Dear colleagues,

It is to update you on recent regulations adopted by NGCA structures which might be of your
interest.

1. DPR Government Decree No. 23-7 of 15.05.2020 ”On adoption of Requirements to the
personal data protection during the processing in information systems” 

• Subject of regulation: protection of personal data allocated and processed in information


systems

• Scope of application: operators of data systems and persons assigned by data operator to
process data in the information system based on the agreement

• Summary: regulation explains what shall be considered as an information system of sensitive


personal data; system of biometric personal data; system of personal data available in public domain;
system of employee’s personal data and system of other personal data (those not related to
sensitive, biometric, public or employment data). Threats to the personal data safety are divided into
3 groups. The data operator shall assess and classify the possible threats. Data systems may have 4
levels of protection. Conditions of implementation of each protective level are provided in the
regulation.

2. DPR Head Order No. 163 of 21.05.2020 “On Regulation on personal data of the state civil
servant in DPR” 

• Subject of regulation: processing and storing of personal data of civil servants in NGCA
structures

• Scope of application: NGCA structures

• Summary: personal data may be obtained only from a civil servant personally; if additional
information is needed from the third party, a civil servant shall be prior notified and asked for a
consent. All collected data are kept in personal files. Regulation clarifies the purpose and conditions
of processing the personal data as well as rights of data subjects. Personal files of civil servants are
treated as confidential (except cases expressly provided by law), and when applicable under the law
– as a state secret.

3. DPR Head Order No. 165 of 25.05.2020 “On the Statute of the Ministry of Foreign Affairs of
DPR” 

• Subject of regulation: legal status and mandate of the DON MFA

• Hierarchy: MFA is supervised by and accountable to the Head of DPR

• Functions (subject to cooperation with international actors): establishment of diplomatic


relations with other states as well as relations with international organisations and their
representations; coordination of actions of other NGCA structures and control over their compliance
with unified policy of DPR with regards to relations with other states, international organisations and
intergovernmental institutions; negotiations with other states and international organisations;
actions aiming to international recognition of the DPR by means of diplomacy; support of foreign
diplomatic representations and consular offices in DON, as well as international organisations and
their representations in DON; ensuring the respect to diplomatic and consular privileges and
immunities

• Functions (subject to international law): ensurance of the development of international law;


performance of the work related to signature of international treaties on behalf the DPR

LNR

A. Non-COVID regulations:

I. LPR Government Decree No. 315/20 of 19.05.2020 on invalidation of encumbrances of rights to


property in the form of a pledge and other encumbrances of rights.

The encumbrances which were put on a property prior to the adoption of the Constitution of the LNR
securing obligations before the state of Ukraine (state bodies of Ukraine), commercial and state
banks of Ukraine, as well as financial (credit) enterprises, institutions and organizations for the
individuals living in the territory of LNR, legal entities and entrepreneurs registered in LNR, are
recognized as invalid.

B. COVID-19:

Decisions of the LPR emergency committee (as reported, official MoM are unavailable)

I. The LPR emergency committee on the prevention of the COVID-19 spread has lifted strict self-
isolation measures since 13 May 2020 and adopted requirements for the organization of work in the
context of maintaining the risks of the spread of COVID-19 for:

 ateliers
 non-food stores including on markets
 transport and transport companies
 beauty salons and hairdressers
 the provision of trade services
 the provision of catering services
 maintenance of vehicles
 the construction industry
 laundries and dry cleaners.

ІІ. The LPR emergency committee on the prevention of the COVID-19 spread on its meeting on
27.05.2020 decided: from June 1, 2020, to allow the work of state notaries and the Notary Archive,
to resume the acceptance of documents at the BTI, and also allow the movement of intercity public
transport (including railway transport). It does not apply to Sverdlovsk, where the strict regime of
self-isolation is still in place.

Decisions of the LPR Government

I. LPR Government Decree No. 331/20 of 26.05.2020 on certain issues of the lease of municipal
property at the time of high readiness regime: lessees of the municipal property objects may be
exempted from the lease payment in May 2020 in case the object of the lease was not actually used
because of the COVID-19 restrictive measures. The conclusion of such lease agreements is also
suspended.

II. LPR Government Decree No. 332/20 of 26.05.2020 on certain issues of the lease of state
property at the time of high readiness regime: lessees of the state property objects may be
exempted from the lease payment in May 2020 in case the object of the lease was not actually used
because of the COVID-19 restrictive measures.

III. LPR Government Decree No. 313/20 of 19.05.2020 on the validity period of technical passports
for real estate in the period of high readiness regime: the validity of technical passports for real
estate is extended for the duration of the restrictive measures (for now registration authorities do
not accept the documents for registration of rights).

IV. LPR Government Decree No. 210/20 of 10.04.2020 on tax discounts in the LPR related to the
COVID-19 (amended by the Decree No. 269/20 of 29.04.2020 and the Decree No. 320/20 of
19.05.2020)

Duration: from 01.04.2020 to 15.05.2020 and some provisions to 31.05.2020.

Scope of application: legal entities and entrepreneurs, whose business activity was restricted due to
the COVID-19 preventive measures

Tax discounts: exemptions from income taxes and patent fees for entrepreneurs; exemptions from /
reductions of the unified social contribution conditional to the saving of jobs and payment of the
minimum salary; exemptions from payment of debt interest; release from penalties for violation of
tax law happened after 01.04.2020; release from penalties for foreign economic operations without a
registered foreign economic agreement; extension of terms of payment for land tax etc.
