HOW TO COMPUTE??

The Employment Standards Act


The contract outlines the terms and conditions of employment and must
include the following:
- Duties the caregiver will have to perform
-Hours the caregivers will have to work in a day, and days in a week
- Wage rate – the minimum allowed is $16.55 an hour for general minimum wage (ONTARIO
BASED) – EFFECTIVE OCTOBER 2023
- Charge for room and board – the most allowed is $325.00 ( subject to change by regulation or
depending on your employer.
The employer has the right to set the caregiver’s work schedule. However, because caregiver’s live in
their employer’s homes, the line between “being at work” and “not at work” is often unclear.
When the employer asks the caregiver to baby-sit, or perform other duties outside of the normal
agreed hours at work, that time is work. It must be paid, and if it occurs after eight hours a day, of
forty hours a week (depends on the province), it must be paid at overtime rates.
Unless there is an emergency, caregivers must have at least 8hours free from work between shifts.
Caregivers must have 32 consecutive hours from work each week. Those hours do not need to be in
the weekend.
Caregivers can be required to work in split shift; however the shift must end no later than 12 hours
after it starts.
For example, a caregiver may be scheduled to work a split shift of 8am to 11am and 2:30pm to
8:00pm but not 8:30pm.
Employers and caregivers must agree on a higher wage rate, but not lower than the minimum
one. If monthly or yearly salary is paid, it must at least equal minimum wage for all hours
worked.
For example: to determine if salary of $3,180 a month for 44-hour work week at least equals
minimum wage. Calculate as follows:
$3,180x12(months)/52(weeks in a yr)
= $733.8/44(hrs per week)
= $16.67/hour
The monthly salary that pays minimum wage for a 44-hour week is $3,180.
OVERTIME PAY
In New Brunswick, Ontario, and Alberta , the employee only receive the time
and a half (1.5) pay increase when they’ve worked over 44 hours.
Nova Scotia and Prince Edward Island OT begin at 48 hours per week.
Other Provinces count OT count OT after 40 hours per week.
Overtime Pay
Overtime pay is the extra rate of pay for time worked over 8 hours in a day, or 40 hours in a
week.

Daily Overtime – when a caregiver works more than 8 hours in a day, she or he is entitled to 1.5
times regular wage rate, up to and including the eleventh hour. After the eleventh hour, the
caregiver is entitled twice the regular wage rate.
Example: Diane worked fours of OT on that week . She normally receives $16.84/hour.
Computation:
$16.84/hour x 1.5 = $ 25.01 an hour
4 hours x $ 25.01 = $ 100 (OT Pay)
WEEKLY PAY
Calculating weekly pay :
1. Calculate normal weekly pay :
Hours worked x Standard hourly wage
44 hr. x $ 16.55 = $ 728.2 (weekly pay)
2. Calculate total OT Pay :
OT hours worked x overtime hourly wage
4 hr(OT) x $ 25.01 = $ 100
3. Calculate total pay for the week:
Standard pay + overtime pay
$ 728.2 + $ 100 = $ 828.2 (TOTAL PAY FOR THE WEEK)
