INTRODUCTION
1. The Local Content Performance Report as enshrined in Regulation 34 (1) of the Petroleum (Local
Content and Local Participation) Regulations, 2013 (L.I.2204) states that:
‘A contractor, subcontractor, licensee or other allied entity shall within forty-five days of the beginning
of each year after commencement of petroleum activities submit to the Commission an Annual Local
Content Performance Report covering all projects and activities for the year under review’.
2. The Local Content Plan as enshrined in Regulations 7, 9, 21, 24, 27, 30, 32 and 33 of the Petroleum
(Local Content and Local Participation) Regulations, 2013 (L.I. 2204). Regulation 7(1) of L.I. 2204
stipulates that:
a. A contractor, subcontractor, licensee or other allied entity shall before engaging in a petroleum
activity prepare and submit a Local Content Plan for approval to undertake the petroleum activity.
b. Regulation 7(2) of L.I. 2204 requires a Long-Term Local Content Plan and an Annual Local
Content Plan to be submitted to the Commission.
This document provides the format and the procedure for submitting Local Content Performance Report
to the Petroleum Commission for approval in accordance with L.I.2204.

SUBMISSION OF DOCUMENTS
The Local Content Reporting Templates that are submitted to the Commission should have the following:
The soft copies of the submitted documents should be uploaded on the E-portal which can be accessed
through the Petroleum Commission website (https://www.petrocom.gov.gh/).
The Local Content Regulations stipulates sanctions for providing false information to the Commission.
Specifically, Regulations 46 (1) and 46(2) states amongst others that:

A person who submits a plan, returns, report or other document and knowingly makes a false statement
commits an offence and is liable on summary conviction to a fine or a term of imprisonment or both.
A citizen who acts as a front or connives with a foreign citizen or company to deceive the Commission as
representing an indigenous Ghanaian company to achieve local content requirement commits an offense.

NOTE: Evidence of financial support and/or Training programmes undertaken or provided should be
attached as appendix to the document.
D. INVESTMENTS
The company should outline any capital investments made towards its operations or local content
achievements. This should include the following:
a. Description of the investment e.g., infrastructure, facilities, equipment, etc.;
b. Current and cumulative expenditure incurred on the investment;
c. Evidence of investment undertaken as appendix to the document;
NOTE: Capital investment is an acquisition of permanent fixed assets, and this is meant to benefit a
company in the long run.
The company should report on spend on locally produced goods, materials and services used in the
execution of upstream petroleum related contracts. The company should provide reasons for the
omission of data.

PURPOSE
PETROLEUM COMMISSION
This Plan in accordance with Regulations 7, 9, 21, 24, 30 and 32 seeks to maximize the use of local
expertise, goods and services in the petroleum industry value chain and the retention of benefits within
Ghana.
A contractor, sub-contractor and any other allied entity engaged in petroleum activities is required by the
Local Content L.I.2204 to incorporate local content as an important element in their project execution and
management philosophy. Every petroleum project, activity or transaction must have a Long-Term Local
Content Plan in line with the duration of the contract awarded which would be assessed and approved by
the Commission.
The Annual Local Content Plan should be in line with the programmes, activities and initiatives in the
Long-term Local Content Plan.

B: INSURANCE SERVICES SUB-PLAN – REGULATION 27 – 28
A contractor, subcontractor, licensee or other allied entity shall obtain the services of an insurance
company and insure all risk related to the petroleum upstream activities in accordance with the Insurance
Act, L.I. 2204 and the Insurance Protocol.

insurance services utilized and to be obtained.
