To and In favor of
Sh. Manish Shukla s/o Sh. Santosh Shukla, a Hindu, aged about 24 years and residing
at 281n, Aashiyana Garden Phase, Chas, Bokaro Steel City, Jharkhand. herein
referred to as the MORTGAGEE.
Whereas: -
a) The term Mortgagor and Mortgagee, unless repugnant to the context shall mean
and include their representatives’ heirs, successors, executors, administrators,
trustees, legal representatives and assigns.
b) The Mortgagor herein, is the sole and absolute owner otherwise well and
sufficiently entitled, seized and possessed of the of immovable property, a
residential property located at Antilia, Ambani Tower, Altamount Road,
Cumballa Hills, PIN code: 400026, Mumbai, Maharashtra, India morefully
described in the schedule hereunder written and herein after called the scheduled
property.
c) The Mortgagor is the absolute owner, having acquired the property, by and since
then Mortgagor has been in possession and enjoyment of the schedule property
and paying taxes and levies thereon, as sole and absolute owner thereof.
d) The Mortgagor being in need of finance for the purpose of his buying a premier
league football team name “Liverpool Football Club”. and the. Mortgagor
requested the Mortgagee to lend him a sum of Rs. 8250 crore – (Rupees Eight
Thousand Two Hundred Fifty Crore Only) which the Mortgagee has agreed to
lend to the Mortgagor @5% per annum upon the terms and conditions set out
therein against the security by way of Usufructuary Mortgage of the said
Residential Property.
e) The Mortgagee has called upon the Mortgagor to create Usufructuary Mortgage
on the said Residential Property as and by way of security for repayment of the
Loan and payment of interest as hereinafter provided.
2. The Mortgagor admits and acknowledges that he owes a sum of Rs. 8250 crore
to the Mortgagee on the basis of promissory note and receipt dated 23/08/2023
executed by him in favour of the Mortgagee.
3. The Mortgagor shall be liable to pay interest on the above stated principal sum
of Rs. 8250 crore @ 5% per cent per annum form the date of the loan until
payment and in this manner the total charge of the referred property of the
Mortgagor shall be the principal sum of Rs. 8250 crore and interest accruing
thereupon.
4. The Mortgagor will pay to the Mortgagee the said sum of Rs. 10312 crore in
equal monthly instalment of Rs. 171.8 crore per month on or before the 24/
08/ 2028. The instalments must be paid through promissory note.
5. Any interest not paid on the due dates shall be treated as principal and added to
the principal sum herby secured and bear interest at the rate @5% and payable
on the half yearly days aforesaid.
i. That the said premises are free from all encumbrances and the Mortgagor
undertakes that until the entire principal amount and interest, if any due, is not
paid back to the Mortgagee, the Mortgagor shall not create any fresh mortgage,
charge, pledge, or in any other manner, alienate the corpus or his interest in the
aforesaid property to any third person.
ii. Mortgagor by repaying the said principal sum of Rs. Rs. 8250 crore with all
interest and other moneys due to the Mortgagee (hereinafter referred to as the
Mortgage amount) the Mortgagor will redeem the said scheduled property from
the mortgage security and shall if so required by the Mortgagor execute a deed
of Release but at the costs of the Mortgagor.
iii. If the Mortgagor fails to pay the sum with interest after it has become payable
under the provisions of this deed, the Mortgagee shall, in addition to any other
remedy available to him under the law, have the power to sell without the
intervention of a Court the mortgaged property or any part thereof for the
realization of the money due to it hereunder.
iv. And it is further agreed and declared by the Mortgagor that he shall also be
liable to pay and shall pay all the costs, charges and expenses that the Mortgagee
will incur for the protection of the mortgage security and or for the realisation of
the mortgage amount and the same shall be deemed to form part of the mortgage
amount and the security there for as aforesaid.
v. The Parties also consent that the cost of registration of this deed with stamp duty
and other misc. expenses shall be borne by the Mortgagor
