5. Name of dispute as per section 2 (1) (c) of the Commercial Courts

Act, 2015 (4 of 2016): Ordinary transaction of Bankers involving

Recovery of Loan Amount along with Interest and Penal Interest.

6. Quantum of claim: Rs.7,90,513.15 (rupees Seven Lakh Ninety Thou-

sand Five Hundred and thirteen and Fifteen paisa Only) as on

06.02.2024 with further interest overdue with monthly rests from the
date of filing of the Mediation Application plus 2% Penal Interest from

the date of filing Mediation Application.

7. Territorial Jurisdiction of the competent court: The Applicant says

that the said loan facility was granted and monies payable there under

were lent advanced by the Applicant to Opposite Party No. at

Ghatkopar East, Mumbai District. The Opposite Parties have executed

the security documents herein above referred to in Ghatkopar East,

Mumbai. All monies due to the Applicant are payable by the Opposite

Parties in Ghatkopar East, Mumbai. The whole cause of action has

arisen in Ghatkopar East Mumbai. This Hon’ble Court has therefore,

jurisdiction to entertain, try and dispose off this Application.

8. Brief synopsis of Commercial dispute (not to exceed 5000 words)

1. 07.03.2020. The Applicant states that the Opposite Party

are engaged in business of manufacturing of

paper and paper products and had approached

to Applicant by making a Application for Pur-

chase of stocks dated 07.03.2020 which was

sanctioned by the Applicant for an amount of

Rs.8,00,000/- (Rupees Eight Lakh Only) ac-


cordingly Applicant had disbursed/ Sanc-

tioned a sum of 8,00,000/- (Rupees Eight

Lakh Only) respectively to Opposite Party

dated 07.03.2020.

2. 30.11.2021 & The Applicant states that the Opposite Party

20.11.2021 had again approached to Applicant by making

a Application under GECL credit facility ex-

tention scheme for Rs.3,00,000/- (Three

Lakhs Only), which was sanctioned by the

Applicant for an amount of Rs.3,00,000/-

(Three Lakhs Only), accordingly Applicant

had disbursed/ Sanctioned a sum of

Rs.3,00,000/- (Three Lakhs Only), respec-

tively to Opposite Party dated 20.11.2021.

2. 20.11.2021. In consideration of the Applicant having

granted the said loan, Opposite Party

executed various documents in favour of the

Applicant.

3. The Applicant say that the Opposite Party

however failed and neglected to conduct the

facility satisfactorily, as agreed to by him,

and to comply and observe the various terms

and conditions stipulated in the said security

documents. As a result the accounts became

highly irregular. The Applicant called upon

the Opposite Party to pay the overdue amount

outstanding in the said accounts and under

the circumstances the Applicant have through

their recall notice dated 31.12.2022

addressed to the Opposite Party called upon

them to make payment of outstanding dues as

fully mentioned therein.

4. Hence, Opposite Party are liable to pay to the

Applicant sum of Rs.2,28,368.48 (Rupees

Two Lakh Twenty Eight Thousand Three

Hundred and Sixty Eight and Forty Eight

Paise Only) as on 06.02.2024 in loan account

no-170002234322 as on 31.08.2023 and Rs.

537,425.93 (Five Lkah Thirty seven Thou-


sand Four Hundred and Twenty Five and

Ninety Three paise Only) as on 05.02.2024 in

loan ac no-173000164860 and Rs. 2920.84

(Two Thousand and Twenty and Eighty Four

paise only ) in loan ac no-50411400001854

as on 31.01.2024 and Rs. 21,797.90 (Twenty

One Thousand seven Hundred and Ninety
