MOST RESPECTFULLY SHOWETH: -


1. That the present matter is pending adjudication before this
Hon’ble Court and is now fixed for hearing on 01.09.2023.
2. That the Defendant craves leave of this Hon’ble Court that
the contents of the Reply to the Application under Order
XXXIX Rules 1 and 2 may kindly be read as part and parcel
of the present application and the same are not repeated
herein for the sake of brevity.
3. That this Hon’ble Court vide its
Order 18.04.2023 granted four weeks time to file the reply to
the captioned IA. That the Defendant was travelling out of
station and was not available for signatures and certain
documents were to be collected for the preparation of the
written statement as well as the reply to the captioned IA and
collection whereof took time leading to delay in filing of the
present Reply. Therefore, delay of 41 days in filing of the
Reply may kindly be condoned in the interest of justice.
4. That the delay of 41 days is thus on account of reasons
beyond the control of the Defendant.
5. That the present application has been made bonafide and in
the interest of justice.
PRAYER
It is, therefore, prayed that this Hon’ble Court may
kindly be pleased to:
a) Condone the delay of 41 days in filing the present

Reply for reasons stated hereinabove;

b) Pass any other or further order(s) as deemed fit and

proper in the facts and circumstances of the present

case.

I, Bhavna Chawla, aged about 48 years, D/o Late Mrs. Nirmal
Malhotra & Late Shri. S.K. Malhotra, R/o B-163, Sushant Lok-I,
Gurugram, Haryana and also at GA-10, 1st Floor, Shivaji Enclave,
New Delhi – 110027, do hereby solemnly affirm and declare as
under:

1. That I am the Defendant in the captioned matter and am duly


conversant with the facts and circumstances of the present
case and am competent to swear this affidavit.

2. That the contents of the accompanying Reply have been


drafted by my counsel under my instructions and the same
have been read over and explained to me which I have
correctly understood by me in my vernacular and the same
are true and correct to my knowledge and belief based on
record and the same may be read as part and parcel of this
affidavit as the same are not being repeated herein for the
sake of brevity.
