AFFIDAVIT OF DESISTANCE

I, ZOLIETO GIBO JABONE, of legal age, Filipino, married, and a

resident of F.S. Pajares Ave., San Jose District, Pagadian City, Philippines, after
having been duly sworn in accordance with law, hereby depose and say:
1. That I am the private complainant in the case filed before REGIONAL
TRIAL COURT, 9th Judicial Region, Branch 19, Pagadian City in
CRIMINAL CASE NO. 14985-2K20 entitled People of the Philippines
vs. JUNARD ARNON DICEN for Violation of Article 310 in relation to
Article 308 of the Revised Penal Code (QUALIFIED THEFT);
2. That the accused JUNARD ARNON DICEN and I have already agreed to
amicably settle the civil aspect of the case. We have agreed to fix the civil
indemnity in the amount of (Php 30,000.00) which shall be paid out of
the cash bail bond posted by the accused.
3. That I am no longer interested in the further prosecution of the case
against the said accused considering that the accused and I have already
settled amicably regarding to the civil aspect of the case.
4. That I am requesting this Honorable Office that the above-mentioned
case be dismissed;
5. That I execute this Affidavit of Desistance to attest as to the truth of the
foregoing facts and circumstances, to support the permanent dismissal of
this case and for whatever legal purposes it may serve.
