiated by the Claimant, Moon X, against the Respondent, Bharat Space
Research Centre (BSRC), pursuant to Article 3.1 of the Arbitration Rules of the Singapore
International Arbitration Centre (SIAC Rules).
The procedural history of the arbitration, including the appointment of the Arbitral Tribunal
and compliance with procedural requirements, is duly noted.
II. JURISDICTION:
3. The Arbitral Tribunal has carefully considered the jurisdictional issues raised by the
parties.
Pursuant to the arbitration agreement in Article [TBF] of the contract, the Arbitral Tribunal
finds that it has jurisdiction to consider the dispute described herein between the Parties.
5. The Arbitral Tribunal has considered the claims and counterclaims presented by the
parties.
The nature of the contractual relationship between Moon X and BSRC, the terms of the
agreement, and the circumstances leading to the dispute have been thoroughly examined.
IV. FINDINGS:
Moon X has demonstrated adherence to the terms of the contract, including profit-sharing,
non-exclusivity, and confidentiality clauses.
BSRC's allegations of breach of confidentiality and illegal sharing of technologies are found
to be unsupported by concrete evidence.
