MEMORANDUM OF UNDERSTANDING

THIS DEED OF DISSOLUTION OF MARRIAGE/DIVORCE DEED IS

MADE AND EXECUTED AT DELHI ON THIS ____day of September

‘2021.

BETWEEN

SH. ………………..S/O SH. ABC R/O ……………….DELHI-110018

(HEREINAFTER CALLED THE FIRST PARTY/HUSBAND.)

AND

Ms. ………………W/O SH. XYZ D/O SH ………. R/O

………………..DELHI 110018 (HEREINAFTER CALLED THE

SECOND PARTY/WIFE).

WHEREAS, the both parties are major and they are Indian Hindu

and they got married to each other according to Hindu rites and
custom on 21.01.2003.From their marriage two children, namely,

XXX was born on 1.05.2005 and XXX was born on 12.01.2014.

AND WHEREAS, both parties due to some temperamental

differences and thought process could not live with each other and

they have decided to live separately from each other with their own

consent, free will and without any force or pressure from any side.

AND WHEREAS, both parties have signed the present MOU with

their consent, free will and without any force or pressure from any

side. Hence this MOU.

NOW THE TERMS AND CONDITIONS ARE AS UNDER :

1. That after signing of this memorandum of Understanding, both

parties shall live separately at any place they wish to live and

other party will not interfere in their life in any manner

whatsoever. They will have no right, title or interest over each

other’s belongings etc.


2. That both parties will not file any petition, complaint against

each other in any manner whatsoever. In case, they wish to do

so, they will first talk to each other and will decide mutually.

3. That at present the parties have mutually settled their disputes

and they are signing the present Memorandum of Understanding.

The terms of settlement are as follows:

I. It has been agreed between the parties that both the

parties will live in the same premises separately and

the first party shall bear all the expenses of the second

party and their children.It is further agreed that first

party will bear all the expenses of childrenincluding

their education presently and in future also, the first

party will also bear expenses of marriage of the

children.

II. It is agreed between the parties that first party shall

not harass the second party and the children, in any

manner whatsoever may be, physically or mentally.


III. It is agreed between the parties that first party shall

have all the rights with respect to the children

including the visiting in the portion of second party,

talking with the children and what so ever.

IV. It has also been agreed between the parties that this

settlement is full and final. Although, there is no case

or complaint pending, except the present cause, but

still both parties undertake not to file any

case/complaint/suit/petition etc. against each other

and shall be entitled to lead their life independently

and both the parties shall not interfere in the life of

each other as well as family members of each other.

V. It has been agreed between the parties that the first

party will not use abusive language or any other form

of force or aggression against the second party or the

children or her parents.


VI. It has also been agreed between the parties that the

first party will hand-over, all the jewellery and valuable

of which belongs to the second party, to the second

party.

VII. This settlement has been voluntarily arrived at

between the parties with their own free will and

without any force, pressure or coercion and both the

parties will remain bound by this Memorandum of

understanding and the terms and conditions

mentioned herein above. The contents of the

settlement have been explained to the parties in

vernacular and they have understood the same and

have admitted the same to be correct. None of the

parties shall file any civil or criminal proceedings

against each other in future and that if any other

case/petition/compliant etc: between the parties is

pending in any court or Authority either against the

parties or against their respective family members and

whether it is in the knowledge of other party or not,


the same shall be withdrawn/got disposed off by the

respective party.

4. The parties submit that after fulfilling all the stipulations.

mentioned above the parties state that they have no further

claims or demands against each other except as settled /decided

above and all the disputes and differences have been amicably

settled by the Parties.

5. That if any Party files any complaint which is not in the

knowledge of either of the parties in any court of law, police, or

any other authority either in New Delhi or any Part of India, then,

it shall be deemed to be considered as compromised and

withdrawn and shall not have any legal effect.

6. That in case, either of the party withdraw from the terms. and

conditions of this Compromise Deed then the other. party shall

have right to take appropriate action against the other party

before the appropriate court of law.


7. That both parties undertake that they shall abide by all terms

and conditions mentioned in the present MOU.

IN WITNESSES WHEREOF, both parties have signed on this MOU

on the day, month and year mentioned above in the presence of

following witnesses.
