MEMORANDUM OF MUTUAL UNDERSTANDING


BETWEEN WIFE AND HUSBAND

This Memorandum of Understanding is made and executed on this the ___day


of February 2024 at Mannady, Chennai by and between: -

Mohamed Iliyas, S/o Syed Farook, Aged 39 Years, Occ: Godown Incharge ,
Religion: Muslim, R/o. Flat No.36/37, salai vinayagar Koil street, Mannady,
Chennai, Tamilnadu-600001 (Hereinafter called First Party, his legal heir,
agents, executors, administrators, etc.,)

AND

Priyanka Gonuguna @ Dhiyana Safa, W/o Mohamed Iliyas, D/o Sudakar


Rao, Aged: 33 Years, Occ: Data Scientist , R/o Flat No. 105, Karthik Paradise
Apartment, Ritwik Enclave, Nellore, Current Office Ap- 524004. (Hereinafter
called Second Party, her legal heir, agents, executors, administrators, etc.,)

WHEREAS the marriage between the first party and second party was
solemnised according to Muslim rites and ceremonies on ------------- at
Chennai. then the same will be registered at Chennai Under special Marriage act
on ----------------------, after the marriage the parties lived together as husband
and wife at Chennai for brief period and second party left to Bangalore for work
and they led happy marital life for 7 years, during their wedlock they were
blessed with one daughter by name Daaniya Ishana on 16-09-2016.

And whereas Second Party was Employed in the Bangalore and Living Alone
parties couldn’t enjoy their married life happily and now the parties are living
separately from -------.
The Marriage between the Parties has Irretrievably broken down and it’s
difficult to lead healthy conjugal life. So both the parties have decided to annul
the Marriage by mutual consent and this memorandum of Understanding is
executed between the first and second party.

THIS MEMORANDUM OF UNDERSTANDING AS FOLLOWS:

In consideration of the promises made by the parties to each other both the First
Party and the Second Party covenant and agrees as follows:

1. Mutual consent Divorce was agreed by both parties.

2. There is no chance of a reconciliation of marriage between the parties or


resumption of normal marital relationship in future and as such the elders
resolved the matter as below stated.

3. That both parties are declaring that, there are no other criminal or civil
cases pending before any court, forum, or authority. If any, such cases are
pending the claimant party is liable to withdraw without any future
conditions.

4. The First Party Agreed to Handover the daughter to the Custody of


second party on condition that, he will have a unrestricted visitation
anytime and if child is taken abroad Second Party Should provide visa for
the same.

5. The First party and Second party agreed to file the Mutual Consent
Divorce Petition before the Hon’ble judge Family Court (High Court) at
Chenai within One month of the MOU.

6. That both parties already have exchanged their belongings, household


articles, valuable Silver Articles, Gold ornaments and valuable documents
much before the time of desertion of the conjugal society itself and there
are no pending, claims, stridhan, or any kind of things at either party.

7. The both parties Agreed that there is No need of Further settlement Now
and Future, so Neither party shall make any further claims against the
other in future. of alimony and maintenance, and The Both Party has
relinquished all kind of rights of past, present, and future about the
maintenance, any kind of assets either moveable or immovable and
declared no pending stridhan etc.

8. That after signing of this MOU, no party shall file any type of case
including criminal, civil, and matrimonial against each other or their
respective family members, relatives, and friends in respect of the said

settlement. Both parties shall not publish or spread any gossip or negative
messages either of them.

9. That each Party can enforce the Civil or Criminal against the other, in
case of any violation by any of this MOU. The present MOU executed by
both parties with their own will and volition and without any due
pressure, influence, or coercion from any party whatsoever.

10.That both parties shall not withdraw their consent for obtaining the
divorce by mutual consent till they obtained the divorce by mutual
consent and both parties have surrendered their rights to withdraw their
consent for obtaining the divorce by mutual consent.

11. It is agreed that after the execution of the terms and conditions stated
above there shall be no claim left between the parties against each other
in any manner whatsoever. Both parties shall not raise any claim or right
over the property’s immovable or movable of the both parties or their
Parents and relatives in future. Both Shall not file any other criminal or
other Complaint against Each other or their family members within the
jurisdiction in India or Abroad.

12. That it is further agreed between both the parties that they would not
have any communication or contact with each other, with each other’s
friends, family members or relatives. They shall not create any situation
which may defame or lower the reputation of the parties or their family
members in the society. It is further agreed they shall not enter at each
other’s workplace as well.

13. That it is hereby declared that both parties have entered into this
agreement with a complete understanding of his or her legal rights in and
subject to the terms and conditions mentioned hereinabove and have
executed this agreement freely and voluntarily without coercion or undue
influence of any kind or nature.
This Memorandum of Understandings is made and executed with the
consensus of both parties with their free will and consent and without any force
or coercion and set their hand on this deed on the day, month and year as
mentioned above.
