That on 03 96.2012, the Complainant had made an application for allotinent of one Flat in the Group Housing Project named a8 “Gayatri Aura” situated at Plot No. GH-1, Sector - 1, Greater Noida (West), UP. That the Complainant had paid the Amount of Rs. 2, 82, 726/- (Rupees Two Laks Eighty Two ‘Thousand Seven Hundred and ‘Twenty Six Only). Pursuant to which an Allotment Letter dated 06.06.2012 was issued by the Promoter stating the Specifications and the Cansideraton price of the allotted Flat . That initially the Promoter issued the Allotment Letter dated (06.06.2012 for the Flat Unit bearing T- 906 and thereafier on 04.04.2014, the Promoter re-allocated the alloted flat 10 B — 908. Thereafter, a fresh allotment fetier cum builder buyer agreement was signed between the paities and a tripartite agreement was also exeouted for grant of Joan. That till 27.03.2014, the Complainant had paid Rs 6, 16, 751/-(Rupees Six Lakhs Sixteen Thousand Seven Hundred and Fifty One ® Only), That a payment of Rs. 6, 02, 068/- (Rupees Six Lakhs Two Thousand and Sixty-Fight Only) was made to. the Respondent Promoter an 18.06.2014, with the balance to be Paid in installments as per the payment plan. 3. That in terms of Clause 16 of the Allotment Letter cum BBA dated 04.04.2014, the possession of the said Apartment/Flat “ss fo be delivered within 40 months from the date of signing + the Allotment Letter Ke. 04.04.2014 with a grace period of 6 ‘months, That as per the allotment cum BBA, the builder had to } deliver the said flat by 04.02.2018 including the grace period, TAAL now as pet the official site of RERA, the date for Completion of the project is 19.01.2024 further showing extension upto 18.07.2024. 4. That the Complainant has made timely payments: 10° the demand of the Respondent Promoter and til 30.08.2016, the Complainant had paid Rs. 21, 37, 571). (Rupees Twenty One Lakh Thirty Seven Thousand Five Hundred ane Seventy One Only) which is around 71% of the consideration price 5. That the Complainant has followed the progress of the project 8S well his apartment and the Resporident Promoter has not delivered the possession but to the utler shock of’ the Complainant, the Respondent Promoter instead of following the timelines as per the Allotment cum BBA, has issued a eancellation letter dated 13.01.2022 cancelling the allotment in | the name of the Complainant on the ground of non-payment of the installments, 6. That the Complainant in consonarice with the Clauses of the Allotment Letter cum BBA has made timely payments and See Sven offer Waiting for around 4 exira years, the Respondent Promoter instead of giving the possession of the said flat has Cancelled the allotment, ‘That after rec ing the cancellation letter, the Complainant telephonically contacted the customer Care of the said Promoter for refund of the amount paid to the Respondent Promoter. The Respondent Promoter in violation of the Allotment Letter cum BBA asked to deduct several charges alongwith interest. Therefore, the Complainant refused ‘o sive several charges and preferred the present complaint as the: ‘Complainant js also entitled to interest as per the Clause 16 ofthe Allotment Letier, ‘That the Respondent Promotér even after immense delay and in violation of the terms of the Allotment Letter has uni laterally cancelled the allotment in the name of the Complainant, 8, That the said Project is still not completed and is still under which is established from the cancellation letter issued by the Respondent Promoter, ‘That the Complainant has made all the previous Payments on ‘ime in compliance of demand letters issued by the Respondent Promoter, It is submitted that the builder/promoter who has Caused delay of more than 3 years in completing the project or handing over the possession of the booked unit/flat, {O-That pow the Respondent Promoter by unilaterally cancelling the allotted flat is trying to gain unjust enrichment at the cost of the Complainant and has been withholding the money of the Complainant even after cancelling the said flat unilaterally, U1-That the Complainant deserves to be refunded the entite amount paid alongwith interest. The Respondent Promoter is mpensation alongwith interest on the entire ae flat which has also liable to pay the Complainant for his unit amount paid by been withheld by the Respondent Promos, foresaid facts and circumstances, the Jjund of the amount paid till date along from the date of payment till 12.That in view of the al complainant is seeking re with interest at the rate of 12% the date of actual payment.
