discharge.
43-04 Operation - Observed 32inch channel drains on the walls of the small pool, no document was provided 04/22/2024
verifying the function of the drains. ------- Operational records of testing results and maintenance activities,
including documentation of approved drain covers, shall be retained on-site at a facility for not less than two
years. However, to the extent that state or federal law requires a more lengthy record retention period, the
records shall be retained for the entirety of the state or federally-mandated period.
265.203 Pools Yard and Spas Yard Enclosures Observed two openings on each side of the main gate leading from the 04/22/2024
hotel lobby. Openings measured at greater than 4 inches. -------- The Pools or Spas yard enclosure shall not
have openings in or under the enclosure and shall not allow the passage of a 4-inch diameter sphere.
265.203 Pools Yard and Spas Yard Enclosures Observed One gate, and two Doors, opening into the pool yard. ------- 04/22/2024
Gates and doors of the Pools or Spas enclosure shall open outward away from the Pools or Spas.
265.203 Pools Yard and Spas Yard Enclosures Observed second gate to be completely disassembled due to drowning 04/22/2024
incident. Unable to verify if gate is self closing and self latching. ------ Gates and doors of the Pools or Spas
enclosure shall be equipped with self-closing and self-latching devices that are designed to close and keep
the gate or door securely closed and latched at all times the gate or door is not in use.
265.203 Pools Yard and Spas Yard Enclosures Observed height of the enclosure by the gap to be measuring at 42 04/22/2024
inches. ------- The Pools or Spas yard enclosure shall have a minimum perpendicular height of at least 48
inches as measured from the ground surface on the outside of the enclosure.
265.205 Operation and Management of Pools and Spas Low water level due to drowning incident. ------- Actual 04/01/2024
water level in Pools and Spas shall be maintained within the design operating water level range of the rim,
gutter, or skimmer system and when the water level is below the operating water level range the Pools or
Spas shall be closed.
43-35 Enforcement and Closure - Upon closure of a facility pursuant to this section, the person in charge of the 03/25/2024
facility shall immediately properly post and maintain signs at all entrances to the facility that state:
"CLOSED UNTIL FURTHER NOTICE".
265.201 Safety Features for Pools and Spas Did not observe signs posted in the pool yard. ------- Signs shall be in the 04/08/2024
Pools yard, securely mounted as applicable, readily visible to the Pools user.

Re-Inspection Required
Upon arrival, spoke with Alex lead maintenance. He provided the permit which had a name change but under the same ownership. Name change was
conducted on both accounts. Main drain document was provided and still valid. However small pool has 32 inch channel drains on the walls, without
a valid document stating their function, date of installation and date of expiration. A full inspection was conducted, multiple violations were observed.
Video footage is available, however manager stated that the footage is being reviewed by legal, and we would have to wait to receive a copy.

Once video footage is available for review, please contact inspector below to acquire a copy of the surveillance footage.

“Please be advised that all pools and spas shall be maintained under the supervision and direction of a properly trained and certified operator. This
includes being able to provide the volume of the pool or spa to the inspector to confirm pool turnover times. Working flow measuring devices
(flowmeters) are necessary to calculate turnover times. Pools shall turnover in 6 hours or less, spas in 30 minutes or less, and wading pools in 1 hour
or less. Pre 1999 pools shall turnover in 8 hours or less. Enforcement action will occur at the next routine inspection if not in compliance.”

Pool shall remain closed until all violations are corrected and pool passes reinspection.

Reinspection may take place on or before 4/22/24.
