SECTION 1: INTRODUCTION & DEFINITIONS
Frasers Property Industrial (Thailand) Company Limited and/or its nominees (collectively “the
Company”) is looking for Main Contractor with the requisite expertise to facilitate the Design and Build
construction of development project in accordance with this Tender Document.
This Tender Document sets out the commercial and technical parameters of the development projects.
These parameters, including all the Annexes (in excel, word, pdf format) shall form the basis of the
Company’s terms and conditions.

SECTION 2: INSTRUCTION TO TENDER
The Contractor is responsible for Design and Build construction works in the areas as required
to complete the Work under the Tender Documents. The Works include, but are not limited to,
the following:
a) Piling Works
b) Civil and Structural Works
c) Architectural Works
d) Mechanical, Electrical and Plumbing Works (including Ventilation Systems, Fire Protection
Systems and Sanitary Systems)
e) External Works
f) Retaining Wall
g) Common Road and Supporting Infrastructure
h) Equipment Supply and Installation
i) Others
• Site Preparation Works and Site Mobilization
• Demolition Works, if any
• Protection and Partitioning Works
• Compliance with all Local Authority Building Codes and Regulations including any
Additional Requirement Specified in the Tender Documents
• Other necessary Permanent and/or Temporary Works required to complete the
Works as specified in the Tender Document
The Contract will be Design and Build based on Section 3 Condition of Contract. Design and
Building Construction Contract means Contractor is responsible for the design, including all
details, design drawings and Technical Specifications in respect of the Works, and shall be
responsible for the adequacy, integrity, suitability, practicability of the design and the Works as
well as shall ensure that the design is Fit for the Purpose and in accordance with the Company's
requirements.
The Contractor shall prepare the detailed drawings, calculations, and specification necessary to
complete the Works in accordance with the Drawings, Design Requirements, General
Specification, and other requirements set forth in this Tender Document to the Company and/or
Company’s Representative for reviewing, checking, and approval. The Company shall have no
responsibility for the accuracy, reliability, sufficiency, or completeness of such information
provided, and the Contractor shall be responsible for (i) discrepancies, errors or omission thereof
and shall waive any rights and claims in relation thereto against the Company; and (ii) making
their own investigations to verify and interpret all such information at its own cost. In any cases,
the acceptance of the design, specification, and value engineering (VE) by the Company and/or
the Company’s Representative shall not relieve the Contractor from any of its liabilities for any
errors, deficiencies, inconsistencies or in adequacies on the Works or design.
The Contractor is responsible for carrying out the Main Contract Works according to their
submitted and approved schedule. The Contractor shall produce a detailed construction
schedule in Microsoft Project format incorporating all key milestone dates in for the Projects.
This master schedule shall include the full and detail construction, permit and defects works to
enable the timeline to be used as a master programming document.

This master schedule is to be updated fortnightly by the Contractor for the use in construction
site meetings and the reports required by the Company to provide a status of the tasks against
the original baseline. The status program should identify actual work completed and any revised
forecast completion dates, as well as identifying the critical path for the projects.
The Contractor shall also be responsible for coordinating with other Contractors, Sub-
Contractors and/or Suppliers and Vendors hired by the Company to perform the Works. The
program of works must be prepared and adhered to accordingly.
The Contractor shall be responsible to obtain all permits, licenses, and consents from the
Authorities for the performance of the Works by the Contractor, construction, and use of the
Project (whether required to be granted in the name of the Contractor or the Company) and other
activities.
The Contractor shall produce all necessary drawings, engineering calculations, studies and
reports required for the Authority submissions, including any re-design and re-submissions to
obtain the permits.
The Contractor should provide necessary coordination with the Authority and responsible for
changing the site supervision engineer record at Local Authority (Aor-Bor-Tor and all concerned
authorities) after awarding the contract, as and when required.
All permissions shall be acquired in a timely manner without delay according to the approved
schedule as required under the Applicable Laws. The costs relating to the Contractor’s
Permissions, including all consultancy and administrative costs necessary to obtain the
Contractor’s Permissions shall be included in the Contract Sum.
LEED Certification
The Company will engage LEED Consultant Company for this project. The Contractor shall be
responsible for the appropriate documentation required for their submission to achieve a
minimum LEED Certified Level for Warehouse in accordance with the U.S. Green Building
Council (USGBC).
The appointed Contractor shall procure the simulation of Computational Fluid Dynamics (CFD)
of all the Projects in accordance with regulatory requirements, such as safety and sustainability
requirements and the Contractor shall prepare the presentation of CFD simulation report and
submit timely to the Company and/or the Company’s Representative for review and approval.
The Contractor is committed to providing a safe and healthy workplace environment for its
employees and visitors.

The building and its design shall comply with the requirements of the Safety, Health and
Workplace Act and Labor Protection Act in accordance with the Contractor’s obligation under
this Tender document, the Contract, and any government Authority’s requirement.
Prior to Work commencement, the Contractor shall submit Site Safety Plan including but not
limited to schedule of all SHW and Business Continuity Plan (BCP) for Covid-19. If an item is
not specifically listed in the Safety Plan, the Contractor shall comply with the Company’s Safety
Guidelines and all reasonable requests by the Company in this regard.
BIM
BIM model could be provided as advantageous point of Tender Evaluation for The Contractor.
The Company will evaluate the Tender Proposals and award the Contract at its sole discretion.
The Company shall take into consideration the Tenderer’s experience, organization, facilities,
proposed cost and time to accomplish the task and financial standing that will ensure the
successful performance of the obligations in accordance with the Contract Documents within the
time stated.
The Company reserves the right to accept or reject any Tender Proposals, and to annul the
Tendering process and reject all Tender Proposals at any time prior to the contract award,
without thereby incurring any liability to Tenderers or any obligation to inform Tenderers of the
grounds for the Company’s decision.
2.3 BOQ
The Tenderer shall insert the quantities and the rates into the blank BOQ provided in the Annex,
which will form as part of the Tender Proposal.
The Tenderer must strictly follow the format of the BOQ and be fully responsible for the
correctness and the sufficiency within the BOQ. The Company will not be liable for any errors or
omissions in the BOQ.
The Contract will be made as a Lump Sum Contract. The BOQ and unit rates will be used to
value any ordered variations to the works and to assess the amount of monthly progress
payments.
The cost of executing the Works shall be at the sole risk of the Contractor who shall be deemed
to have obtained all information and taken into account all circumstances which may affect the
cost in establishing the Contract Price.
Any omission or carless mistake made by the Contractor shall be rectified by the Contactors at
their own cost and is not the responsibility of the Company. In the event of any price fluctuations
or mistakes in calculation during procurement and construction (regardless of whether the
Contract Price was already approved by the Company or its representative), it will be under
Contractor’s responsibilities to deliver the Project to Fit for the Purpose and in accordance with
the Company’ s requirement.

2.5 DESIGN DRAWING PROPOSAL
The Tenderers shall submit Design Drawing per the checklist, refer to Annex E for all trades
(Piling, Civil and Structure, Architectural, MEP, External Work and Equipment), relevant
documents, and/or 3D renders that is sufficient to show the conceptual design intent (applicable
for Design & Build Contracts) in accordance with the Technical Specifications provided in this
Tender Document.
The Tenderer shall submit a detailed Master Schedule prepared in Microsoft Project and detailed
construction method statement / sequence indicating how the Works will be executed within the
time frame required.
This shall include but not limited to the proposed site layout plan and traffic, locations of material
storage and site offices.
The Tender Deposits submitted will only be refundable (without interest) to the unsuccessful
Tenderers who have submitted a bona fide Tender Proposal. The Tender Deposit of the
successful tenderer will not be refunded but shall be used to defray lithography charges.
The language of communication between the Company and the Tenderers / awarded
Contractors shall be in English. Including but not limited to all letters, documents, tender
submissions, and other written forms of communication must be in English.
Tender Proposal shall remain valid for ninety (90) days after the submission deadline. Unless
requested by the Company, the Tender Proposal cannot be revoked, canceled, amended, or
altered by the Tenderer during this period.
The Tender Proposal shall be submitted in Part A & B in one envelope and Part C in another.
Each envelope must be sealed and have 1 set of hard copy and soft copy in thumb-drive,
comprising of and according to the below outlined. All the forms in the Annexes must be
completed and provided in both PDF and Excel format. Failure to complete ALL Parts will
automatically render the Tenderer unsuccessful in this Tender Document

or any modifications of Tender Proposal received after the specified date and time shall not be
considered by the Company. The Project duration that meeting/shorter than our expectation is
an added advantage to Tender Evaluation for the Tenderer.
Tenderer shall follow the indicative timeline as stated in the information below. The timeline may
change as deemed appropriate by the Company’s Representative.

SECTION 3: TERMS AND CONDITIONS OF CONTRACT
The key terms and conditions of the Contract provided in this Section 3 of the Tender Document
are not exhaustive and serve as an outline. It is subject to the full terms and conditions of the
Contract, including those stated in the Letter of Acceptance (LOA).

to the Contractor without interest after the issuance of the
Final Acceptance Certificate or after the issuance of the
certificate of statutory completion for the Works by the
relevant authority whichever is later.
